HomeMy WebLinkAboutPC RES 3087 6 $ 9 JO ~4 J6 2~ 2~ ~6 RESOLUTION NO. 3087 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING CONDITIONAL USE PERMIT 92-027, TO AUTHORIZE THE INSTALLATION OF A 32-SQUARE FOOT CHANGEABLE COPY, MONUMENT SIGN, THE MODIFICATION OF THE VEHICULAR ACCESS TO THE PARCEL; AND, THE MODIFICATION TO THE AMOUNT OF PARKING SPACES PROVIDED IN CONJUNCTION WITH THE EXISTING CHURCH STRUCTURE LOCATED AT 13841 RED HILL AVENUE. The Planning Commission does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A· That a proper application, Conditional Use Permit 92-027, has been filed Mr. Thomas J. Towle on behalf of First Southern Baptist Church of Tustin requesting authorization to install a 32-square foot, changeable copy, monument sign; the modification of the vehicular access to the parcel; and, the modification to the amount of parking spaces provided in conjunction with the existing church located at 13841 Red Hill Avenue. Be That a public hearing was duly called, noticed and held on said application on September 14, 1992. Ce That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, and will not be a detriment to the property and improvements in the neighborhood of the subject property and to the general welfare of the City of Tustin as evidenced by the following findings: . The monument sign provides information for the general public as to the events presented by the church and the associated dates and times. . The proposed monument sign is of similar size and area as monument signs permitted within the zoning district which surround the site and is compatible with the surrounding neighborhood. · The monument sign is located centrally to the project and does not encroach into any public rights-of-way nor does it impair the line of sight of any driveway. 1 2 3 4 5 6 1 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 Resolution No. 3087 Page 2 · The proposed monument sign is of a design which is architecturally compatible with the existing church facility. . The proposed driveway apron will permit access to the parking area in a more direct manner, thus reducing the potential for on-site vehicular conflicts. · The proposed driveway apron will be of a sufficient dimension to accommodate the anticipated traffic to the church. · The proposed driveway apron location is more central to the site. · The peak times of use for the church's parking area is on the weekends and mainly on Sundays. These are considered the non-peak periods with regards to traffic flow along Red Hill Avenue. · The peak times of use for the adjacent commercial is on the weekends. The elimination of the shared access and parking reduces the potential for circulation and parking conflicts between church-goers and commercial patrons. 10. The reconfiguration of the parking area results in a lowered parking ratio from the original approved plans. 11. The proposed security gate will limit unauthorized access to the church parking area thus reducing the potential for vandalism to the church property. D . That the establishment, maintenance and operatio~ of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, as evidenced by the findings stated above. E. This project has been determined to be Categorically! Exempt (Class 11) pursuant to the provisions of, Section 15311 of the California Environmental Quality Act (CEQA). The Planning Commission hereby approves Conditional Use Permit No. 92-027 authorizing installation of a 32-square foot, changeable copy, monument sign; the modification of the vehicular access to the parcel; and, the modification to the amount of parking spaces provided in conjunction with the existing church structure located at 13841 Red Hill Avenue, subject to he conditions contained in Exhibit A, attached hereto. KATHLEEN CLANCY Recording Secretary EXHIBIT A CONDITIONS OF APPROVAL CONDITIONAL USE PERMIT 92-027 RESOLUTION NO. 3087 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted site plans for the project date stamped September 14, 1992, on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this exhibit. (1) 1.2 Unless otherwise specified, all conditions contained in this exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Conditional Use Permit approval shall be null and void unless necessary building permits are issued within twenty four (24) months of the date on this exhibit. (1) 1.4 The applicants and property owners shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any building permits. (1) 1.5 Any public improvements ~amaged by the applicant adjacent to this property shall be repaired and/or replaced as determined by the Engineering Division and shall include, but not be limited to, curb and gutter, street paving and driving apron. (1) 1.6 Ail construction shall be in accordance with the 1991 Uniform Building Code, applicable City Codes and the City's Security Code. (4) 1.7 The existing wood structure monument sign located at the southeast corner of the site shall be removed and the existing grade repaired prior to final inspection of any building permits. SIGN MODIFICATIONS (4) 2.1 The color of the signs including returns, shall match, as closely as possible, the color of the building trim, subject to approval of the Community Development Department. Requirements of the Uniform Building Code shall be complied with as approved by the Building Official. No field changes shall be made without corrections submitted to and approved, by the Community Development Department. *** 3.2 The applicant shall submit an executed copy of the "Release of Agreement" with regards to the existing reciprocal access and parking agreement, to be placed on file, to the Community Development Department. (1) 3.3 Ail construction within a public right-of-way and/or public easement must be shown on a separate 24" X 36" plan with all construction referenced to applicable City standard drawing numbers. Improvements to be shown on these plans shall include, but not be limited to the following: a. B. C. D. E. F. Street and Driveway apron paving Curb and gutter Sidewalk Existing facilities Landscaping/irrigation Street lights (1) 3.4 Ail changes in existing curbs, gutters, sidewalks and other public improvements shall be responsibility of subdivider. **** 3.5 The plans submitted for dr0iveway modifications shall show parking space layout and restriping details for entire parking area. PARKING *** 4.1 The Owner shall cause to be prepared a comprehensive parking demand study, at the request and discretion of the Community Development Department or Public Works Department, if it is determined that a parking problem exists on the site. If said report indicates inadequate on-site parking, the owner, at the discretion of the City, shall provide additional mitigation to offset parking impacts either by securing off-site parking, in the form of a recorded reciprocal parking agreement, with an adjacent property owner within 300 feet of the church parcel or other mitigation measures such as valet parking subject to approval of the City. FEES (1) 5.1 Payment of all building plan check and permit fees shall be made prior to issuance of any building permits in accordance with the Tustin City Code. JP:br
