RESOLUTION NO. 3049
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, APPROVING SIGN CODE EXCEPTION 92-004 TO
INCREASE AN INDIVIDUAL TENANT IDENTIFICATION SIGN
FROM SIX-SQUARE FEET TO 18-SQUARE FEET ON AN
EXISTING TENANT DIRECTORY SIGN LOCATED AT 13842
NEWPORT AVENUE
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That a proper application, Sign Code Exception 92-
004, has been filed by Spesco on behalf of Westwood
Financial requesting an exception from the City
Code Section 9408E to increase an individual tenant
identification sign from six-square feet to 18-
square feet on an existing tenant directory sign
located at 13842 Newport Avenue.

Pursuant to City Code Section 9405c, the request to
authorize an exception to the sign regulations to
increase an individual tenant identification sign
from six-square feet to 18-square feet on an
existing tenant directory sign at the subject
property can be supported by the following
findings:

The proposal has followed the sign size and
placement as closely as practical. The
proposed sign would replace three panels on an
existing monument sign, thus maintaining the
integrity of the monument sign, while still
providing the other existing tenants to be
identified on the sign.
·
The design of the monument sign would meet all
the requirements of the Sign Code, excepting
the proposed single tenant identification,
thereby satisfying as closely as practicable
the purpose of the Sign Code to regulate the
design of signs. If the proposed sign was
limited to one panel, the monument sign would
give the false impression that there were
vacancies in the building which would not be
beneficial to the business community.

There are special circumstances unique to the
property in that the current division of the
building only includes four tenants with
Blockbuster Video occupying over 60 percent of
the building. The existing monument sign was

designed to accommodate six tenant signs. The
proposed sign would avoid extensive
modification to the existing monument sign
such as removing the two panels, that some day
may be needed again by other future tenants.

Granting of this exception would not have a
negative impact on the surrounding community
as the sign would maintain the design
integrity of the monument sign while providing
the needed business identification for the
entire center.
·
Granting of this exception would promote the
general welfare and aesthetics of the
community as the monument sign would continue
to identify all tenants of the center without
giving the impression that the center has
vacancies.

This project is Categorically Exempt from the
requirements of the California Environmental
Quality Act, pursuant to Section 15311 (Class 11).
II. The Planning Commission hereby approves the ~ign Code
Exception 92-004, to increase an individual tenant
identification sign from six-square feet to 18-square
feet on an existing tenant directory sign located at
13842 Newport Avenue, subject to conditions attached
hereto as Exhibit A and incorporated herein by reference.
PASSED AND ADOPTED at a regular Planning Commission meeting on
the 22nd day of June, 1992.

CONDITIONS OF APPROVAL
SIGN CODE EXCEPTION 92-004
GENERAL
(1) 1.1 The proposed project shall substantially conform to
submitted plans date stamped June 22, 1992, on file with
the Community Development Department as herein modified
or as modified by the Director of Community Development.
In accordance with this Exhibit, the Director of
Community Development may also approve subsequent minor
modifications to plans during plan check if such
modifications are determined consistent with the approved
plans.
(1) 1.2 Unless otherwise specified, all conditions in this
exhibit shall be complied with prior to issuance of any
building permits for the project, subject to review and
approval by the Community Development Department.
(1) 1.3 Sign Code Exception approval shall become null and void
unless sign permits and all construction is completed
within eighteen (18) months of the date of this exhibit.
COMMUNITY DEVELOPMENT DEPARTMENT
*** 2.1 Should the tenant space occupied by Blockbuster Video be
redivided, tenant identification on the monument sign
shall be returned to the original condition, limiting
each tenant to a maximum of six-square feet.
PLAN SUBMITTAL
(1) 3.1 Three (3) sets of sign plans shall be submitted at sign
(3) permit plan check.
FEES
(1) 4.1 Prior to issuance of any sign permits, payment shall
(3) be made of all applicable building plan check and permit
fees to the Community Development Department.
