A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, FOR SIGN CODE
EXCEPTION 92-007 .APPROVING THE REQUEST TO
PERMIT THE INCREASE OF THE MAXIMUM SIGN SQUARE
FOOTAGE OF THE TENANT SIGN AREA FROM SIX (6)
SQUARE FEET TO A MAXIMUM OF 10.25 SQUARE FEET
IN CONJUNCTION WITH A TENANT DIRECTORY
MONUMENT SIGN LOCATED AT 12821 NEWPORT AVENUE,
TUSTIN.
The Planning Commission of the City of Tustin does hereby
resolve as follows:

The Planning Commission finds and determines as
follows:

That a proper application, Sign Code Exception
92-007, has been filed by Tarbell, Realtors on
behalf of Mr. and Mrs. James London, the
property owners, requesting a Sign Code
Exception from the City of Tustin Sign Code to
permit the increase of the maximum sign square
footage of the tenant sign area from six (6)
square feet to a maximum of 10.25 square feet
in conjunction with' a tenant directory
monument sign.

Pursuant to City of Tustin Sign Code Section
9204C, the request can be supported ~y the
following findings:

Sign size and placement restrictions of
the Siqn Code will be followed as closely
as practicable in that the proposed
monument sign's overall sign area, height
and location are as prescribed in the
Sign Code. While the exception would
permit the individual tenant sign areas
to exceed what is permitted in the Sign
Code, the proposed design of the monument
limits the number of tenant signs that
may be disPlayed to three promoting the
intent of the Sign Code to reduce sign
clutter.

The intent and purpose of the siqn
requlations have been followed as closely
as practicable in that with an increase
in tenant sign area, the individual
office buildings within the complex are
provided the opportunity for effective
identification while at the same time
meeting the remaining sign regulations.

There are special circumstances unique to
the property which ~ustifies the
Exception in that the existing office
buildings are multi-tenant in design.
The designation of a major tenant for
each building will limit the number of
tenant signs to be located on the
proposed tenant directory monument sign.
There are special circumstances unique to
the property which justifies the
Exception in that the site plan of the
existing office buildings limits, the
visibility of permitted signs of the rear
building.
Granting of the Exception will not have a
negative impact on surroundinq, properties
in that the proposed monument sign
complies to Section 9402h Review Criteria
in that the sign incorporates
architectural design elements and
materials from the existing office
buildings. The location of the proposed
monument is appropriate in that it is
central to the site. The 'tenant
directory monument sign as proposed will
not have a negative impact on the
surrounding properties as the overall
sign area is less than that permitted by
the Sign Code and the design and
placement of the proposed signs are to be
integrated into the canopy structures and
will not present a "cluttered" facade.
The proposed monument sign will not be
illuminated and therefore will not have
additional glare on surrounding
residential districts.
The sign application promotes the public
health, safety, welfare and aesthetics of
the community and that the grantinq of
the Exception meets the findings and
intent of the sign Code in that the
monument sign is located outside of the
visual clearance area and will not
restrict the views of traffic entering
and exiting the site. The removal of the
two (2) existing nonconforming sign
promotes the intent of the Sign Code to
reduce sign clutter on facades.

This project is Categorically Exempt from the
requirements of the California Environmental
Quality Act, pursuant to Section 15311 (Class
1~).
II. The Planning Commission hereby approves the request
to permit the increase of the maximum sign square
footage of the tenant sign area from six (6) square
feet to a maximum of 10.25 square feet in
conjunction with a tenant directory monument sign.
PASSED AND ADOPTED at a regular Planning Commission
meeting on the 8th day of March, 1993.

CONDITIONS OF APPROVAL
SIGN CODE EXCEPTION 92-007
GENERAL
*** 1.1 The proposed project shall substantially conform to
(1) submitted plans date stamped March 8, 1993, on file with
the Community Development Department as herein modified
or as modified by the Director of Community Development.
In accordance with this Exhibit, the Director of
Community Development may also approve subsequent minor
modifications to plans during plan check if such
modifications are determined consistent with the approved
plans.
(1) 1.2 Unless otherwise specified, all conditions in this
exhibit shall be complied with prior to issuance of any
building permits for the project, subject to review and
approval by the Community Development Department.
(1) 1.3 Sign Code Exception approval shall become null and void
unless sign permits and all construction is completed
within twelve (12) months of the date of this exhibit.
(1) 1.4 Approval of Sign Code Exception 92-007 is contingent upon
the applicant signing and returning an "Agreement to
Conditions Imposed" form as established by the Director
of Community Development.
(4) 1.5 Ail signs not covered by this action shall conform to the
City of Tustin Sign Code including window signs which
shall not exceed 25% of glass area upon which the sign is
located.
(1) 1.6 The developer shall hold and defend the City of Tustin
harmless for all claims and liabilities out of the City's
approval of the entitlement process for this project.

PLAN SUBMITTAL
(3) 2.1 At sign permit and building plan check, three (3) sets of
construction plans and two (2) sets of structural
calculations shall be submitted.
(4) 2.2 At sign permit and building plan check, the applicant
**** shall submit three (3) sets of site plans, showing the
dimensioned location of the monument sign. The monument
sign shall be a minimum of one (1) foot from the back of
sidewalk as shown on Parcel Map 92-23.
PUBLIC WORKS DEPARTMENT
(1) 3.1 Any damage done to existing street and landscape
(6) improvements shall be replaced or repaired prior to
release of refundable security bond.
(1) 3.2 Prior to any work in the public right-of-way, an
Encroachment Permit must be obtained from and applicable
fees paid to the Public Works Department.
USE RESTRICTIONS
(4) 4.1 The two (2) existing "Tarbell Realtors" wall signs shall
be removed and the sign locations on the building facade
repaired and repainted within 30 days of the completion
of the proposed monument sign.
(4) 4.2 The subject site shall be limited to one (1) tenant
directory monument sign~ This sign shall display a
maximum of three (3) major tenant sign faces. Prior to
the issuance of building permits and the installation of
any sign face change, the building owner shall provide to
the Community Development Department, a letter
designating the tenant as a "major tenant" and approving
the proposed sign text.
(4) 4.3 The colors for the tenant directory monument sign and
tenant sign faces shall be limited to not more than three
(3) colors, excluding black and white.

(4) 4.4 A document shall be recorded, which will provide
guidelines for the use and maintenance of the tenant
directory monument sign. This document may be recorded
individually or may be a part of any Code, Covenants and
Restrictions (CC&R's) recorded on the property. A copy
of the final document shall be submitted to the Community
Development Department for review and approval. A
conformed copy of the document shall be submitted to the
Community Development Department
FEES
(1) 5.1 Prior to issuance of any building permits, payment shall
(3) be made of all applicable building plan check and permit
fees to the Community Development Department.
(4) 5.2 Prior to issuanc~ of any building permits, the applicant
shall post with the Community Development Department a
refundable security bond in the amount of 1.5 times the
estimated cost of the removal of the two (2) existing
"Tarbell Realtors" signs, repair and repainting of the
building facade. The amount and acceptable security for
the bond shall be reviewed and approved by the Building
Official.
