A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, APPROVING SIGN CODE EXCEPTION 92-005 TO
ALLOW FOR A COMBINED MONUMENT SIGN FOR INDIVIDUAL
BUSINESS IDENTIFICATION OF TWO BUSINESSES WITHIN
ONE BUILDING, ONE OF WHICH HAS LESS THAN 5,000
SQUARE FEET OF FLOOR AREA AND INCREASE THE COPY
AREA FROM 32 SQUARE FEET TO 36 SQUARE FEET ON THE
PROPERTY LOCATED AT 17245 SEVENTEENTH STREET
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I.
The Planning Commission finds and determines as follows:

That a proper application, Sign Code Exception 92-
005, has been filed by Watkins Commercial
Properties requesting an exception from the City
Code Section 9408(c) to allow for a combined
monument sign for individual business
identification of two businesses within one
building, one of which has less than 5,000 square
feet of floor area and increase the copy area from
32 square feet to 36 square feet on the property
located at 17245 Seventeenth Street.

Pursuant to city Code Section 9405(c), the request
to authorize an exception to the sign regulations
at the subject property can be supported by the
following findings:
The proposal has followed the sign size and
placement as closely as practical. The
proposed sign would be constructed at the
allowable maximum height of six feet and the
increase to the copy area of four square feet
for a total of 36 square feet to accommodate
the business names of two restaurants is
reasonable to ensure that the copy is clearly
visible to motorists as well as pedestrians.

The design of the monument sign satisfies the
requirements of the Sign Code as practicable
as possible in that if a strict interpretation
of the sign regulations were taken, neither
business would have the benefit of a monument
sign, a privilege enjoyed by many of the
surrounding restaurants. In this case,
tenancy is not singular and one of the
restaurants has less than 5,000 square feet of
floor area; however, by using the combined
floor area of 9,000 square feet, a combined
monument sign is justified.

There are special circumstances unique to the
property in that the two restaurants are
located within a shopping center that has
limited street frontage along Seventeenth
Street, which has a higher ratio of vehicle
trips than Carroll Way, and also has a number
of similar restaurants with individual
monument signs. The original concept
envisioned for the structure at the subject
location has since changed from an equally
divided three-tenant occupancy to one major
restaurant tenant with a smaller lease space
reserved for a smaller restaurant, thereby
increasing the need for individual business
identification at the subject location since
the building no longer functions as a
restaurant pavilion.

Granting of this exception would not have a
negative impact on the surrounding community
as the sign has been designed to match the
design standards for size, height and
placement as would be permitted for a single
business identification monument sign.

Granting of this exception would promote the
general welfare and aesthetics of the
community as it would allow individual tenant
identification for two restaurants similar to
the privilege enjoyed by surrounding
restaurants and the proposal compliments the
architecture and materials of the restaurant
building.

This project is Categorically Exempt from the
requirements of the California Environmental
Quality Act, pursuant to Section 15311 (Class 11).
II. The Planning Commission hereby approves the Sign Code
Exception 92-005, to allow for a combined monument sign
for individual business identification of two businesses
within one building, one of which has less than 5,000
square feet of floor area and increase the copy area from
32 square feet to 36 square feet on the property located
at 17245 Seventeenth Street, subject to conditions
attached as Exhibit A incorporated herein by reference.

CONDITIONS OF APPROVAL
SIGN CODE EXCEPTION 92-005
GENERAL
(1) 1.1 The proposed project shall substantially conform to
submitted plans date stamped September 28, 1992, on
file with the Community Development Department as
herein modified or as modified by the Director of
Community Development. In accordance with this
Exhibit, the Director of Community Development may
also approve subsequent minor modifications to
plans during plan check if such modifications are
determined consistent with the approved plans.
(1) 1.2 Unless otherwise specified, all conditions in this
exhibit shall be complied with prior to issuance of
any building permits for the project, subject to
review and approval by the Community Development
Department.
(1) 1.3 Sign Code Exception approval shall become null and
void unless sign permits and all construction is
completed within eighteen (18) months of the date
of this exhibit.
PLAN SUBMITTAL
(1) 2.1 Three (3) sets of sign plans shall be submitted at

FEES
(1) 3.1 Prior to issuance of any sign permits, payment shall

permit fees to the Community Development
Department.
