A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING SIGN CODE
EXCEPTION 92-008 A REQUEST TO MODIFY THE SIGN
CABINET OF A EXISTING NONCONFORMING POLE SIGN
LOCATED AT 14082 RED HILL AVENUE, TUSTIN
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That a proper application, Sign Code Exception 92-
008, has been filed by Greer Engineering Co. on
behalf of Chevron U.S.A., Inc. requesting a Sign
Code Exception from the City of Tustin Sign Code to
allow the modification of the sign cabinet of an
existing nonconforming pole sign.

Pursuant to City of Tustin Sign Code Section 9204C,
the request to modify the sign cabinet of the
existing pole sign can be supported by the
following findings:

There 'are special circumstances unique to the
property to justify the Exception; in that,
due to sound walls recently constructed by
Caltrans in conjunction with the Interstate 5
Freeway improvements, a reduction in height of
the existing pole sign would reduce the
visibility of sign face from the Freeway.
·
Grantinq of the Exception will not have a
neqative impact on surrounding properties; in
that the applicant is proposing to reduce the
overall sign square footage from the existing
131.8 square feet to a proposed 85.2 square
feet. The 35% reduction in square footage
reduces the visual impact of the existing sign
on the surrounding properties.
·
The intent and purpose of the sign requlations
of the land use zone in which the sign is
located shall be followed as closely as
possible; in that, the existing pole sign
established with the approval of Conditional
Use Permit 86-30 in October of 1986, was in
compliance with the City of Tustin Sign Code
in effect at the time. The applicant is
proposing to reduce the overall sign face
square footage, bringing the sign face square
footage into closer conformity to the current
sign code.

II. The Planning Commission hereby approves the request to
modify the sign cabinet of the existing pole sign located
at 14082 Red Hill Avenue, Tustin, subject to conditions
contained in Exhibit A, attached hereto.
PASSED AND ADOPTED at a regular Planning Commission meeting on
the 14th day of December, 1992.

CONDITIONS OF APPROVAL
SIGN CODE EXCEPTION 92-008
GENERAL
(1)
1.1 The proposed project shall substantially conform to
submitted plans date stamped December 14, 1992, on
file with the Community Development Department as
herein modified or as modified by the Director of
Community Development.
In accordance with this Exhibit, the Director of
Community Development may also approve subsequent
minor modifications to plans during plan check if
such modifications are determined consistent with
the approved plans.
(1) 1.2 Unless otherwise specified, all conditions in this
exhibit shall be complied with prior to issuance of
any building permits for the project, subject to
review and approval by the Community Development
Department.
(1) 1.3 Sign Code Exception approval shall become null and
void unless sign permits and all construction is
completed within twelve (12) months of the date of
this exhibit.
(1) 1.4 Approval of Sign Code Exception 92-008 is
contingent upon the applicant signing and returning
an "Agreement to Conditions Imposed" form as
established by the Director of Community
Development.
(4) 1.5 Ail signs not covered by this action shall conform
to the City of Tustin Sign Code including window
signs which shall not exceed 25% of glass area upon
which the sign is located.
(1) 1.6 The developer shall hold and defend the City of
Tustin harmless for all claims and liabilities out
of City's approval of the entitlement process for
this project.

PLAN SUBMITTAL
Z.1 At sign permit and building plan check the
following shall be submitted:
(3) A.
Three (3) sets of construction plans and two
(2) sets of structural calculations.
PUBLIC WORKS DEPARTMENT
(1) 3.1 Any damage done to existing street and landscape
(6) improvements shall be replaced or repaired prior to
final inspection of project.
(1) 3.2 Prior to any work in the public right-of-way, an
Encroachment Permit must be obtained from and
applicable fees paid to the Public Works
Department.
FEES
"(1) 4.1 Prior to issuance of any building permits, payment
(3) shall be made of all applicable building plan check
and permit fees to the Community Development
Department.
