HomeMy WebLinkAboutPC RES 3062 1 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 3062 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA CONDITIONALLY APPROVING DESIGN REVIEW 92-030 AUTHORIZING CONSTRUCTION OF A 28,392-SQUARE FOOT AUTO SERVICE BUILDING AND A 27,979-SQUARE FOOT UPPER PARKING DECK AT 45 AUTO CENTER DRIVE. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A® That a proper application, (Design Review No. 92- 030) was filed by Czysz Construction, Inc. on behalf of David Wilson, requesting approval of a 28,392-square foot auto service building and a 27,979-square foot upper parking deck at 45 Auto Center Drive. Be Pursuant to Section 9272 of the Tustin Municipal Code, the Commission finds that the location, size, architectural features and general appearance of the proposed development will not impair the orderly and harmonious development of the area, the present or future development therein, the occupancy as a whole. In making such findings, the Commission has considered at least the following items: 1. Height, bulk and area of buildings. 2. Setbacks and site planning. 3. Exterior materials and colors. 4. Type and pitch of roofs. · Size and spacing of windows, doors and other openings. · Towers, chimneys, roof structures, flagpoles, radio and television antennae. · Landscaping, parking area design and traffic circulation. · Location, height and standards of exterior illumination. · Location and appearance of equipment located outside of an enclosed structure. 1 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 3062 Page 2 10. Location and method of refuse storage. 11. Physical relationship of proposed structures to existing structures in the neighborhood. 12. Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood and public thoroughfares. 13. Proposed signing. 14. Development Guidelines and criteria as adopted by the City Council. Ce The proposed project is covered be a previously certified EIR (85-2) and requires no further documentation. II. The Planning Commission conditionally approves Design Review 92-030 authorizing construction of a 28,392-square foot auto service building and a 27,979-square foot upper parking deck at 45 Auto Center Drive subject to conditions attached hereto as Exhibit A. KA~HLEEN CLANCY- Recording Secretary/ RESOLUTION 3062 EXHIBIT A CONDITIONS OF APPROVAL DESIGN REVIEW 92-030 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted site plans for the project date stamped July 27, 1992 on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this exhibit. Minimal modifications to the site plan or structures may be approved by the Community Development Director. (1) 1.2 Unless otherwise specified, all conditions contained in this exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 This Design Review approval shall become null and void unless all necessary building permits are issued within eighteen (18) months of the date on this exhibit and substantial construction is underway. Time extensions may be granted by the Community Development Department up to 6 months if a written request is received by the Community Development Department within thirty (30) days prior to expiration. Longer extensions shall require Planning Commission approval. (1) 1.4 The applicants and property owners shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any building permits and or business license. USE RESTRICTIONS *** 2.1 The building shall be used for service and storage only. PLAN SUBMITTAL (1) 3.1 At building plan check, submit three sets of construction (3) level plans as follows: A. Construction and grading plans, structural calculations for structures. SOURCE CODES (1) STANDARD CONDITION (5) RESPONSIBLE AGENCY REQUIREMENT (2) CEQA MITIGATION (6) LANDSCAPING GUIDELINES (3) UNIFORM BUILDING CODE/S (7) PC/CC POLICY (4) DESIGN REVIEW *** EXCEPTION Exhibit A Resolution No. 3062 Page 2 Ail plans and calculations shall have wet signature of a licensed engineer, and shall meet the requirements of the Uniform Building Code and Uniform Fire Code. S · Provide preliminary technical detail and plans for all utility installations. Additionally, a note shall be placed on plans stating that no field changes shall be made without said changes first requiring review and approved by the Community Development Department. C, Submit a building area analysis pursuant to Chapter 5 of the Uniform Building Code to verify that the existing building and the proposed new structures are not over area due to their use (group occupancy) and type of construction. (3) 3.Z Ail construction shall comply with the 1991 edition of the Uniform Building Code. NOISE (1) 4.1 Ail construction operations including engine warm up (2) shall be subject to the provisions of the City of'Tustin Noise Ordinance and shall take place only during the hours of 