The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: A· A proper application, Variance 91-15, filed on behalf of Bill and Barbara Mathis, has been approved to allow a variance from the City's parking requirement, permitting a reduction from 34 parking spaces to 23 spaces at the furniture store, located at 1471 Nisson Road. This project was approved on November 12, 1991, by the adoption of Resolution No. 2974. B. ' A public hearing was duly called, noticed and held on May 10, 1993, by the Planning Commission. C® This project is Categorically Exempt from the requirements of the California Environmental Quality Act (CEQA), pursuant to Section 15311 (Class 11). De A time extension is needed due to delays caused by litigation. II. The Planning Commission of the City of Tustin, California, hereby approves a one-year time extension of Variance 91-15, subject to the conditions contained in Exhibit A, attached hereto. o .. This condition supercedes Condition No. 1.3 of Resolution No. 2974. (1) 1.2 Ail conditions of approval of Resolution No. 2974, except Condition No. 1.3, shall remain in effect. (1) 1.3 The applicant shall hold harmless and defend the City of Tustin from all claims and · liabilities arising out of the City's approval of the entitlement process for this project.
