A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, FOR SIGN CODE
EXCEPTION 92-003 APPROVING THE REQUEST TO
INCREASE THE MAXIMUM SIGN HEIGHT FOR THE
BUSINESS IDENTIFICATION MONUMENT SIGN FROM SIX
(6) FEET TO 7'- 10 3/4"; AND TO REDISTRIBUTE
THE MAXIMUM ALLOWABLE SQUARE FOOTAGE OF
SECONDARY BUSINESS IDENTIFICATION WALL OR
CANOPY SIGNS LOCATED AT 14001 NEWPORT AVENUE,
TUSTIN.
The Planning Commission of the City of Tustin does hereby
resolve as follows:

The Planning Commission finds and determines as
follows:

That a proper application, Sign Code Exception
91-01, has been filed by Chevron U.S.A., Inc.
requesting a Sign Code Exception from the City
of Tustin Sign Code to permit the increase of
the maximum sign height for the business
identification monument sign from six (6) feet
to 7' - 10 3/4"; and to allow the
redistribution of the maximum allowable square
footage of secondary business identification
wall or canopy signs.

Pursuant to City of Tustin Sig~ Code Section
9204C, the request to increase of the maximum
sign height for the business identification
monument sign from six (6) f~et to 7' - 10
3/4" and to redistribute the maximum allowable
square footage of the secondary business
identification wall or canopy sign can be
supported by the following findings:

Siqn size and placement restrictions of
the Siqn Code will be followed as closely
as practicable in that the proposed
monument sign's sign area and location
are as prescribed in the Sign Code. The
existing City corner landscape
improvements limit the visibility of the
proposed monument sign and therefore
prevents the monument sign from being
provided in accordance with the Code.
Also in that, the proposed size of the
secondary signs is less than the
permitted 25 square feet. The proposed
locations for the signs are all
considered, by the Tustin Sign Code, to

be eligible for the placement of
secondary signs.
The intent and purpose of the siqn
requlations have been followed as closely
as practicable in that with an increase
in overall height of the proposed
monument sign, the gasoline service
station is provided the opportunity for
effective identification while at the
same time meeting the remaining sign
regulations. Also in that, the locations
of the proposed secondary signs are to
provide effective business identification
for the motorists on Newport Avenue and
E1 Camino Real while limiting the area of
the proposed signs.
There are special circumstances unique to
the property which ~ustifies the
Exception in that existing City corner
landscape improvements located in the
right-of-way restrict visibility to the
proposed monument sign. With an increase
in the monument sign height the sign face
area will be visible above the
improvements. Also in that~ the existing
building and canopy configurations are
unusual and dictates a unique design
layout for the secondary signage.
Grantinq of the Exception will not have a
negative impact on surroundinq proDerties
in that applicant is locating the
proposed monument sign in the most
appropriate location available on the
site. The corner landscape improvements
will screen the lower base portion of the
monument sign reducing the visual impact
of the size. The proposed secondary
signage will not have a negative impact
on the surrounding properties as the
combined total area of the proposed
secondary signs will be less than that
permitted by the Sign Code and the design
and placement of the proposed signs are
to be integrated into the canopy
structures and will not present a
"cluttered" facade.

The sign application promotes the public
health, safety, welfare and aesthetics of
the community and that the qrantinq of
the Exception meets the findinqs and
intent of the Siqn Code in that the
monument sign is located outside of the
visual clearance area and will not
restrict the views of traffic entering
and exiting the site.

This project is Categorically Exempt from the
requirements of the California Environmental
Quality Act, pursuant to Section 15311 (Class
ll).
II. The Planning Commission hereby approves' the request
to increase the maximum sign height of a monument
sign from six (6) feet to 7' - 10 3/4"; and to
redistribute the maximum allowable square footage
of the secondary business identification wall or
canopy signs located at 14001 Newport Avenue,
subject to the conditions contained in Exhibit A,
attached hereto.
PASSED AND ADOPTED at a regular Planning Commission
meeting on the 10th day of November, 1992.

