RESOLUTION NO. 3051
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, APPROVING CONDITIONAL USE PERMIT 92-005
AND DESIGN REVIEW 92-010, AUTHORIZING THE
CONSTRUCTION OF A SANCTUARY, FELLOWSHIP HALL AND
CLASSROOM BUILDINGS INCLUDING RELATED SITE
IMPROVEMENTS ON THE PROPERTY IDENTIFIED AS LOTS 14
AND 15 OF TRACT 13627.
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I .
The Planning Commission finds and determines as follows-
A. Tha~ proper applications, Conditional Use Permit
.'i... 92-005 and Design Review 92-010, have been filed on
~ behalf of The Salvation Army Church requesting
authorization to construct a sanctuary, fellowship
hall and classroom buildings including related site
improvements on the property identified as Lots 14
and 15 of Tract 13627.
·
A public hearing was duly noticed, called and held
for said applications on June 22, 1992.
C ·
That the establishment, maintenance, and operation
of the use applied for will not, under the
circumstances of this case, be detrimental to the
health, safety, morals, comfort, or general welfare
of the persons residing or working in the
neighborhood of such proposed use, nor be injurious
or detrimental to the property and improvements in
the neighborhood of the subject property, or to the
general welfare of the City of Tustin, as evidenced
by the following findings:

The proposed project has been designed in
accordance with the requirements of the ETSP
and the proposed church use was anticipated in
the approvals for the Phase Four Sector Level
Map, Tract 13627.
.
The church use' and related buildings will
improve the general welfare of the community
by offering worship services and religious
studies.

The church use and related buildings will
provide Salvation Army sponsored services 'to
the community which include women forums,
youth forums and day care facilities.

The anticipated uses do n6t include the use of
any of the facilities for any type of 24-hour
basis; i.e., Alcoholic Anonymous meetings,
homeless shelter, nor "soup" kitchen.

The anticipated use of the facilities will not
include any type of thrift store that might
generate a constant flow of traffic throughout
the day, but rather is limited to providing
three large gatherings on Sundays,
traditionally a low-volume traffic day.
·
The overall site layout has incorporated
surrounding infrastructure and has been
designed sensitively to anticipated uses by
locating structures adjacent to Jamboree Road.
·
The overall project will provide improvements,
architecturally including landscape and
hardscape elements, that will enhance the area
improving the general welfare of the City.
The project site will be adjacent to other
public and institutional uses along the
western and southern boundaries, which are
anticipated to be developed as a park and
elementary school. Additionally, the site is
bordered by Jamboree Road and Pioneer Road to
the east and north, respectively, providing
physical separation from future residential
neighborhoods reducing noise impacts.
·
The project site has been designed to be
compatible with the location of the pipeline
easement, which runs the full length of the
property's western boundary, and no structures
are proposed to be built within the easement.
That a church is a conditionally permitted use
pursuant .to the East Tustin Specific Plan-Low
Density Residential designation.
Pursuant to Section 9272 of the Tustin City Code,
the Planning Commission finds that the location,
size, architectural features and general appearance
of the proposed development will not impair the
orderly and harmonious development of the area, the
present or future development therein, the
occupancy as a whole. In making such findings, the
Commission has considered at least the following

items:
1. Height, bulk and area of buildings;
2. Setbacks and site planning;
3. Exterior materials and colors;
4. Type and pitch of roofs;
5. Size and spacing of windows, doors and other
openings;
6. Towers, chimneys, roof structures, flagpoles,
radio and television antennas;
7. Landscaping,. parking area design and traffic
circulation;
8. Location, height and standards of exterior
illumination;
9. Location and appearance of equipment located
outside of an enclosed structure;

10. Location and method of refuse storage;
11. Physical relationship of proposed structures
to existing structures in the neighborhood;
12. Appearance and design relationship of proposed
structures to existing structures and possible
future structures in the neighborhood and
public thoroughfares;
13. Proposed signing; and
14. Development Guidelines and criteria as adopted
by the City Council.
F. This project is covered by a previous EIR (85-2)
for the East Tustin Specific Plan. No additional
documentation is required.
II. The Planning Commission hereby approves Conditional Use
Permit No. 92-005 and Design Review 92-010 authorizing
the construction of a sanctuary, fellowship hall and
classroom buildings including related site improvements
on the property identified as Lots 14 and 15 of Tract

13627, subject to all conditions contained in Exhibit A,
attached hereto.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Commission, held on the 22nd day of June, 1992.

