RESOLUTION NO. 3450
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, CONDITIONALLY APPROVING CONDITIONAL USE
PERMIT 93-009 AUTHORIZING THE DEVELOPMENT OF PATIO
HOMES PURSUANT TO SECTION 3.6.3.C OF THE EAST
TUSTIN SPECIFIC PLAN ON TRACT 14782
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:
a.
That a proper application, of Conditional Use
Permit 93-009, has been filed on behalf of
California Pacific Homes to request authorization
to Develop patio homes pursuant tc Section 3.6.3.C
of the East Tustin Specific Plan Tract 14282.

That a public hearing was duly called, noticed and
held on said application on June 28, 1993, by the
Planning Commission.

That establishment, maintenance and operation of
the use applied for will not, under the
circumstances of this case, be detrimental to he
health, safety , morals, comfort, or genera1
welfare of the persons residing or ~orking in the
neighborhood of such proposed use, nor detrimental
to the property and improvements in the
neighborhood of the subject property, nor to the
general welfare of the City of Tustin as evidenced
by the following'

The development of patio homes restricts the
density of the development to- 15 dwelling
units per acre. Actual development of the
project would be 9.4 dwelling units to the
---acre. Zoning for the site would permit a
maximum density of 18 dwelling units per acre
under attached single family or condominiu~
development standards. The development of
patio homes on this site would provide a
reduction of density to 52% of the permitted
maximum density.

The development of patio homes provides for a
minimum open space requirement of 400 square
feet per unit. The propcsed development
provides a minimum of 510 square feet of oper
area for several units and a maximum of 3,45C
square feet for one unit. The average oper
area per family unit is 742.6 square feet, ar

increase cf 185.65 percent.of the required
open space per dwelling unit.
The proposed development is configured in an
orderly fashion with a clear hierarchy of
streets including a private loop street,
private court (streets) and private court
(drives), zhe arrangement of which provides a
protected circulation system.

The proposed patio home development would
conform to all of the requirements of the East
Tustin Specific Plan, applicable City Codes,
the Uniform Building Code and all Fire and
Safety Codes and as such, would not be
detrimental to the health, safety, morals,
comfort or general welfare of the persons
residing in the neighborhood nor to the
general welfare of the City.
II. The Planning Commission hereby approves Conditional UsE
Permit No. 93-009 authorizing the development, of patio
homes pursuant to Section 3.6.3.C. of the East Tustir
Specific Plan on Tract 14782 subject to the conditions
contained in Exhibit A of Planning Commission Resolutior
No.s 3149 and 3151.
