RESOLUTION NO. 3014
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, RECOMMENDING TO
THE CITY COUNCIL DENIAL OF ZONE CHANGE 92-001
A REQUEST TO CHANGE THE DESIGNATION OF THE
PROPERTY LOCATED AT 14442 HOLT AVENUE FROM E-4
(RESIDENTIAL ESTATE DISTRICT) TO R-1 (SINGLE-
FAMILY RESIDENTIAL DISTRICT)
The Planning Commission of the City of Tustin does hereby
resolve as follows:

The Planning Commission finds and determines as
follows:
A·
That Zone Change 92-001 was submitted to the
Planning Commission by J. P. Greubel Company
for consideration.

That a public hearing was duly noticed, called
and held on said application by the Planning
Commission on March 23, 1992. The public
hearing was closed on March 23, 1992, and the
item was continued to April 13, 1992, as a
consent calendar item.

That the proposed Zone Change to R-1 (Single-
Family Residential District) is not in the
best interest of the public health, safety and
welfare of the surrounding area as evidenced
by the following:

The proposed zone change would be
incompatible with land use densities in
the vicinity as it would permit an
increase in density from four (4)
dwelling units per acre to six (6)
dwelling units per acre which is
inconsistent with properties north, east
and west of the site, which are limited
to densities ranging between two (2) and
three and one half (3.5) dwelling units
per acre.

The proposed zone change would not be in
the best interest of the surrounding area
in that a precedent would be set for
development north of the site to also be
re-zoned to R-1 (Single Family
Residential District) which would
ultimately result in the introduction of
a new land use pattern for properties
north of Warren Avenue on the east side

of Holt Avenue inconsistent with
properties on the west side of Holt
Avenue.

Tile change would create a zoning district
boundary at mid-block rather than at
Warren Avenue. Warren Avenue, as a
street, provides for a more natural,
orderly separation between a zoning
district rather than a mid-block
location.

That the proposed zone change to R-1 (Single
Family Residential District) is not consistent
with the Housing Element of the General Plan
in that the change would be inconsistent with
the predominate character of the surrounding
area and would not conserve the existing
neighborhood. Properties immediately adjacent
to the subject site (to the north, east and
west) are comprised of very low density
residential development with large setbacks
and considerable open space. The change would
encourage larger buildings, and considerably
smaller setbacks from Holt Avenue.
II. The Planning Commission hereby recommends to the
City Council denial of Zone Change 92-001 a request
to change the zoning designation of the property
located at 14442 Holt Avenue from E-4 (Residential
Estate Distl-ict) to R-1 (Single-Family Residential
District).
PASSED AND ADOPTED by the Planning Commission of the City
of Tustin at a regular meeting held on the 13th day of
April, 1992.