CONDITIONS OF APPROVAL
CONDITIONAL USE PERMIT 92-005
DESIGN REVIEW 92-010
GENERAL
(1) 1.1 The proposed project shall substantially conform with the
submitted site plans for the project date stamped June
22, 1992, on file with the Community Development
Department, as herein modified, as modified by the
Director of Community Development Department in
accordance with this exhibit or as modified during the
building plan check process and as approved by the
Community Development Department.
(1) 1.2 Unless otherwise specified, all conditions contained in
this exhibit shall be complied with prior to the issuance
of any building permits for the project, subject to
review and approval by the Community Development
Department.
(1) 1.3 Design Review and Conditional Use Permit approval shall
become null and void unless all necessary building
permits are issued within eighteen (18) months of the
date on this exhibit and substantial construction is
underway. Time extensions may be granted by the
Community Development Department without penalty to the
applicant's use permit approval if a written request is
re.ceived by the Community Development Department within
thirty (30) days prior to expiration.
(1) 1.4 The applicants and property owners shall sign and return
an Agreement to Conditions Imposed form prior to the
issuance of any building permits.
*** 1.5 The approval of Design Review 92-010 authorizes an
interim condition plan as anticipated for the classroom
buildings; however, actual design, layout, review and
approval shall be subject to a Minor Design Review
submittal and applicable fee at the time of building plan
check submittal subject to approval by the Community

Development Department. The submitted plans shall be
designed in accordance with all applicable UBC Codes,
Title 19 and 24, City Codes and State Department of
Social Services Licensing requirements and all State Fire
Marshall regulations.
1.6 The developer of Lot 14 of Tract 13627 is required to
provide a parking covenant and reciprocal access
agreement to guarantee ten parking spaces and access on
Lot 14 of Tract 13627 for use by the adjacent park site.
In the event that Lot 17 of Tract 13627 is dedicated as
park land, the agreement becomes null and void. Said
agreement shall be submitted for review and approval by
the Community Development Department and City Attorney
prior to the issuance of any structural building permits.
OPERATIONS
(4) 2.1 The applicant shall obtain all neressary licenses and
approvals from the State Department of Social Services
for operation of the da~ care facility.
(4) 2.2 No other activities shall be scheduled simultaneously
with the use of the sanctuary. Simultaneous use of the
facilities on the church site are limited by the total
number of parking allocated calculated at a ratio of one
space for every three fixed seats or as modified per
Condition No. 5.7 herein.
(4) 2.3 The approval of this use permit shall not constitute
authorization for any type of 24-hour use.by the church
or any other party. Operating hours shall be between
7:00 a.m. and 10:00 p.m. excepting those services
generally provided in an emergency relief condition or as
related to specific organized members' activities.
PLAN SUBMITTAL
(1) 3.1 At building plan check submit three sets of construction
(3) level plans as follows:
A. Construction and grading plans, structural
calculations for structures.
Ail plans and calculations shall have wet signature
of a licensed engineer, and shall meet the
requirements of the Uniform Building Code and
Uniform Fire Code.

A grading plan with specifications consistent with
the City of Tustin Grading Manual and ordinance and
prepared by a California Civil Engineer will be
required. Said plan shall be consistent with the
site plan and identify a dust control plan.