7:00 a.m. until 6:00 p.m., Monday through Friday or other times that the Building official determines will be in substantial conformance with the Noise Ordinance and the public health and safety will not be impaired subject to application being made at the time the permit for the work is awarded or during progress of the work. Ail requirements of the city's Noise Ordinance (Chapter 6 of the Municipal Code) shall be met at all times which in part requires noise levels not to exceed 60 dba at any time. (1) 4.2 Outside public address speakers, telephone bells, buzzers and similar devices which are audible on adjoining properties must comply to the Tustin Auto Center Loudspeaker Criteria. *** 4.3 Identify location of paging equipment on the building plans. Said equipment shall comply with the adopted paging criteria for the Auto Center. Exhibit A Resolution No. 3062 Page 3 BUILDING/SITE (4) 5.1 Provide a letter from Great Western Reclamation, attached to plan check set, indicating that the proposed trash enclosures complies with access and recycling standards of Great Western Reclamation. (4) 5.2 Ail exterior colors to be used shall be subject to review and approval of the Director of the Community Development Department. All exterior treatments shall be coordinated with regard to color, materials and detailing and noted on submitted construction plans and elevations shall indicate all colors and materials to be used. (1) 5.3 Note on final plans that a six-foot-high chain linked fence shall be installed around the site prior to building construction stages unless area is secured by existing fencing. Gated entrances shall be permitted along the perimeter of the site for construction vehicles. (1) 5.4 Exterior elevations of the buildings shall indicate any (4) fixtures or equipment to be located on the elevations of the building. Venting and mechanical equipment shall be a minimum of 6" below top of parapet. Submitted plans shall identify the height level of the parapet at all critical locations. (1) 5.5 Ail utilities to site shall be provided underground. (1) 5.6 No exterior downspout shall be permitted on any facade on the proposed building which are visible from adjacent streets or commercial areas. (1) 5.7 Ail lighting on the parking deck shall be limited to illuminating the parking deck only. No light shall be permitted to stray beyond the four-foot walls of the parking deck. FIRE DEPARTMENT (1) 6.1 Prior to issuance of any building permits for combustible (5) construction, evidence that a water supply for fire protection is available shall be submitted to and approved by the Fire Chief. Fire hydrants and access roads shall be in place and operational to meet requirements and fire-flow prior to commencing combustible materials. Exhibit A Resolution No. 3062 Page 4 (1) 6.Z Prior to the issuance of any building permits, all (5) underground piping for automatic fire extinguishing systems shall be approved. Plans for automatic fire extinguishing system shall be approved by the Fire Chief prior to installation . Such systems shall be operational prior to the issuance of a certificate of use and occupancy. Provide standpipes for fire fighting purposes on the second floor. They shall be within 100 feet of all portions of the second floor roof plan. (1) 6.3 Provide a letter of intended use regarding the service (5) department. Provide a list of the types and quantities of chemicals to be used with the letter to the Fire Chief. (1) 6.4 The gas pump shall comply with the Uniform Fire Code (5) Articles 79 and 80. Relocate the proposed gas pump away from the exit. (1) 6.5 The following notes shall be on the site plan: a · Fire Department Final inspection required. Schedule inspection two days in advance. Phone 832-1011. b® Locations and classifications of extinguisher to be determined by fire inspector. Co Storage, dispensing or use of any flammable and combustible liquids, flammable and compressed gasses and other hazardous materials shall comply with the Uniform Fire Code Regulations. de Building(s) not approved for high piled combustible storage. Materials in closely packed piles shall not exceed ten feet in height, 12 feet on pallets or in racks and six feet for tires, plastic, and some flammable liquids. If high stock piling, comply with UFC Art. 81, and NFPA Std. 231, 231C, and 231D. e · Plans of modifications to or new fire protection, detector alarm system(s) shall be approved by the Fire Department prior to installation. FEES (6) 7.1 Prior to the issuance of any building permits, payment Exhibit A Resolution No. 3062 Page 5 (i) shall be made of all required fees including but not limited to: ae Major thoroughfare and bridge fees to Tustin Public Works Department. 0 Ail applicable plan check and building permit fees to the Community Development Department.
