RESOLUTION NO. 3102
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, APPROVING CONDITIONAL USE PERMIT 92-042
TO PERMIT INSTALLATION OF A NEW INTERNALLY
ILLUMINATED MONUMENT SIGN AT 12881 NEWPORT AVENUE.
The Planning Commission does hereby resolve as follows:
I. The Planning Commission finds and determines as follows:
a.
That a proper application, (Use Permit No.92-042)
has been filed on behalf of First Baptist Church of
Tustin to permit installation of a 30 square foot
monument sign near to the front property line.

That a public hearing was duly called, noticed and
held on said application on December 14, 1992.

That establishment, maintenance, and operation of
the use applied for will not, under the
circumstances of this case, be detrimental to the
health, safety, morals, comfort, or general welfare
of the persons residing or working in the
neighborhood of such proposed use in that the
replacement of the existing pole and monument signs
with one internally illuminated monument sign will
eliminate non-conforming signs, improve visibility
of the sign, enhance the appearance of the property
and streetscape and provide public information.
That the establishment, maintenance, and operation
of the use applied for will not be injurious or
detrimental to the property and improvements in the
neighborhood of the subject property, nor to the
general welfare of the City of Tustin for the
reasons stated above.

This project is a minor new construction of an
accessory structure and is therefore Categorically
Exempt (Class 11) from the requirements of the
California Environmental Quality Act.
II. The Planning Commission hereby approves Conditional Use
Permit No. 92-042 to authorize replacement of a pole and
monument signs with a 30 square foot monument sign
located at 12881 Newport Avenue subject to the conditions
contained in Exhibit A attached hereto and incorporated
herein by reference.

CONDITION OF APPROVAL FOR
CONDITIONAL USE PERMIT 92-042
GENERAL
(1) 1.1 The proposed project shall substantially conform
with the submitted plans for he project date
stamped December 14, 1992 on file with the
Community Development Department, as herein
modified or as modified by the Director of the
Community Development Department in accordance with
this Exhibit.
(1) 1.2 Unless otherwise specified, the conditions
contained in this Exhibit shall be complied with
prior to the issuance of any building permits for
the project, subject to review and approval by the
Community Development Department.
(1) 1.3 Conditional Use Permit approval shall become null
and void unless building permits are issued within
twelve (12) months of the date of this Exhibit.
(1) 1.4 The developer shall hold harmless and defend the
City of Tustin from all claims and liabilities
arising out of the City's approval of the
entitlement process for this project.
(1) 1.5 The applicant and property owner shall sign and
return the "Agreement to Conditions" form.

PLAN SUBMITTAL
2.1 At building plan check submittal:

Provide construction plans and structural
calculations. Requirements of the Uniform Building
Codes, State Handicap and Energy Requirements shall
be complied with as approved by the Building
Official.

A landscape plan shall be submitted to and approved
by the Department of Community Development and
shall include low shrubs and/or decorative flowers
located around the base perimeter of the sign.

The sign plan shall be modified to provide off-
white textured stucco over the aluminum base.

Prior to installation .of the proposed monument
sign, the applicant shall remove the existing pole
sign and monument sign.
The proposed monument sign shall be located to
satisfy the visual clearance requirements of
Section 9403(h)1.
F·
The proposed monument sign shall not occupy any
required parking spaces.
FEES
Payment of the following fees prior to the issuance
of any building permits shall be required.

Ail applicable plan check and building permit fees
to the Community Development Department.
