HomeMy WebLinkAboutPC RES 3070 1 2 3 4 5 6 7 8 9 10 11 12, 13 14 15 16 17 18 191 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 3070 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN FINDING THAT FINAL ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL EIR 85-2, AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS AND ADDENDA) IS ADEQUATE TO SERVE AS THE PROGRAM EIR FOR THE TIME EXTENSION FOR AN AMENDMENT TO CONDITIONAL USE PERMIT 90-05 AND DESIGN REVIEW 89-71 AND ALL FEASIBLE MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: ae That Conditional Use Permit 90-05 and Design Review 89-71 and respective development plans are considered "projects" pursuant to the terms of the California Environmental Quality Act; and Bo That said projects were approved by the Planning Commission on September 10, 1990 by the adoption of Resolution Nos. 2833 and 2832. Ce A proper application, Amendment to Conditional Use Permit 90-05, was filed by the Irvine Company to request a time extension for the projects; Ce That the projects are covered by a previously certified Final Environmental Impact Report for the East Tustin Specific Plan which serves as a Program EIR for the proposed project. II. The East Tustin Specific Plan Final Environmental Impact Report (85-2), previously certified on March 17, 1986 as modified by subsequently adopted supplements and addenda, was considered at the time of approval of these projects. The Planning Commission hereby finds: these projects are within the scope of the East Tustin Specific Plan previously approved; the effects of these projects, relating to grading, drainage, circulation, public services and utilities, were examined in the Program EIR. All feasible mitigation measures and alternatives developed in the Program EIR are incorporated into these projects. 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 3070 Page 2 The final EIR, was therefore determined and is still determined to be adequate to serve as a Program EIR for these projects and satisfies all requirements of the California Environmental Quality Act. Applicable mitigation measures identified in the Final EIR have been incorporated into these projects which mitigates any potential significant environmental effects thereof. The mitigation measures are identified as Conditions on Exhibit A of Planning Commission Resolution No. 2833, approving Conditional Use Permit 90-05 and Resolution No. 2832 approving Design Review 89-71.
