HomeMy WebLinkAboutPC RES 3029 1 2 3 4 5 8 9 10 11 12 13 14 15 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 3029 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING CONDITIONAL USE PERMIT 92-016, AUTHORIZING THE ESTABLISHMENT OF A RETAIL/FITNESS TRAINING FACILITY WITHIN THE EXISTING TENANT SPACE LOCATED AT 13011 NEWPORT AVENUE, SUITE 102. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae That a proper application, Conditional Use Permit 92-016 has been filed on behalf of The Starting Line, Inc. to establish a retail/fitness training facility at 13011 Newport Ave:':ue, Suite 102. Ce That a determination was made by the Planning Commission on May 11, 1992, that a retail/fitness training facility is a conditionally permitted use similar in character to other conditionally permitted uses listed in the C-2 (Central Commercial) District. De That the establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, nor be injurious or detrimental to the property and improvements i~ the neighborhood of the subject property, or to the general welfare of the City of Tustin, as evidenced by the following findings: A minimum of 50% of the facility is proposed to be utilized for retail sales, a use permitted within the C-2 (Central Commercial) District designation, and the operations will be conditioned as such to maintain this ratio · Base upon the square footage of the tenan' space as a retail use, twelve (12) parkin¢ spaces would be allocated within the cente~ for use by the facility. The proposed use provides the opportunity for the improvement of the general public health, safety and welfare of the community in that the facility has an objective to provide personal fitness and health training on an individual basis. This project has been determined to be Categorically Exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. II. The Planning Commission hereby approves Conditional Use Permit No. 92-016 to authorize the establishment of a retail/fitness training facility within the existin¢ tenant space located at 13011 Newport Avenue, Suite 102, subject to all conditions contained in Exhibit A, attached hereto. KATHLE~C~CY- ~__ Recording Secretarsf EXHIBIT A CONDITIONAL USE PERMIT 92-016 CONDITIONS OF APPROVAL RESOLUTION NO. 3029 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped May 11, 1992, on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Conditional Use Permit approval shall become null and void unless all permits are issued within twelve (12) months of the date of this Exhibit. (1) 1.4 Approval of Conditional Use Permit 92-016 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form, as established by the Director of Community Development. PLAN SUBMITTAL 2.1 At building plan check submittal: (3) A. Three sets of construction plans shall be submitted including two sets of structural calculations where required. Requirements of the Uniform Building Plumbing, Mechanical and Electrical Codes shall be complied with as approved by the Building Official. Be Note on plans that total occupant load for the suite is 58 persons. This calculation is based upon UBC occupancy standards for the retail portion of the tenant space of 40 persons combined with the 18 person maximum for the workout portion of the tenant space. OPERATIONS (2) 3.1 A minimum of 50% of the tenant space shall be utilized for retail sales. (2) 3.3 A maximum of 18 persons, clients and personal trainers inclusive, may utilize the training/workout portion of the facility at any one time.
