RESOLUTION NO. 3074
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, APPROVING CONDITIONAL USE PERMIT 92-029
AND RECOMMENDING TO THE REDEVELOPMENT AGENCY
APPROVAL OF DESIGN REVIEW 92-037 AUTHORIZING THE
CONSTRUCTION OF A NEW 16,000 SQUARE FOOT GYMNASIUM
AND RELATED SITE IMPROVEMENTS ON THE PROPERTY
LOCATED AT 14632 PROSPECT AVENUE.
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That proper applications, Conditional Use Permit
92-029 and Design Review 92-037, have been filed by
the City of Tustin Community Services Department
requesting authorization to construct a new 16,000
square foot gymnasium and related site improvements
on the property located at 14632 Prospect Avenue.

A public hearing was duly noticed, called and held
for said application on August 24, 1992.

That Recreation centers are considered a
conditionally permitted use in the Public and
Institutional zoning district.
De
That the establishment, maintenance, and operation
of the use applied for will not, under the
circumstances of this case, be detrimental to the
health, safety, morals, comfort, or general welfare
of the persons residing or working in the
neighborhood of such proposed use, nor be injurious
or detrimental to the property and improvements in
the neighborhood of the subject property, or to the
general welfare of the City of Tustin as evidenced
by the following:

The proposed use was anticipated and is
consistent with the Master Plan for Columbus
Tustin Park and the project as originally
identified in the Second Amendment to the
Amended Redevelopment Plan for the Town Center
Redevelopment project area.

The proposed use will not negatively effect
surrounding property owners, in that the
improvements are for the use and pleasure of
the surrounding properties and the general
welfare of the City.

have been sensitively designed to the existing
residential development, by retaining a
minimum 25-foot building setback from Beneta
Way and by orienting the main entrance/exit
onto the parking lot area adjacent to Prospect
Avenue.
·
The location and height of the proposed
improvements are compatible with the most
adjacent existing improvements located on the
school district's property in that varying
angles and roof pitches are proposed adding
interest and breaking up the building mass,
specifically along the structure's west and
north elevations.

Pursuant to Section 9272 of the Tustin City Code,
the Planning Commission finds that the location,
size, architectural features and general appearance
of the proposed development will not impair the
orderly and harmonious development of the area, the
present or future development therein, the
occupancy thereof, or the community as a whole. In
making such findings, the Planning Commission
considered the following:
1. Height, bulk and area of buildings.
2. Setbacks and site planning.
3. Exterior materials and colors.
4. Type and pitch of roofs.
·
Size and spacing of windows, doors and other
openings.
·
Towers, chimneys, roof structures, flagpoles,
radio and television antennae.
·
Landscaping, parking area design and traffic
circulation.
·
Location, height and standards of exterior
illumination.
·
Location and appearance of equipment located
outside of an enclosed structure.

11. Physical relationship of proposed structures
to existing structures in the neighborhood.
12. Appearance and design relationship of proposed
structures to existing structures and possible
future structures in the neighborhood and
public thoroughfares.
13. Proposed signing.
14. Development Guidelines and criteria as adopted
by the City Council.

The project is covered by previously certified EIR
88-2 for the Second Amendment to the Amended
Redevelopment Plan for the Town Center
Redevelopment project area.
II. The Planning Commission hereby approves Conditional Use
Permit 92-029 and recommends to the Redevelopment Agency
approval of Design Review 92-037 authorizing the
construction of a new 16,000 square foot gymnasium and
related site improvements on the property located at
14632 Prospect Avenue, subject to all conditions
contained in Exhibit A, attached hereto.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Commission, held on the 24th day of August, 1992.

CONDITIONS OF APPROVAL
RESOLUTION NO. 3074
GENERAL
(1) 1.1 The proposed project shall substantially conform with the
submitted plans for the project date stamped August 24,
1992, on file with the Community Development Department,
as herein modified, or as modified by the Director of
Community Development Department'in accordance with this
Exhibit. The Director of Community Development may also
approve minor modifications during plan check, if found
to be consistent with the intent of the conceptual plans
and consistent with all applicable development standards.
(1) 1.2 Unless otherwise specified, the conditions contained in
this Exhibit shall be complied with prior to the issuance
of any building permits for the project, subject to
review and approval by the Community Development
Department.
(1) 1.3 Ail utilities exclusively serving the gymnasium site
shall be underground.
(1) 1.4 Any public improvements damaged by the applicant adjacent
to this property shall be repaired and/or replaced as
determined by the Engineering Division and shall include,
but not be limited to, curb and gutter, street paving and
drive apron.

Final grading and specifications consistent with
the site plan and landscaping plans and prepared by
a registered civil engineer for approval by the
Community Development Department in conformance
with the requirements listed in the City's Grading
Manual.

A precise soils engineering report provided by a
soils engineer within the previous twelve (12)
months for the pad site.
A separate 24" x 36" street improvement plan will
be required for all required construction within
the public right-of-way, which should include but
not be limited to the following:

Information to ensure compliance with all
requirements of the Orange County Fire Chief
including required fire flow and installation,
where, required, of fire hydrants subject to
approval of the Fire Department, and city of Tustin
Public Works Department and compliance with all
requirements pertaining to construction as follows:

Prior to the issuance of any building permits
for combustible construction, evidence that a
water supply for fire protection is available
shall be submitted to and approved by the Fire
Chief. Fire hydrants and access roads shall
be in place and operational to meet the
requirements and fire flow prior to commencing
combustible materials.
·
Prior to the issuance of any buildings
permits, all underground.piping for automatic
fire extinguishing system shall be approved by
the Fire Chief. These details shall include
width, clear height, and means of emergency
over-ride.
·
Ail drives 28 feet or less in width shall be
posted as "No Parking/Fire Lane."