Provide preliminary technical detail and plans for
all utility installations. Additionally, a note
shall be place on plans stating that no field
changes shall be made without said changes first
requiring review and approved by the Community
Development Department.
Do
A precise soil engineering report provided by a
soils engineer within the previous twelve (12)
months from the date of plan check submittal.
NOISE
(1) 4.1 Ail construction operations including engine warm up
shall be subject to the provisions of the City of Tustin
Noise Ordinance and shall take place only during the
hours of 7:00 a.m. until 6:00 p.m., Monday through Friday
or other times that the Building Official determines will
be in substantial conformance with the Noise Ordinance
and the public health and safety will not be impaired
subject to application being made at the time the permit
for the work is awarded or during progress of the work.
(1) 4.2 Ail requirements of the City's Noise Ordinance (Chapter
6 of the Municipal Code) shall be met at all times which
in part requires noise levels not to exceed 55 dBa at any
time.
BUILDING/SITE
(1) 5.1 Ail exterior colors to be used shall be subject to review
(4) and approval of the Community Development Department.
Ail exterior treatments must be coordinated with regard
to color, materials and detailing and noted on submitted
construction plans and elevations shall indicate all
colors and materials used.
(3) 5.2 Indicate lighting scheme for the project. Note locations
of all exterior lights and types of fixtures, lights to
be installed on the building shall be of a decorative
design. No lights shall be permitted which may create

any glare or have a negative impact on adjoining
properties. The location and types of lighting shall be
subject to the approval, of the Community Development
Department.
(3) 5.3 A detailed sign program for the proposal shall be
submitted for plan check which shall include the actual
locations of the monument sign and any other directional
signs which identify services and activities. The
program and any proposed sign shall comply in all
respects to the East Tustin Specific Plan and Tustin Sign
Code as applicable.
5.4 Note on final plans that a six-foot-high chain link fence
shall be installed around the site prior to building
construction stages. Gated entrances shall be permitted
along the perimeter of the site for construction
vehicles.
5.5 Ail mechanical and electrical fixtures and equipment
shall be adequately and decoratively screened. A cross
section of the mechanical and electrical fixtures and
equipment on the roof shall be provided at plan check.
The screen shall be considered as an element of the
overall design of the project and shall blend with the
architectural design of the buildings. All telephone and
electrical boxes shall'be indicated on the building plans
and shall be completely screened. Electrical
transformers shall be located toward the interior of the
project maintaining a sufficient distances from frontage
of the project.
5.6 Exterior elevations of the buildings shall indicate any
fixtures of equipment to be located on the roof of the
building, equipment heights and type of screening. All
parapets shall be at least six inches above rooftop
equipment for purposes of screening.
(4) 5.7 Submitted plans shall be revised to provide an additional
(6) nine parking spaces on the site plan for a total of 277
parking spaces, or 27 seats shall be removed from the
sanctuary building.
(2) 5.8 The on-site sidewalk and any necessary transition from
(4) the parking provided on the Salvation Army site to the
(6) public sidewalk for use by the park shall be certified to
meet all American Disability Act (ADA) requirements for

access to a public facility.
(3) 5.9 The common property line fencing adjacent to Lots 16, 17
(4) and 18 shall be installed prior to issuance of
(6) Certificates of Occupancy. Said fencing shall utilize
the accepted City design for "view" fencing which is
comprised of a combination wrought-iron, pilaster type.
The applicant may modify the design to show construction
of the fence without the concrete base and decresae the
spacing of the pilasers. Actual details shall be
submitted for review and approval by the Community
Development Department.
PUBLIC WORKS
(4) 6.1 Ail access rights to Jamboree Road were released or
(6) relinquished to the City with the recordation of Tract
13627. Ail reference to use of the emergency exit for
"Sunday" exiting shall be removed from submitted plans.
(4) 6.2 A separate 24" x 36" street improvement plan will be
required showing all required construction with the
public right-of-way. In addition, a construction traffic
control plan will be required which shall be prepared by
a California registered traffic engineer.
(4) 6.3 Any damaged or missing public improvements adjacent to
this property shall be repaired and/or replaced as
determined by the Engineering-Division and shall include,
but not be limited to curb and gutter, street paving and
drive apron.
(1) 6.4 A profile of the line of sight looking westerly from the
(4) entrance to this site will be required. It appears that
some regrading of the slope within the future park site
may be needed to provide for safe and adequate visibility
for egress from the church site. As determined by the
City Engineer, any required regrading to the park site to
accommodate clean and safe visibility from the driveway
for the church site shall be the responsibility of the
developer of Lots 14 and 15 of Tract 13627. Any required
right-to-access for regrading shall' be obtained and
granted for this purpose.
(4) 6.5 Prior to the issuance of any permits, a traffic impact
analysis report shall be submitted for review and
approval by the City's Traffic Engineer.

