HomeMy WebLinkAboutPC RES 3008 1 2 3 4 5 6 8 9 10 11 12 13 14 15 17 18 20 2~ 22 RESOLUTION NO. 3008 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, CONDITIONALLY APPROVING CONDITIONAL USE PERMIT 92-003 AUTHORIZING THE ESTABLISHMENT OF A PAWN BROKER BUSINESS IN AN EXISTING TENANT SPACE ON THE PROPERTY LOCATED AT 640 EL CAMINO REAL. The Planning Commission of the city of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: A· That a proper application for Conditional Use Permit 92-003 was filed by Marvin Rowland requesting authorization to establish a pawn broker business within an existing tenant space on the property located at 640 E1 Camino Real. S~ That a hearing before the Planning Commission was duly noticed, called and held on said application on February 24, 1992. C. The proposed use is subject to approval of a conditional use permit pursuant to City Code Section 9233(c) (q) . D · That the establishment, maintenance or opera=ion of the use applied for will not, under the circumstances of this particular case, be detrimental to the health, safety, morals, comfort and general welfare of the persons residing or working in the neighborhood of such proposed use, nor will it be injurious or detrimental to property and improvements in the neighborhood or the general welfare of the City as evidenced by the following: 23 24 25 27I 281 Operating criteria has been established per City Code Sections 3611 through 3616 to provide that the establishment of a pawn broker business in the City operates in a manner that assures the surrounding community of protection of health, safety, morals, comfort and general welfare. Additionally, conditions of approval accompany this Resolution assuring that the applicant is aware and complies with all City requirements. 1 4 7 9 10 11 13 14 15 16 17 18 19 ~0 Resolution No. 3008 Page 2 Ee · The subject location is within an established shopping center which maintains a variety of business types and the addition of a pawn broker business can be accommodated with only minor tenant improvements and would therefore be appropriate. · Access to the shopping center has been established and the introduction of this use will not result in a need to provide additional improvements off-site; therefore, detriment to surrounding properties is not anticipated. · Parking for the shopping center is in compliance with City requirements for retail uses which is stated as four spaces required for every 1,000 square feet of gross floor area; therefore, this use, which is classified as retial, would not result in negative impacts to neighboring tenants as current parking provided is adequate. That this project has been determined to be Categorically Exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. II. (1) 1.2 Conditional Use Permit 92-003 approval shall become null and void if the pawn broker business is not established within twelve months. (1) 1.3 Approval of Conditional Use Permit 92-003 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form, as established by the Director of Community Development. (1) 1.4 Conditional Use Permit 92-003 shall not become effective until the following steps are completed in the following order. Failure to complete these steps or obtain the required approvals shall render this Conditional Use Permit 92-003 authorization null and void: a · The business owner and any employees of the pawn broker business shall obtain an approved application from the Tustin Police Department in accordance with Tustin City Code Section 3613(a). 0 The business owner shall obtain an approved application from the license and permit board in accordance with Tustin City Code Section 3613(b) and (c) . Ce Upon completion of items "a" and "b" stated above, the business owner shall obtain an approved Dusiness license from the Community Development Department. The business license shall be kept current so long as the business is operating. The contents of said record shall comply with Tustin City Code Section 3612(a). (1) 2.2 The reporting of daily transactions shall be made to the Tustin Police Department on the following day of such transactions. The contents of this report shall comply with Tustin City code Section 3612(b). (1) 2.3 A holding period of ten days from the date that the receiving transaction for any article that was reported to the Tustin Police Department shall be required prior to said article being sold in accordance with Tustin City Code Section 3614. (1) 2.4 The holding period of any article may be extended upon written notification by the Tustin Police Department in accordance with Tustin City Code Section 3614. (1) 2.5 Ail articles received in pawn shall be made available for inspection upon request by the Tustin Police Department. (1) 2.6 The hours of operation for the pawn broker business shall be limited to between 7:00 a.m. and 9:00 p.m. of any day in accordance with Tustin City Code Section 3615. SITE MODIFICATIONS 3.1 Exuerior business iOentlflca~lon signs shall be submitted for review and approval by the Community Development Department and sign permits issued, if applicable. (1) 3.2 Any tenant improvements requiring a building permit shall be submitted for plan check for approval by the Community Development Department and applicable building plan check and permit fees paid.
