HomeMy WebLinkAboutPC RES 3109 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 3109 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, DENYING CONDITIONAL USE PERMIT 92-041 REQUESTING AUTHORIZATION TO INSTALL A 20 FOOT TALL POLE MOUNTED SIGN AT OAK TREE PLAZA. The Planning Commission does 'hereby resolve as follows: I · The Planning Commission finds and determines as follows: A. That a proper application, Conditional Use Permit No. 92-041 has been filed on behalf of Keith Robuck to install a 49 square foot, 20 foot tall pole sign with exposed neon lighting. Be That a public hearing was duly called, noticed and held on December 14, 1992. Ce That establishment, maintenance, of the pole sign applied for will, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed sign, evidenced by the following findings: · The proposed 20 foot tall pole sign is not compatible with the size or character of the project in that the site is developed with one story, buildings with approximately 30,000 square feet of building area. · The proposed pole sign is inconsistent with the visual characteristics of the area which includes low profile, low intensity developments as' a transition between commercial developments to the west and residential uses to the east. · The proposed pole sign will detract from the adjacent developments that are designed to a human scale. None of the other commercial shopping centers on 17th Street have pole signs and approval of such a sign would be granting this site a special privilege. Ee That the establishment, maintenance, and operation of the sign applied for will be injurious or detrimental to the property and improvements in the neighborhood of the subject property; and to the general welfare of the City of Tustin, for the' reasons stated above. This proposed sign is a minor new construction of an accessory structure and is therefore Categorically Exempt (Class 11) from the requirements of the California Environmental Quality Act. II. The Planning Commission hereby denies Conditional Use Permit No. 92-041 reauesting authorization to install a 49 square foot, 20 foot tall pole sign with neon.
