RESOLUTION NO. 3081
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, APPROVING A MODIFICATION TO CONDITIONAL
USE PERMIT 92-022 AMENDING THE MASTER SIGN PROGRAM
FOR THE TUSTIN RANCH PROJECT AREA PROVIDING FOR THE
PLACEMENT OF FLAGS AT APARTMENT COMPLEXES ON A
WEEKEND ONLY BASIS.
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That a proper application, Conditional Use Permit
92-022, has been filed on behalf of The Irvine
Company requesting an amendment to the master sign
program for the Tustin Ranch project area providing
for the placement of decorative flags at apartment
complexes.

A public hearing was duly noticed, called and held
for said application on July, 13, 1992, whereby the
Commission continued the item for discussion during
a workshop held August 24, 1992. An additional
public hearing was duly noticed, called and held
for said application on September 14, 1992.

That the establishment, maintenance, and operation
of the use applied for will not, under the
circumstances of this case, be detrimental to the
health, safety, morals, comfort, or general welfare
of the persons residing or working in the
neighborhood of such proposed use, nor be injurious
or detrimental to the property and improvements in
the neighborhood of the subject property, or to the
general welfare of the City of Tustin in that the
amendment will result in providing an increased
visibility to various apartment complexes
differentiating them from model complexes.
Additionally, the use of decorative flags on a
weekends only basis does not result in detrimental
impacts to surrounding properties in that the use
of flags would be considered an aesthetically
pleasing alternative compared with the use of
temporary banners with text.

This project has been determined to be
Categorically Exempt (Class 11) pursuant to Section
15311 of the California Environmental Quality Act.

II. The Planning Commission hereby approves a modification to
Conditional Use Permit 92-022 amending the master sign
program for the Tustin Ranch project area providing for
the placement of flags at apartment complexes on a
weekend only basis, subject to all conditions contained
in Exhibit A, attached hereto.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Commission, held on the 14th day of September, 1992.

CONDITIONAL USE PERMIT 92-022
CONDITIONS OF APPROVAL
RESOLUTION NO. 3081
GENERAL
(1) 1.1 The proposed project shall substantially conform with the
submitted plans for the project date stamped September
14, 1992, on file with the Community Development
Department, as herein modified, or as modified by the
Director of Community Development Department in
accordance with this Exhibit.
(1) 1.2 Unless otherwise specified, the conditions contained in
this Exhibit shall be complied with prior to the issuance
of any building permits for the project, subject to
review and approval by the Community Development
Department.
(1) 1.3 Approval of Conditional Use Permit 92-022 is contingent
upon the applicant signing and returning an "Agreement to
Conditions Imposed" form, as established by the Director
of Community Development.
(1) 1.4 Approval of the modification to Conditional Use Permit
92-022 by adoption of Resolution No. 3081 authorizes the
use of decorative flags at apartment complexes. All
previous conditions of approval of Exhibit A of
Resolution No. 3058 remain applicable for the use and
authorization of flags at model complexes.
PLAN SUBMITTAL
(3) 2.1 Two sets of construction plans including calculations
where required shall be submitted for the footings and
sleave detail, which would allow for removal of the
poles. Requirements of the Uniform Building Code shall
be complied with as approved by the Building Official.
USE RESTRICTIONS
(4) 3.1 The display of flags at apartment complexes shall be
limited to weekends only.

(4) 3.2 The location and grouping of flags shall be reviewed and
approved by the Community Development Department and
shall be limited to areas on-site within close proximity
to the sales office, the project's signage or on the
inside of the project's perimeter wall where the common
property line abuts a roadway.
(4) 3.3 Conditional Use Permit approval authorizes the display of
decorative flags measuring eighteen (18) square feet,
attached to poles not to exceed 19 feet in height. Each
project site shall be limited to a maximum of six (6)
flags.
FEES
(1) 4.1 Prior to issuance of any permits the applicant shall pay
the following fees:

Division.

Ail sign permit fees to the Building Division and
sign design review fees to the Planning Division.