(1) F.
Note on final plans that a six foot high chain
linked fence shall be installed around the pad
location for the gymnasium prior to building
construction stages. Gated entrances shall be
permitted along the perimeter of the site for
construction vehicles.
(1) G.
The service road access shall be designed in
accordance with the construction standards for
private streets pursuant to Section 3.1 for
pavement thickness specifications as listed in the
City's adopted Construction Standards for Private
Streets, Storm Drain and On-Site Private
Improvements. Standard section details B102 and
B103 should be utilized and modified as necessary
subject to review and approval by the Community
Development Department.
LANDSCAPING, GROUNDS AND HARDSCAPE ELEMENTS
(6) 3.1 Submit at plan check complete detailed landscaping and
irrigation plans for all new landscaping areas proposed
on the site consistent with adopted City of Tustin
Landscaping and Irrigation Submittal Requirements.
Provide summary table applying indexing identification to
plant materials in their actual location. The plan and
table must list botanical and common names, sizes,
spacing, actual location and quantity of the plant
materials proposed. Show planting and berming details,
soil preparation, staking, etc. The irrigation plan
shall show location and control of backflow prevention
devices, pipe size, sprinkler type, spacing and coverage.
Details for all equipment must be provided. Show all
property lines on the landscaping and irrigation plan,
public right-of-way area, sidewalk widths, parkway areas,
and wall locations. The Community Development Department
may request minor substitutions of plant materials or
request additional sizing or quantity materials during
plan check. Note on landscaping plan that coverage of
landscaping irrigation materials is subject to field
inspection at project completion by the Community
Development Department.
(6) 3.2 The submitted landscaping plans at plan check must
reflect the following requirements, either incorporated
into the design and/or construction or included as notes:

Provide a minimum of one 15 gallon size tree for
every 30 feet of property line on the property
perimeter and five 5 gallon shrubs.
Be
Shrubs shall be a minimum of 5 gallon size and
shall be spaced a minimum of 8 feet on center when
intended as screen planting.
Ce
Ground cover shall be planted between 8 to 12
inches on center.

When 1 gallon plant sizes are used the spacing may
vary according to materials used.
Ee
Ail plant materials shall be installed in a healthy
vigorous condition .typical to the species and
landscaping must be maintained in a neat and
healthy condition. This will include but not be
limited to trimming, mowing, weeding, removal of
litter, fertilizing, regular watering, or
replacement of diseased or dead plants.
(6) 3.3 Provide details, colors, and materials for all exterior
walkways, stairs and walls. Design all walkways to
create a reinforced pedestrian corridor with accessory
landscaping treatment subject to review and approval by
the Community Development Department.
(6) 3.4 Indicate lighting scheme for project, note locations of
all exterior lights and types of fixtures. No lights
shall be permitted which may create any glare or have a
negative impact on the residential properties. The
location and types of lighting shall be subject to the
approval by the Community Development Department.
(6) 3.5 Applicant shall submit a complete sign program, including
directionals and building identification. Additionally,
a note and detail shall be provided at plan check
submittal specifying that the additional access road from
Beneta Way to the property is "For Service Vehicles
Only." All sign types, materials and finishes shall be
submitted for review and approval by the Community
Development Department.
ARCHITECTURE
(4) 4.1 Applicant shall submit revised material samples to
specify one of the block types as a split-face finish
subject to the review and approval of the Community

Development Department and the Assistant City Manager's
assessment of budget availability. Specifications at
plan check submittal shall reflect materials call-outs on
all elevations and applicable details and notes added
indicating that all block surfaces shall be protected
with a graffiti resistant finish and/or material.
(4) 4.2 Applicant shall submit at building plan check the actual
design, including material specifications, for the
outdoor patio/trellis area pursuant to the alternate bid
criteria subject to the review and approval by the
Community Development Department.
NOISE
(1) 5.1 Ail construction operations including engine warm up
(2) shall be subject to the provisions of the City of Tustin
Noise Ordinance and shall take place only during the
hours of 7:00 a.m. until 6:00 p.m., Monday through
Friday, or other times that the Building Official
determines will be in substantial conformance with the
Noise Ordinance and that the public health and safety
will not be impaired, subject to application being made
at the time and permit for the work is awarded or during
progress of the work.
ADA TRANSITION PLAN REQUIREMENTS
(5) 6.1 Ail signage for the gymnasium pad and for the parking lot
area shall be upgraded with the International Symbol of
Accessibility as appropriate to direct users to
accessible routes subject to the review and approval by
the Community Development Department.
(5) 6.2 A re-striping plan shall be submitted to provide
accessible paths of travel and spaces at both ends of the
parking lot. Additionally one van accessible space shall
be provided.
(5) 6.3 An appropriate number of litter receptacles shall be
replaced to comply with ADA requirements subject to the
review and approval by the Community Development
Department.
(5) 6.4 Existing ramps at Beneta Way and the parking lot area
shall be upgraded to current code/standards. Details
shall be submitted for review and approval by the
Community Development Department.

(5) 6.5 A new ramp shall be installed to replace existing ramps
at the intersection of Beneta Way and Prospect Avenue
upgraded to current codes and standards. This ramp
construction and details shall be included in the off-
site plan check submittal and shall be subject to the
review and approval by the City Engineer and the
Community Development Department.
FEES
(1) 7.1 Prior to issuance of any building permits payment shall
be made of all required fees including:

Orange County Sanitation District No. 7 fees to the
Sanitation District.
Be
School facilities fee to the Tustin Unified School
District or proof of a release from payment of any
fee.
Ce
East Orange County Water District fees to the water
district.