(4) 6.6 The developer will be required to execute and record a
covenant and agreement to hold Lots 14 and 15 of Tract
13627 as one prior to the issuance of building permits.
(1) 6.7 The radius-type drive will require additional right-of-
(4) way dedication per City Standard No. 10SE. The
additional dedication will need to be adequate for the
construction of handicap ramps per City Standard No. 124.
FIRE
(4) 7.1 Prior to the issuance of any building permits for
combustible construction, evidence that a water supply
for fire protection is available shall be submitted to
and approved by the Fire Chief. Fire hydrants shall be
in place and operational to meet required fire-flow prior
to commencing construction with combustible materials.
(4) 7.2 Prior to the issuance of any building permits, all
underground piping for automatic fire extinguishing
systems shall be approved and installed. Plans for an
automatic fire extinguishing system shall be approved by
the Fire Chief prior to installation. Such systems shall
be operational prior to the issuance of a certificate of
use and occupancy.
(4) 7.3 Prior to the issuance of any building permits,
construction details for any controlled entry access
shall be'approved by the Fire Chief. These details shall
include width, clear height and means of emergency
vehicle over-ride.
(4) 7.4 Prior to the issuance of any certificates of use and
occupancy, the private street shall be red curbed and
posted "No Parking-Fire Lane" as per 1985 Uniform Fire
Code Section 10.207 in a manner meeting the approval of
the County Fire Chief.
LANDSCAPING, GROUNDS AND HARDSCPAPE ELEMENTS
(7) 8.1 Submit at plan check complete detailed landscaping and
irrigation plans for all landscaping areas consistent
with adopted City of Tustin Landscaping and Irrigation
Submittal Requirements. Provide summary table applying
indexing identification to plant material in their
actual location. The plan and table must list botanical
and common names, sizes, spacing, actual location and

quantity of the plant materials proposed. Show planting
and berming details, soil preparation, staking, etc. The
irrigation plan shall show location and control of
backflow prevention devices, pipe size, sprinkler type,
spacing and coverage. Details for all equipment must be
provided. Show all property lines on the landscaping and
irrigation plan, public right-of-ways area, sidewalk
widths, parkway areas, and wall locations. The
Department of Community Development may request minor
substitutions of plant materials during plan check. Note
on landscaping plan that coverage of landscaping
irrigation materials is subject to field inspection at
project completion by the Department of Community
Development.
FEES
(1) 9.1 Prior to issuance of any building permits payment

Within forty-eight (48) hours of approval of the
subject project, the applicant shall deliver to the
Community Development Department, a cashier's check
payable to the COUNTY CLERK in the amount of $25.00
(twenty-five dollars) pursuant to AB 3185, Chapter
1706, Statutes of 1990, enable the City to file the
Notice of Determination required under Public
Resources code Section 21151 and 14 Cal. Code of
Regulations 15094. If within such forty-eight (48)
hour period that the applicant has not delivered to
the Community Development Department the above-
noted check, the approval for the project granted
herein shall be considered automatically null and
void.
In addition, should the Department of Fish and game
reject the Certificate of Fee Exemption filed with
the Notice of Determination and require payment of
fees, the applicant shall deliver to the Community
Development Department, within forty-eight (48)
hours of notification, a cashier's check payable to
the COUNTY CLERK in the amount of $850 (eight
hundred fifty dollars) pursuant to AB 3158, Chapter
1706, Statutes of 1990. If this fee is imposed,
the subject project shall not be operative, vested
or final unless and until the fee is paid.
