RESOLUTION NO. 2978
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING
CONDITIONAL USE PERMIT 91-16 TO AMEND
CONDITIONAL USE PERMIT 74-9 TO ALLOW THE
DEVELOPMENT OF A PARKING LOT ON THE NORTHEAST
CORNER OF ENDERLE CENTER AND VANDENBERG LANE
WHERE AN OFFICE BUILDING WAS PREVIOUSLY
PROPOSED
The Planning Commission of the City of Tustin does hereby
resolve as follows:

The Planning Commission finds and determines as
follows:
A·
That a proper application, Conditional Use
Permit 91-16 has been filed on behalf of EMS
Development Company to authorize the
development of a parking lot at 14082 Enderle
Center also legally described as Lot 9 of
Parcel Map recorded in Book 84, Pages 28 - 30
of Parcel Maps, City of Tustin, County of
Orange.

That a public hearing was duly called, noticed
and held for a re-hearing of said application
on November 12, 1991.

That the establishment, maintenance, and
operation of the use applied for will not,
under the circumstances of this case, be
detrimental to the health, safety, morals,
comfort, or general welfare of the persons
residing or working in the neighborhood of
such proposed use nor be a detriment to the
property and improvements in the neighborhood
of the subject property, nor to the general
welfare of the City of Tustin as evidenced by
the following findings:

The proposed parking lot will be buffered
from adjacent land uses in that a berm
and an adequate number of street trees,
shrubs and groundcover will be required
for the project in conformance with City
Landscape Standards.
·
The proposed use will provide needed
overflow parking for the shopping center
of which it is a part.

This proposed project is Categorically Exempt
(Class 11) pursuant to Section 15311 of the
California Environmental Quality Act.
II. The Planning Commission hereby approves Conditional
Use Permit 91-16 amending Conditional Use Permit
74-9 to allow the development of a parking lot on
the northeast corner of Enderle Center and
Vandenberg Lane addressed as 14082 Enderle Center,
where an office building was previously proposed.
PASSED AND ADOPTED by the Planning Commission of the City
of Tustin at a regular meeting held on the 12th day of
November, 1991.

FINDINGS AND CONDITIONS OF APPROVAL
CONDITIONAL USE PERMIT 91-16
A. GENERAL
(1)
1.1 The proposed project shall substantially conform
with the submitted plans for the project date
stamped November 12, 1991 on file with the
Community Development Department, as herein
modified, or as modified by the Director of
Community Development Department in accordance with
this Exhibit.

1.2 Unless otherwise specified, the conditions
contained in this Exhibit shall be complied with
prior to the issuance of any building permits for
the project subject to review and approval by the
Community Development Department.
1.3 Conditional Use Permit approval shall become null
and void unless all building permits are issued
within eighteen (18) months of the date of this
Exhibit.

1.4 Any public improvements damaged by the applicant
adjacent to this property shall be repaired and/or
replaced as determined by the Engineering Division
and shall include, but not be limited to, curb and
gutter, street paving and drive apron.

1.5 Ail construction shall be in accordance with the
1988 UBC, applicable City Codes and the City's
Security Code.
(i)
1.6 Approval of Conditional Use Permit 91-16 is
contingent upon the applicant signing and returning
an "Agreement to Conditions Imposed" form, as
established by the Director of Community
Development.
(4) 1.7 Removal of the existing handicap ramp and
construction of a new handicap ramp per the current
City Standard No. 124 is required. This will
require dedication of additional right-of-way in
the form of a corner cut off per Standard No. 124.

The Engineering Division will need a legal
description and sketch of this dedication along
with a copy of the latest vesting on the property.
Also provide a title report for the property.
1.8 Provide an updated master site plan for the entire
Enderle Center, including an updated parking
summary within 30 days of Planning Commission
approval.
1.9 A reciprocal access and parking easement and
agreement shall be recorded between the subject
property, the parcels directly to the north,
identified as Assessor Parcel No. 401-235-02 and
401-235-03, and the parcels to the west of the
subject site, identified as Assessor Parcel No.'s
401-251-04, 05 and 06, and 401-252-05, 06, 08, 09,
and 10, to guarantee the continuous access between
the properties which make up Enderle Center.
SITE CONDITIONS
2.1 A combination of shrubs and berming, to equal a
total of 36-inches high, shall be added along all
streets to adequately screen parking from street
view in accordance with Resolution No, 1409 which
approved the original conditional use permit (CUP
74-9) for Enderle Center.
2.2 Replace Hedera Helix "Hahni" groundcover with a
groundcover from the suggested list of plant
material in the Landscaping and Irrigation
Standards.
2.3 At least 5% of parkin~ lot area and any additional
portion not actually used for movement and parking
of vehicles shall be landscaped with trees, shrubs
and groundcover.
2.4 Perimeter trees shall be planted in a planter of
sufficient width to provide 2-1/2 feet minimum
clearance for vehicle overhang.
2.5 Project must include one (1) 15 gallon tree for
each five (5) parking stalls within the parking lot
and five (5) -5 gallon shrubs per 25 lineal feet of
planter area.

2.6 Any unused space resulting from design of the
parking area shall be landscaped.
2.7 Ail newly planted trees must be staked according to
City Standards.
2.8 Shrubs shall be a minimum of five (5) gallon size
and shall be spaced a minimum of five (5) feet on
center when intended as screen planting.
2.9 Ground cover shall be planted between eight (8) and
twelve (12) inches on center.
2.10 When one (1) gallon plant sizes are used, the
spacing may vary according to the material used.
2.11 Ail plant material shall be installed in a healthy
vigorous condition typical to the species.
2.12 Landscaping shall be enclosed by minimum six (6)
inch high concrete curbs.
2.13 Select and locate plant materials to promote water
and energy conservation.
2.14 Ail landscaping areas shall be adequately
maintained. This will include but not be limited
to: trimming, mowing, weeding removal of litter,
fertilizing, regular watering, and replacement of
diseased or dead plants.
2.15 Ail landscaped areas shall be provided with a
permanent and adequate means of irrigation which is
adequately maintained.
2.16 Backflow preventions shall be provided including
screening for backflow units.
2.17 Enclose controller in lockable housing.
2.18 Design system to provide sufficient coverage
avoiding water overspray on buildings and
sidewalks.
2.19 A thirty foot proposed driveway originally proposed
on Vandenberg Lane shall be moved to Enderle Center
Drive, located 100 feet from the corner radius of

Vandenberg Lane and Enderle Center Drive.
2.20 Modifications to traffic signing shall be required
along Enderle Center Drive to accommodate right and
left turn movements from the proposed driveway.
Cost of resigning pavement shall be borne by the
developer in an amount determined by the City
Engineer.
PLAN SUBMITTAL
3.1 At plan check, submit three (3) sets of
construction plans. Requirements of the Uniform
Building Code shall be complied with as approved by
the Building Official. No field changes shall be
made without corrections submitted to and approved
by the Community Development Department.
3.2 A separate 24" x 36" street improvement plan,
prepared by a California Registered Civil Engineer,
will be required for all construction within the
public right-of-way. This plan shall include, but
not be limited to the following:
a. curb and gutter
b. sidewalk
c. drive apron
d. handicap ramp
3.3 Revise the legal description shown on the site plan
and the conceptual grading to agree.

FEES
4.1 Payment of all Building plan check and permit fees
shall be made prior to issuance of any building
permits in accordance with the Tustin City Code.
