HomeMy WebLinkAboutPC RES 3020 1 2 3 4 5 6 l 8 9 10 Il 12 13 14 15 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 3020 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING SIGN CODE EXCEPTION 92-002 TO ALLOW FLAGS WHICH EXCEED SIGN CODE REGULATIONS, SUBJECT TO CONDITIONS, FOR THE PROPERTY LOCATED AT 2982 EL CAMINO REAL The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: A· That a proper application for Sign Code Exception 92-002 has been filed by Ikea U.S. West Incorporated to allow flags which exceed Sign Code regulations for the property located at 2982 E1 Camino Real. B· The proposed display of five flags will include a United States flag, a Swedish flag and three (3) business identification (corporate) flags, all on 32-foot-high poles. C, That the Planning Commission has reviewed the request to the requested flags and the proposal can be supported by the following findings: The size and placement restrictions of the Sign Code are being followed as closely as practicable. The request exceeds the maximum allowable number of flags by one (1) flag; · The intent and purpose of the regulations of the Sign Code are being followed as closely as practicable; · Per the Department of Defense Flaq Manual, it is acceptable to display the flags requested; · The size and scale of the Tustin Market are special circumstances which justify the Exception; · Granting of the Exception will not have a negative impact on surrounding properties. The location of the flags is near the intersection of Jamboree Road and the I-5 Freeway. There are no residential properties in the vicinity. 2 3 4 5 6 8 9 lO 12 13 14 ~5 ~7 18 ~9 20 2~ 22 23 24 25 26 27 28 Resolution No. 3020 Page 2 · The request will not adversely impact public health, safety, welfare or aesthetics of the community, and the granting of the Exception meets the findings and intent of Chapter 4 - Sign Regulations, of the Tustin City Code. II. The Planning Commission hereby approves Sign Code Exception 92-002 to allow flags which exceed Sign Code regulations for the property located at 2982 E1 Camino Real, subject to conditions contained in Exhibit A, attached hereto. KATHLEE~CLA~CY - Recording Secretary PR:nm EXHIBIT A RESOLUTION NO. 3020 CONDITIONS OF APPROVAL SIGN CODE EXCEPTION 92-002 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date-stamped April 13, 1992, on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this exhibit. (1) 1.2 Unless otherwise specified, the conditions contained in this exhibit shall be complied with prior to the issuance of any building permit for the project, subject to review and approval by the Community Development Department. (1) 1.3 Approval of Sign Code Exception 92-002 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (5) 1.4 Approval shall be for the display of a maximum of five flags to include any of the following: United States flag Swedish flag California flag Tustin flag Three Ikea Corporate flags Ail flags shall be displayed in accordance with standards of the Department of Defense, Flag Manual. PLAN SUBMITTAL (3) 2.1 At building plan check the applicant shall submit construction plans and structural calculations for the flag poles complying with the requirements of the Uniform Building Code, as approved by the Building Official. SITE AND BUILDING CONDITIONS (5) 3.1 The installation of flag poles shall not obstruct any SOURCE CODES (1) STANDARD CONDITION (5) RESPONSIBLE AGENCY REQUIREMENT (2) CEQA MITIGATION (6) LANDSCAPING GUIDELINES (3) UNIFORM BUILDING CODE/S (7) PC/CC POLICY (4) DESIGN REVIEW *** EXCEPTION Exhibit A - Conditions of Approval Resolution No. 3020 Sign Code Exception 92-002 Page 2 existing handicapped parking, standard parking or loading spaces. 3.2 Any curbs, sidewalks, pavement, landscape or planter areas damaged during installation of the flag poles shall be repaired or replaced prior to final approval by the Planning Division of the Community Development Department.
