RESOLUTION NO. 3042
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, APPROVING CONDITIONAL USE PERMIT 92-021,
AUTHORIZING THE CONTINUED USE OF A TEMPORARY
SECURITY FENCE LOCATED WITHIN THE REQUIRED MINIMUM
FRONT YARD SETBACK AT THE PROPERTY LOCATED AT
14882-14932 NEWPORT AVENUE
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That a proper application, Conditional Use Permit
92-021, has been filed by Citivest Construction to
continue the use of a temporary security fence
located within the required minimum front yard
setback at the property located at 14882-14932
Newport Avenue.

A public hearing was duly called, noticed and held
for said application on June 8, 1992.

That establishment, maintenance, and operation of
the use applied for will not, under the
circumstances of this case, be detrimental to the
health, safety, morals, comfort, or general welfare
of the persons residing or working in the
neighborhood of such proposed use, no~ to the
surrounding neighborhood or to the general welfare
of the City of Tustin as evidenced by the following
findings:

The continued use of the 6'-0" in height fence
at the property located at 14882-14932 Newport
Avenue is necessary to secure the subject
abated property. Continuing to secure the
property to keep trespassers from entering
will benefit the health, safety, morals,
comfort, or general welfare of the persons
residing or working in the neighborhood of the
property as the property has been abated.

The use of the security fence on the subject
site will not be detrimental to surrounding
properties or to the general welfare of the
City as the fence is temporary and will be
removed when redevelopment of the property
occurs.

This project has been determined to be
Categorically Exempt (Class 1) pursuant to Section
15301 of the California Environmental Quality Act.

II. The Planning Commission hereby approves Conditional Use
Permit No. 92-021 to authorize the continued use of a
security fence located within the required minimum front
yard setback at the property located at 14882-14932
Newport Avenue, subject to the conditions contained in
Exhibit A, attached hereto.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Commission, held on the 8th day of June, 1992.

I, KATHLEEN CLANCY, the undersigned, hereby certify that I am
the Recording Secretary of the Planning Commission of the City
of Tustin, California; that Resolution No. 3042 was duly
passed and adopted at a regular meeting of the Tustin Planning
Commission, held on the 8th day of June, 1992.

CONDITIONAL USE PERMIT 92-021
CONDITIONS OF APPROVAL
RESOLUTION NO. 3042
GENERAL
(1) 1.1 The proposed project shall substantially conform with the
submitted plans for the project date stamped June 8,
1992, on file with the Community Development Department,
as herein modified, or as modified by the Director of
Community Development Department in accordance with this
Exhibit.
(1) 1.2 Unless otherwise specified, the conditions contained in
this Exhibit shall be complied with prior to the issuance
of any building permits for the project, subject to
review and approval by the Community Development
Department.
(1) 1.3 This permit shall be valid for a period of 24 months from
the date of this Resolution or at such point in time that
said fence can be considered a construction fence in
conjunction with the issuance of building permits for the
renovation of the property, whichever is less. A time
extension may be granted by the Planning Commission,
without the need for a public hearing, should additional
time be required to secure the property. Said extension
request shall be made to the Community Development
Department at least 30 days prior to the expiration of
the terms of this Conditional Use Permit.
(5) 1.4 The property shall continue to be monitored on a 24 hour,
seven days a week basis to ensure that no trespassers
enter the abated property for the duration of the
abatement period.
