HomeMy WebLinkAboutPC RES 31542 3 4 5 6 7 8 lO 19 20 2! 22 28 RESOLUTION NO. 3154 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 93-019 TO ALLOW THE CONSTRUCTION OF THIRTEEN GARAGES, LAUNDRY FACILITIES, POOL FACILITIES AND SITE IMPROVEMENTS AT THE CONDOMINIUM COMPLEX LOCATED AT 15500 TUSTIN VILLAGE WAY. The Planning Commission of the City of Tustin does hereby resolve as follows: I.- The Planning Commission finds and determines as folloQs' · -. a~ That a proper application, Conditional Use Permit 93-019, has been filed by James Whaley, to construct thirteen garages, a laundry facility, pool facilities and site improvements at the condominium project located at 15500 Tustin Village Way. Be That a public hearing was du%y called and noticed for said application on July 12, 1993, and was continued to and held on July 26, '1993 by the Planning Commission. Ce That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals,..~ .cqmfort, or general welfare of the persons residing or working in the neighborhood of such proposed .use, nor detrimental to the' property and -i~provements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin as evidenced by the following: · The proposed modifications are necessary due to a Caltrans acquisition for freeway widening. The design of the improvements are compatible with the surrounding neighborhood in that they are one story in height and constructed of concrete block, wood and other materials existing in the construction' of surrounding structures. The improvements wo61d not be detrimental to the health, safety and general welfare of the persons residing in or working in the neighborhood as the improvements would be constructed according ~to all City and Uniform Building' Code requirements. 'D. This project is Categorically Exempt from the requirements of the California EnvirOnmental Quality Act, pursuant to Section 15303 (Class 3). II. MIT 93-019 A. GENERAL 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped July 26, 1993 on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. Minor modifications may be approved by the Director of Community Development if such modifications are found to comply with applicable standards and the scope of this project. 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project subject to review and approval by the Community Development Department. 1.3 Approval of CUP 93-019 shall become null and void unless all building permits are issued within eighteen (18) months of the date of this Exhibit. 1.4 Any public improvements damaged by the applicant adjacent to this property shall be repaired and/or replaced as determined by the Engineering Division and shall include, but not be limited to curb, and gutter, street paving and drive apron. 1.5 Approval of CUP 93-019 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. 1.6 The applicant and property owner shall hold harmless and defend the City of Tustin for all claims and liabilities arising out of the City's approval of the entitlement process for this project. (4) 1.8 Prior to permit issuance, the property owner shall record an amendment to the CC&R's amending the diagrammatic exhibits to show the revised parking layout for the project including the addition of the adjacent 0.2 acre parcel with proposed development of 13 garages and 8 open spaces. The CC&R's shall identify assignment of all parking spaces. All organizational documents for the modifications, including CC&R's and deed restrictions shall be submitted to and approved by the Community Development Department and the City Attorney's office. A copy of the final documents shall be submitted to the Community Development Department after their recordation. (7) 1.9 Approval of Conditional Use Permit is contingent upon City Council approval of Zone Change 93-003. Failure of the city Council to approve the request will result in Conditional Use Permit 93-019 becoming null and void. B. SITE AND BUILDING CONDITIONS (1) 2.1 Construction of the proposed garages shall comply with (2) the 1991 Uniform Building Code. Specifically, construction shall comply with Uniform Building Code (UBC) Section 504-b, 1710 and Chapter 30 for the fire resistance of exterior walls, parapet walls and roof coverings respectively. Roof coverings shall be a minimum of Class "C" rating pursuant to Tustin City Code. (1) 2.2 Restroom facilities shall comply with the requirements of (2) the handicapped regulations. (1) 2.3 The laundry facility shall comply with UPC Appendix "C" (2) regarding the required number of washers and dryers for the multiple dwelling units. (1) 2.4 The construction of all .new structures shall in all (2) respects comply with the Building Codes, City Ordinances and State and Federal laws and regulations. (1) 2.5 Indicate lighting scheme for the proposed parking area, laundry and restroom facilities and trash enclosure. Note locations of all exterior lights and types of fixtures. Lights to be installed