A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, APPROVING A REQUEST FOR SIGN CODE
EXCEPTION 92-001 TO ALLOW CONSTRUCTION OF A
MONUMENT SIGN ON A PROPERTY WHICH HAS 105-LINEAL
FEET OF STREET FRONTAGE, AND TO ALLOW ONLY THE
GASOLINE PROVIDER TO BE IDENTIFIED AT THE GASOLINE
SERVICE STATION AND CAR WASH LOCATED AT 13871 RED
HILL AVENUE
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That a proper application, Sign Code Exception 92-
001, has been filed by William Day on behalf of
Arco Product Company requesting an exception from
the City of Tustin Sign Code Section 9408F(1) (a)
which requires a minimum of 150 lineal feet of
street frontage, to allow the construction of a
monument sign on a property which has 105-lineal
feet of street frontage; and from Section 9402
which states that business identification sign
shall identify the name, address and lawful use of
the premises upon which it is located, to exclude
business identification and to allow only the
gasoline provider to be identified at the gasoline
service station and car wash located at 13871 Red
Hill Avenue.

Pursuant to City of Tustin Sign Code Section 9405c,
the request to authorize an exception to the Sign
Code to allow construction of a monument sign on a
property that has 105-lineal feet of street
frontage, and to allow only the gasoline provider
to be identified at the subject facility can be
supported by the following findings:

The proposal has followed the sign size and
placement as closely as practical. The
proposed sign would be located in a landscape
planter, would be less than the maximum sign
area permitted, would meet the maximum height
requirement, and other development standards
associated with the placement of a monument
sign.

The design of the monument sign would meet all
the requirements of the Sign Code, excepting
the minimum street frontage requirement,
thereby satisfying as closely as practicable
the purpose of the Sign Code to regulate the

design of signs. Removal of the existing, non-
conforming pole sign would bring the property
into conformance with the Sign Code. Further,
the sign would also promote effective
identification of services available at the
site, which also satisfies the purpose of the
Sign Code.

There are special circumstances unique to the
property in that the lot is not a corner lot
as are most gasoline stations in the City and
immediate vicinity and does not have two
street frontages to meet the minimum street
frontage requirement.
·
Granting of this exception would not have a
negative impact on the surrounding community
as the proposed monument sign would not impede
traffic flow or in any way restrict site
access. Further, the project also calls for
the removal of an existing nonconforming pole
sign and related pricing signs which would
reduce visual clutter.
·
Granting of this exception would promote the
general welfare and aesthetics of the
community as visual clutter will be reduced in
the neighborhood due to the removal of the
existing nonconforming pole sign and creating
conformity to the existing Sign Code
Regulations.

This project is Categorically Exempt from the
requirements of the California Environmental
Quality Act, pursuant to Section 15311 (Class 11).
II. The Planning Commission hereby approves the Sign Code
Exception 92-001, to allow the construction of a monument
sign and to allow only the gasoline provider to be
identified on the monument sign on the property located
at 13871 Red Hill Avenue subject to conditions attached
hereto as Exhibit A and incorporated herein by reference.

CONDITIONS OF APPROVAL
SIGN CODE EXCEPTION 92-001
GENERAL
(1) 1.1 The proposed project shall substantially conform to
submitted plans date stamped June 8, 1992, on file with
the Community Development Department as herein modified
or as modified by the Director of Community Development.
In accordance with this Exhibit, the Director of
Community Development may also approve subsequent minor
modifications to plans during plan check if such
modifications are determined consistent with the approved
plans.
(1) 1.2 Unless otherwise specified, all conditions in this
exhibit shall be complied with prior to issuance of any
building permits for the project, subject to review and
approval by the Community Development Department.
(1) 1.3 Sign Code Exception approval shall become null and void
unless sign permits and all construction is completed
within eighteen (18) months of the date of this exhibit.
(1) 1.4 Approval of Sign Code Exception 92-001 is contingent upon
the applicant signing and returning an "Agreement to
Conditions Imposed" form as established by the Director
of Community Development
COMMUNITY DEVELOPMENT DEPARTMENT
(5) 2.1 Existing pole sign shall be removed from the premises and
site shall be restored to original conditions immediately
upon completion of construction of the monument sign.

PUBLIC WORKS DEPARTMENT
(1) 3.1 An irrevocable offer of dedication of and additional ten
(5) (10) feet of street right-of-way shall be required prior
to building permit issuance. A legal description and
drawing of the dedication shall be prepared by a
California registered civil engineer or licensed land
surveyor and submitted to the Engineering Department for
approval.
(5) 3.2 The monument sign shall be permitted to be located within
*** the ten (10) feet dedication as shown on submitted plans,
however, the applicant shall be responsible for the
relocation of the monument sign at such time that the ten
feet of street right-of-way is required for widening of
Red Hill Avenue.
PLAN SUBMITTAL
(1) 4.1 At sign permit and building plan check the following
(3) shall be submitted:
A. Three (3) sets of construction plans and two (2)
sets of structural calculations.
FEES
(1) 5.1 Prior to issuance of any building permits, payment shall
(3) be made of all applicable building plan check and permit
fees to the Community Development Department.
