HomeMy WebLinkAboutPC RES 3001 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 3001 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 91-32, AUTHORIZING THE ESTABLISHMENT OF A BULK REVERSE VENDING MACHINE AT AN EXISTING SUPER MARKET AT THE PROPERTY LOCATED AT 13270 NEWPORT AVENUE The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: A· A proper application, Conditional Use Permit 91-32, has been filed by ENVIPCO California, Inc. requesting authorization to establish a bulk reverse vending machine at an existing super market at the property located at 13270 Newport Avenue. B· A public hearing was duly called, noticed and held for said application on January 27, 1991. Ce The proposed use is a conditionally permitted use within the Retail Commercial (C-i) District pursuant to City Code Section 9232b (v) . D· That the establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use nor be a detriment to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin as evidenced by the following findings: The proposed bulk reverse vending machines incorporate new technologies in the collection, redemption, storage and handling of recyclable materials, which reduce the potential for health and safety issues. · The establishment of the bulk reverse vending machines will aid the City of Tustin, its businesses and residents in 1 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 2'2 23 24 25 26 27 28 Resolution No. 3001 Page 2 meeting the goals of Assembly Bills 939 and 2020. The Bills deal with recycling and source reduction needs for the area and promote a cleaner and safer environment. · The proposed machines utilize a voucher pay redemption system which eliminates on-site money boxes. With this elimination, the potential of burglary, theft and vandalism is reduced. · The proposed machines incorporate collection storage units into the machine; thus, eliminating the need for additional on-site storage bins. · The proposed machines utilize more efficient means of collection, thus reducing customer wait time. The reduced wait time will facilitate improved circulation systems to the machines. · The Lucky's Food Center currently provides site lighting which reduces the potential for vandalism. E · That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, as evidenced by the findings (D 4-6) stated above. ~is project i~ ~tegoricaiiy Exempt from the requirements of the California Environmental Quality Act, pursuant to Section 15303 (Class 3). KATHLEEN CLANCY Recording Secretary EXHIBIT A RESOLUTION NO. 3001 CONDITIONS OF APPROVAL CONDITIONAL USE PERMIT 91-32 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped January 27, 1992, on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Conditional Use Permit approval shall become null and void unless building permits are issued within twelve (12) months of the date on this Exhibit. (1) 1.4 Approval of Conditional Use Permit 91-32 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. *** 1.5 Ail Conditions of Approval for Variance 91-21, as set forth in Exhibit A of Resolution No. 3002, shall apply to this Resolution. *** 1.6 The subject property shall be maintained in a safe, clean and sanitary condition at all times. Any City Code or other violations, as determined by the Community Development Department or other City agency, may be grounds of revocation of this Conditional Use Permit. A complete, de=aiied project sign .program includinc~ design, location, sizes, cclors and materials shall be submitted for review and approval by the Department of Community Development. The sign program shall include project identification, addressing and directional signs. PLAN SUBMITTAL (1) 3.1 At plan check, submit three (3) sets of construction plans. Requirements of the Uniform Building Code shall be complied with as approved by the Building Official. (1) 3.2 Technical details and plans for all utility installations, including cable TV, telephone, gas, water, and electricity shall be required as applicable. No field changes shall be made without corrections submitted to and approved by the Building Official. FEES (1) 4.1 Payment of building plan check and permit fees to the Community Development Department shall be made prior to the issuance of any building permits in accordance with the Tustin City Code.
