HomeMy WebLinkAboutPC RES 3145 2 3 5 6 7 8 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 25 27 RESOLUTION NO. 3145 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, WHICH AMENDS DESIGN REVIEW 90-055 TC MODIFY THE SITE PLAN FOR TENTATIVE TRACT 14381 TC ADD 12 ADDITIONAL DWELLING UNITS, CONDITIONALLY APPROVING DESIGN REVIEW 92-043. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: a. That a proper application, Design Review 92-043 was filed by California Pacific Homes requesting to amend Design Review 90-055 to modify the site plan for Tentative Tract 14381 to add 12 additional detached single family dwelling units, to the project. Tentative Tract 14381 incudes a-total of 22.62 acres and the 12 additional dwelling units are proposed to be located on Lot I of Tentative Tract 14381; and B· That the said application was considered on June 28, 1993 by the Planning Commission. Ce Pursuant to Section 9272 of the Tustin Municipal Code, the Commission finds that the location, size, architectural features and general appearance of the proposed development will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Commission has considered at least the following items: . 1. Height, bulk and area of buildings. 2" ..-Setbacks and site planning. 3. Exterior materials and colors. 4. Physical relationship cf proposed structures to existing structures ~n the neighborhood. 11. Appearance and design relationship of proposed structure to existing ssructures and possible feature structures in the neighborhood and public thoroughfares. , 12. Development Guidelines and criteria as adopted by the City Council. II. The' Planning Commission hereby conditionally approves Design Review 92-043 amending Design Review 90-055 tc modify the site plan for Tentative Tract 14381 and authorize construction of 12 additional detached single- family dwellings subject to the conditions contained in Exhibit A, attached hereto. Recording Secretary EXHIBIT A RESOLUTION NO. 3145 CONDITIONS OF APPROVAL DESIGN REVIEW 92-043 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans date stamped June 28, 1993 on file with the Community Development Department as herein modified or as modified by the Director of Community Development in accordance with this Exhibit. The Director of Community Development may also approve subsecuent minor modifications to plans during plan check if such modifications are to be consistent with provisions of the East Tustin Specific Plan. (1) 1.2 Unless otherwise specified, the conditions contained in the Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Design review approval shall become null and void unless all building permits are issued within eigh%een (18) months of the date of this Exhibit. (1) 1.4 The applicant shall sign and return an Agreement to Conditions Imposed form prior to issuance of building permits. (1) 1.5 The applicant and property owner shall hold harmless and defend the City of Tustin for all claims and liabilities arising out of the City's approval of the enuitlement process for this project. (1) 1.6 Ail conditions of the original Design Review 90-55, included in Planning Commission Resolution 2936, shall apply to he expansion area unless superseded by conditions contained herein. SOURCE CODES (1) STANDARD CONDITION (5) RESPONSIBLE AGENCY REQUIREMENT (2) CEQA MITIGATION (6) LANDSCAPING GUIDELIA~S (3) UNIFORM BUILDING CODE/S (7) PC/CC POLICY (4) DESIGN REVIEW *** EXCEPTION Exhibit A - Conditions of Approval Resolution No. 3145 Page 2 SITE AND BUILDING CONDITIONS *** 2.1 The applicant shall provide rain gutters and downspouts for all building elevations that have no eave overhangs. *** 2.2 The unit bedroom mix for the project shall not exceed 30% - four bedroom units. *** 2.3 Temporary construction fencing shall not be permitted to be located within the required travelway of the private streets and courts. *** Z.4 The site plan shall identify the location of air conditioning equipment and the distance from an adjacent dwelling. A minimum 15 foot separation from window openings on adjacent dwellings shall be provided, unless screened by a 5 foot high masonry wall. LANDSCAPING, GROUNDS AND HARDSCAPE ELEMENTS (5) 3.1 Ail final mailbox locations and orientation for the expansion area and original project, excluding mailboxes on Lots 37, 47, 48, 57 and 58 of Final Tract Map 14567, shall be subject to the review and approval of the Community Development Director. In determining final location, the Director shall consider the following: a · mailboxes shall be located as close as possible to a designated parking space; b. mailboxes shall not be located within ten (10) feet of a street/court intersection, or within ten (10) feet from the back of curb return; and C· the location of mailboxes should encourage people to walk to their mailboxes. FEES (1) 4.1 Payment of all fees is required in accordance with Condition 9.1, 9.2 and 9.3 of Exhibit A of Planning Commission Resolution No. 3147.
