RESOLUTION NO. 2996
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, CALIFORNIA, FOR SIGN CODE EXCEPTION 91-
01 APPROVING THE REQUEST TO REDISTRIBUTE THE
MAXIMUM ALLOWABLE SQUARE FOOTAGE OF SECONDARY
BUSINESS IDENTIFICATION WALL OR CANOPY SIGNS; AND
DENYING THE REQUEST TO INCREASE THE MAXIMUM SIGN
AREA FOR THE BUSINESS IDENTIFICATION MONUMENT
LOCATED AT 13052 NEWPORT AVENUE, TUSTIN
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That a proper application, Sign Code Exception 91-
01, has been filed by Greer Engineering Co. on
behalf of Chevron U.S.A., Inc. requesting a Sign
Code Exception from the City of Tustin Sign Code to
allow the redistribution of the maximum allowable
square footage of secondary business identification
wall or canopy signs; and to permit the increase of
the maximum sign area for the business
identification monument from 32-square feet to
39.27-square feet.

That a public hearing was duly called, noticed and
held for said application on January 13, 1992.
C.
Pursuant to City of Tustin Sign Code Section 9204C,
the request to redistribute the maximum allowable
square footage of the secondary business
identification wall or canopy sign can be supported
by the following findings:

The applicant has followed the sign size and
placement as closely as practical. The
proposed size of the secondary signs is less
than the permitted 25 square feet. The
proposed locations of the signs are all
considered, by the Tustin Sign Code, to be
eligible for the placement of secondary signs,i
The granting of this exception will satisfy'
the intent and purpose of the sign regulations
in that locations of the proposed secondary
signs are to provide adequate business
identification for the motorists on Irvine
Boulevard.

There are special circumstances unique to the
property in that the parcel configuration is
unusual and dictates a unique building layout.

Granting of this exception will not have a
negative impact on the surrounding community
as the area of the signs are less than that
permitted by the Sign Code and the design and
placement of the proposed signs are to be
integrated into the building structures and do
not present a "cluttered" facade.
Pursuant to City of Tustin Sign Code Section 9405C,
the request to increase the maximun~ sign area for
the business identification monument cannot be
supported by the following findings:
i ·
The monument sign size and placement
restrictions, as established by the Sign Code,
can be satisfied without an exception in that
there are no physical limitations which
prevent the monument sign from being provided
in accordance with the Code.
·
The intent and purpose of the sign regulations
can be satisfied without an exception. There
are no special circumstances unique to the
property which justifies the increase in
monument sign size as the location of the
monument sign is on a prominent corner with no
restrictions in visibility to the sign.
·
The recently adopted sign Code evaluated
specifically and established standards for
service stations to provide adequate business
identification while providing necessary
customer information. Any deviation to
increase the sign area would have a negative
visual impact on the community.

E. This projec5 is Categorically Exempt from the.
requirements of the California Environmental Quality Act,i
pursuant to Section 15302 (Class 2).
II. The Planning Commission hereby approves the request tot
redistribute the maximum allowable square footage of the
secondary business identification wall or canopy signs
illustrated in Exhibit B attached hereto.
III. The Planning Commission hereby denies the request to
increase the maximum sign area for the business
identification monument from the permitted 32-square feet
to 39.27-square feet.

CONDITIONS OF APPROVAL
SIGN CODE EXCEPTION 91-01
GENERAL
*** 1.1 The proposed project shall substantially conform to
(1) submitted plans date stamped January 13, 1992, on file
with the Community Development Department as herein
modified or as modified by the Director of Community
Development.
In accordance with this Exhibit, the Director of
Community Development may also approve subsequent minor
modifications to plans during plan check if such
modifications are determined consistent with the approved
plans.
(1) 1.2 Unless otherwise specified, all conditions in this
exhibit shall be complied with prior to issuance of any
building permits for the project, subject to review and
approval by the Community Development Department.
(1) 1.3 Sign Code Exception approval shall become null and void
unless sign permits and all construction is completed
within eighteen (18) months of the date of this exhibit.
(1) 1.4 Approval of Sign Code Exception 91-01 is contingent upon
the applicant signing and returning an "Agreement to
Conditions Imposed" form as established by the Director
of Community Development.
(4) 1.5 Ail signs shall conform to the City of Tustin Sign Code
including window signs which shall not exceed 25% of
glass area upon which the sign is located.
*** 1.6 Ail Conditions of Approval for Conditional Use Permit 91-
25 and Design Review 91-44, as set forth in Exhibit A of
Resoiution No. 2995, shall apply to this Resolution.
1.7 A complete, detailed project sign .program including
design, location, sizes, colors, and materials shall be
submitted for review and approval by the Community
Development Department.

The sign program shall include all project
identification, addressing and directional signs to autos
to proper access, parking and loading.
PLAN SUBMITTAL
2.1 At sign permit and building plan check the following
shall be submitted:

sets of structural calculations.
FEES
(1) 3.1 Prior to issuance of any building permits, payment shall