on buildings shall be Exhibit A Conditions of Approval Resolution No. 3154 Page 3 of a decorative design. One foot-candle of light shall be provided in the parking area in conformance with the City Security Ordinance. No lights shall be permitted which may create any glare or have a negative impact on adjacent properties. The location and type of lighting shall be subject to the approval of the Director of Community Development. (1) 2.6 Exterior elevations of each proposed building shall indicate any fixtures or equipment to be located on the roof, equipment height and type of screening. All parapets shall be at least six inches above rooftop equipment for the purpose of screening. (4) 2.7 Wheel stops shall be prohibited for all new open parking spaces proposed. Six inch continuous concrete curb and a 2 foot - 6 inch overhang into the landscape planter shall be utilized to stop vehicles. (4) 2.8 The property owner shall apply a protective graffiti resistant finish on the rear and side surfaces of the proposed garage structures, on the outside of the laundry and restroom facilities which face areas of vehicular circulation, and on proposed concrete block walls which face areas of vehicular circulation, subject to the review and approval of the Community Development Department Director. (4) 2.9 The property owners shall be responsible for the daily maintenance and upkeep of the subject improvements, including the removal of graffiti. All graffiti shall be removed within 72 hours of a complaint being.transmitted by the City to the property owner. Failure to maintain said structures will be grounds for City enforcement of its Property Maintenance Ordinance, including maintenance and abatement procedures. (7) 2.~0 The proposed split-faced concrete block wall to be constructed on the east side of the existing swimming pool and providing enclosure of the trash area shall be a maximum of 6 feet 8 inches in height, pursuant to Tustin City Code. LANDSCAPING, GROUNDS AND HARDSCAPE ELEMENTS (1) 3.1 Submit at plan check complete detailed landscaping and irrigation plans for all landscaping areas consistent with adopted City of Tustin Landscaping and Irrigation Submittal Requirements. Provide summary table identifying plant materials. The plant table shall list botanical and common names, sizes, spacing, location and quantity of the plant materials proposed. Show planting and berming details, soil preparation , staking, etc. The irrigation plan shall show location and control of backflow prevention devices, pipe size, sprinkler type, spacing and coverage. Details for all equipment must be provided. Show all property lines on the landscaping and irrigation plan, public right-of-way areas, sidewalk widths, parkway areas, and wall locations as applicable. The Community Development Department may request minor substitutions of plant materials or request additional sizing or quantity materials during plan check. Note on landscaping plan that coverage of landscaping and irrigation materials is subject to field inspection at project completion by the Department of Community Development. (7) 3.2 The submitted landscaping plans at plan check shall reflect the following requirements: ae Shrubs shall be a minimum of 5 gallon size and shall be spaced a minimum of 5 feet on center. Be Ground cover shall be planted between 8 to 12 inches on center. Ce Fences, walls and equipment areas shall be screened with shrubs and/or vines and trees. Do Ail plant materials shall be installed in a healthy vigorous condition typical to the species and must be maintained in a neat and healthy condition. Maintenance includes but is not limited to trimming, moving, weeding, removal of litter, fertilizing, regular watering and replacement of diseased or dead plants. The groundcover Hedera Helix shall be replaced with another groundcover selected from the City's Landscape and Irrigation Standards preferred plant list. (4) 3.3 The six-foot wide Caltrans easement area behind the easterly garages and the soundwall, and the area between the westerly garages and the property line shall be improved with gravel, filled to a minimum of four inches. D. PLA/q SUBMITTAL (2) 4.1 At plan check, submit three (3) sets of construction plans. Requirements of the Uniform Building Code shall be complied with as approved by the Building Official. No field changes shall be made without corrections submitted to and approved by the Community Development Department. (2) 4.2 Preliminary technical detail and plans for all (3) utility installations including cable TV, telephone, gas waster and electricity. Additionally, a note on plans shall be included stating that no field changes shall be made without corrections submitted to and approved by the Building Official. E. FEES (1) 5.1 Payment of all Building plan check and permit fees shall be made prior to issuance of any building permits in accordance with the Tustin City Code. BCS: br: cup93019