CONDITIONS OF APPROVAL
SIGN CODE EXCEPTION 92-003
GENERAL
*** 1.1 The proposed project shall substantially conform to
(1) submitted plans date stamped November 10, 1992, on file
with the Community Development Department as herein
modified or as modified by the Director of Community
Development.
In accordance with this Exhibit, the Director of
Community Development may also approve subsequent minor
modifications to plans during plan check if such
modifications are determined consistent with the approved
plans.
(1) 1.2 Unless otherwise specified, all conditions in this
exhibit shall be complied with prior to issuance of any
building permits for the project, subject to review and
approval by the Community Development Department.
(1) 1.3 Sign Code Exception approval shall become null and void
unless sign permits and all construction is completed
within twelve (12) months of the date of this exhibit.
(1) 1.4 Approval of Sign Code Exception 92-003 is contingent upon
the applicant signing and returning an "Agreement to
Conditions Imposed" form as established by the Director
of Community Development.
(4) 1.5 Ail signs not covered by this action shall conform to the
City of Tustin Sign Code including window signs which
shall not exceed 25% of glass area upon which the sign is
located.
*** 1.6 Ail costs for replacement plant materials and
installation of improvements within the public owned
planters shall be solely the responsibility of the
applicant.
(1) 1.7 The developer shall hold and defend the City of Tustin
harmless for all claims and liabilities out of City's
approval of the entitlement process for this project.

PLAN SUBMITTAL
2.1 At sign permit and building plan check the following
shall be submitted:
(3) A.
Three (3) sets of construction plans and two (2)
sets of structural calculations.
(1) 2.2 Prior to issuance of any building permits, submit at
(7) plan check complete detailed landscaping and irrigation
plans for the on-site corner landscape area, and the City
owned corner landscape planters consistent with adopted
City of Tustin Landscaping and Irrigation Submittal
Requirements. Provide summary table applying indexing
identification to plant materials. The plant table shall
list botanical and common names, sizes, spacing, location
and quantity of the plant materials proposed. Show
planting and berming details, soil preparation, staking,
etc. The Community Development and Public Works
Departments may request minor substitutions of plant
materials or request additional sizing or quantity
materials during plan check. Note on landscaping plan
that coverage of landscaping and irrigation materials is
subject to field inspection at project completion by the
Departments of Community Development and Public Works.
PUBLIC WORKS DEPARTMENT
(5) 3.1 It is anticipated that a minimum of ten (10) feet
*** additional right-of-way dedication will be required for
the future widening of Newport Avenue. The applicant
shall be responsible for the relocation of the monument
sign at the such time that Newport Avenue is required to
be widened.
(1) 3.2 Any damage done to existing street and landscape
(6) improvements shall be replace or repaired prior to
release of refundable security bond.
(1) 3.3 Prior to any work in the public right-of-way, an
Encroachment Permit must be obtained from and applicable
fees paid to the Public Works Department.

USE RESTRICTIONS
(4) 4.1 The existing lower cabinet on the "Tustin Transmission"
pole sign shall be removed within 30 days of the
completion of the proposed monument sign.
(4) 4.2 The existing pole sign shall be brought into conformance
as previously approved in Conditional Use Permits 80-04
and 78-02 within 30 days of completion of the proposed
monument sign. The sign face area of the pole sign shall
not exceed 85 square feet. All text and colors shall be
reviewed and approved by the Community Development
Department prior to installation. The sign copy for the
pole sign shall be limited to business identification
purposes only and shall not include products, prices or
brand names.
FEES
(1) 5.1 Prior to issuance of any building permits, payment shall
(3) be made of all applicable building plan check and permit
fees to the Community Development Department.
(4) 5.2 Prior to issuance of any building permits, the applicant
shall post with the Community Development Department a
refundable security bond in the amount of 1.5 times the
estimated cost of the removal of the lower cabinet sign,
reconstruction and replacement of the sign face of the
existing pole sign. The amount and acceptable security
for the bond shall be reviewed and approved by the
Building Official.
