RESOLUTION NO. 3000
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, CONDITIONALLY APPROVING CONDITIONAL USE
PERMIT 91-28 AUTHORIZING THE USE OF AN EXISTING
DETACHED ACCESSORY STRUCTURE AS A GUEST ROOM ON THE
PROPERTY LOCATED AT 170 SOUTH "B" STREET.
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That proper applicationS, Conditional Use Permit
91-28 and Variance 91-17, were filed by Mr. and
Mrs. Ray Madrid to allow an existing structure to
be permitted as a second single-family dwelling
with less than the required number of parking
spaces at 170 South "B" Street.

That a public hearing was duly noticed, called and
held on said application on January 13, 1992, and
continued to January 27, 1992.

Pursuant to Section 9291 of the Tustin Municipal
Code, the Commission that the establishment,
maintenance or operation of the use applied for
will not, under the circumstances of the particular
case, be detrimental to the health, safety, morals,
comfort and general welfare of the persons residing
or working in the neighborhood or such proposed
use, and will not be injurious or detrimental tc
property and improvements in the neighborhood o~
general welfare of the City as evidenced by th~
following:
1. The land area of the property allows for a
density which is consistent with that of th~
surrounding residential district.
2. The layout of the existing structures provides
adequate distance from the street and adjacent
dwellings. Noise impacts to surroundin¢
properties will be minimal.
3. The structure was legally constructed wit~
proper building permits and in accordance wit~
the City's Zoning Code applicable at the time
of construction.

The minor improvements will not impact
adjacent properties as the structure it
existing and the conversion to a guest roo~
will be satisfied by the removal of th~

cooking facility and include a restriction
that the guest room will not be rented.
This project has been determined to be
Categorically Exempt (Class 1) pursuant to Section
15301 of the California Environmental Quality Act.
II. The Planning Commission hereby approves Conditional Use
Permit 91-28 authorizing the use of the detached
accessory structure as a guest room on the property
located at 170 South "B" Street, subject to the
conditions contained in Exhibit A, attached hereto.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Commission, held on the 27th day of January, 1992.

CONDITIONS OF APPROVAL
CONDITIONAL USE PERMIT 91-28
GENERAL
(1) 1.1 The proposed project shall substantially conform to the
submitted plans date stamped January 27, 1992, on file
with the Community Development Department as herein
modified or as modified by the Director of Community
Development.
*** 1.2 Conditional Use Permit 91-28 approval shall become null
and void unless the cooking facility is removed from the
existing detached accessory structure within 30 days.
(1) 1.3 Approval of Conditional Use Permit 91-28 is contingent
upon the applicant signing and returning an "Agreement to
Conditions Imposed" form, as established by the Director
of Community Development.
*** 1.4 A covenant and restriction shall be prepared for the
property stating the 624-square foot detached accessory
structure is considered a guest room rather than a
separate residential unit. The guest room is prohibited
from having at any time or installation in the future of
cooking facilities and may not be rented unless a
subsequent Conditional Use Permit is approved by the
Planning Commission for such use pursuant to Tustin City
Code Section 9223(b) (1). Said covenant and restriction
shall be submitted for review and approval by the
Community Development Department and City Attorney within
30 days.
