RESOLUTION NO. 3129
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING
CONDITIONAL USE PERMIT 92-048 APPROVING THE
ESTABLISHMENT OF A COMMERCIAL RECREATION
CENTER AT 2802 EL CAMINO REAL.
The Planning Commission of the City of Tustin does hereby
resolve as follows:

The Planning Co~mi$$ion finds and determines as
follows:

That a proper app].ication, (Use Permit No. 92-
048) has been filed on behalf of Little Fun
Station/Donahue $chrieber to authorize the
establishment of a commercial recreation
center to include play area, restaurant, party
rooms and child care facilities.

That a public hearing was duly called, noticed
and held on said application on March 22, 1993
by the Planning Commission.

That establishment, maintenance, and operation
of the use applied for will not, under the
circumstances of this case, be detrimental to
the health, safety, morals, comfort or general
welfare of the persons residing or working in
the neighborhood of such proposed use,
evidenced by the following findings: . -
1)
The establishment of a commercial
recreation center will provide diversity
of uses within the Market Place and the
child care facility will provide a
service to patrons of adjacent
businesses.
2)
There is adequate parking on site to
accommodate the use.
3)
The proposal is consistent with zoning
regulatioDs of the East Tustin Specific
Plan.

That the establishment, maintenance, and
operation of the use applied for will not be
injurious or detrimental to the property and
improvements in the neighborhood of the
subject property, not to the general welfare
of the City of Tustin for the reasons stated

It has been determined that this project is a
minor alteration to an existing facility and
is, therefore, Categorically Exempt (Class 1)
from the California Environmental Quality Act.
II. The Planning Commission hereby approves Conditional
Use Permit No. 92-048 to authorize the
establishment of a commercial recreation center at
2802 El, Camino Real, subject to the conditions
attached hereto and identified at Exhibit .A, and
incorporated herein by reference.
PASSED AND ADOPTED by the Planning Commission of the City
of Tustin at a regular meeting held on the 22nd day of
March, 1993.

GENERAL
(1) 1.1 The proposed project shall substantially
conform with the submitted plans for he
project date stamped March 22, 1993 on file
with the Community Development Department, as
herein modified or as modified by the Director
of the Community Development Department in
accordance with this Exhibit.
(1) 1.2 Unless otherwise specified, the conditions
contained in this Exhibit shall be complied
with prior to the establishment of the outdoor
dining area, subject to review and approval by
the Community Development Department.
(!) 1~3 The applicant shall hold harmless and defend
the City of Tustin from all claims and
liabilities arising out of the City's approval
of the entitlement process for this project.
(1) 1.4 The applicant and property owner shall sign
and return the Agreement to Conditions form.
(8) 1.5 Ail conditions of approval for Conditional Use
Permit 92-048 and applicable requirements of
the Tustin Cizy Code shall be complied with at
all times. Any violations thereof will be
grounds for initiation of proceedings to
consider revocation of Conditional Use Permit
92-048.

USE RESTRICTIONS
2.1
The drop off child care facility shall be limited
to a maximum of four hours per period per child.
There shall be no more than 22 children at the care
facility at any one time.

Ail signs must meet the requirements of the Tustin
Market Place Master Sign Program and are subject to
review and approval of the Community Development
Department.
The children's day care center shall receive
approval from the Orange County Social Services
Department and shall maintain a valid license.
Parking for the proposed use shall be calculated at
the following rate:
Restaurant/Party Room 1 Space/75 square feet
Remainder of Area 1 Space/200 square feet
A total of 82 spaces are required for the subject
use based upon floor plans submitted with
application. The additional 27 spaces shall be
provided at the rear of the building. A parking
lot striping plan for the new rear parking area
shall be provided consistent with the City's
Parking Lot design standards and shall be approved
by the Community Development Department prior to
issuance of building permits.
Ail employees shall be required to park in the rear
lot.
PLAN SUBMITTAL
4.1
At building plan check submittal:
Provide construction plans, structural calculations,
and Title 24 energy calculations. Requirements of
the Uniform Building Codes, State Handicap and
Energy Requirements shall be complied with as
approved by the Building Official.

FEES
Payment of all applicable plan check and building
permit fees to the Community Development Department
shall be requi~ed prior to the issuance of any
building permits.
