HomeMy WebLinkAboutPC RES 2983 9 10 11 13 14 15 18 19 '2 '2 ~3 94 25 ~6 27 ~8 RESOLUTION NO. 2983 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING DESIGN REVIEW 91-49 FOR A BUSINESS IDENTIFICATION SIGN WITH EXPOSED NEON TUBING ON THE SECONDARY WALL AND A SUPPLEMENTAL SIGN ON THE PRIMARY WALL OF THE CAR WASH LOCATED AT 1501 NISSON ROAD The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae That a proper application was filed on behalf of Tustin Auto Spa, Inc. (Caf~ Auto Spa) requesting approval of Design Review 91-49 for a business identification sign with exposed neon tubing on the secondary wall and a supplemental sign on the primary wall for the property located at 1501 Nisson Road. Be That this item is considered Categorically Exempt (Class 11) pursuant to Section 15311 of the California Environmental Quality Act. Ce That pursuant to Section 9408(B) (2) of the Tustin City Code, the Director of Community Development has determined the primary and secondary building walls for the purpose of calculating allowable sign areas. De That Tustin city Code Section 9404(c) (2) provides that the Planning Commission can determine whether exposed neon tubing is compatible with the architectural style and character of the building. That the Plannina Commission has considered the proposed location, size, scale, type of illumination, and compatibility of the signs with the architectural design of the buildings pursuant to the requirements of Tustin City Code Section 9403(H) (1) and found that the proposed signs generally meet the criteria. II. KATHLEEN CLANCY Recording Secretary EXHIBIT A DESIGN REVIEW 91-49 CONDITIONS OF APPROVAL RESOLUTION NO. 2983 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date-stamped November 25, 1991 on file with the Community Development Department or as herein modified in accordance with this Exhibit. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Design review approval shall become null and void unless building permits, including sign and electrical permits, are issued within eighteen (18) months of the date on this Exhibit. (1) 1.4 The applicant and property owner shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any building permits. (1) 1.5 Ail signs shall meet the maximum allowable sign area (5) standards of the Tustin City Sign Code. The supplemental sign, located on the primary (freeway) elevation, shall not exceed 18.75-square feet. The applicant may also revise the plans to include a 56.25-square foot business identification wall sign on the primary elevation, not to exceed a total of 75-square feet of sign area on the primary wall, including any supplemental sign area. (1) 1.6 Ail permanent signage shall be maintained in accordance with the Tustin Sign Code, including the use of temporary banner displays which require a Temporary Use Permit approved by the Community Development Department. PLkN SUBMITTAL (1) 2.~ At building plan check, two sets of construction plans shall be submitted. The construction plans shall be in accordance with applicable Building Codes and shall be inspected by the Community Development Department during construction, prior to final approval. FEES (1) 3.~ Payment of all applicable plan check and building permit fees shall be made to the Community Development Department. PR:nm
