HomeMy WebLinkAboutPC RES 2966 1 2 3 4 5 6 t 8 9 10 11 12 13 14 15 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 2966 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING THE REQUEST TO AUTHORIZE THE USE OF EXPOSED NEON TUBING IN THREE (3) WALL SIGNS AND ONE (1) MONUMENT SIGN PROVIDING BUSINESS IDENTIFICATION AT THE RESTAURANT LOCATED AT 17320 SEVENTEENTH STREET The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: a. That a proper application was filed on behalf of The Olive Garden Italian Restaurant requesting approval of the use of exposed neon tubing in three (3) wall signs and one (1) monument sign which will provide business identification for the property located at 17320 Seventeenth Street. Be That this item is considered Categorically Exempt (Class 11) pursuant to Section 15311 of the California Environmental Quality Act. C· That Tustin City Code Section 9444(i) and Section 9272(c) provides that the Planning Commission can determine whether exposed neon tubing is compatible with the architectural style and character of the building. D · That the Planning Commission has considered the proposed installation, location, size, and illumination of the exposed neon tubing pursuant to the requirements of Tustin City Code Section 9272(c) and found that the proposal to use exposed neon tubing in three (3) wall signs and one (1) neon sign is within this criteria. II. The Planning Commission of the City of Tustin does hereby authorize the use of an exposed neon tubing in three (3) wall signs and one (1) neon sign on the restaurant located at 17320 Seventeenth Street subject to the conditions attached hereto on Exhibit A. PASSED AND ADOPTED at a regular meeting o~the Tustin Planning Commission, held on the 28th day of October, 1991· /Chairman . Secretary EXHIBIT A CONDITIONS OF APPROVAL RESOLUTION NO. 2966 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped October 28, 1991 on file with the Community Development Department or as herein modified in accordance with this Exhibit. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Design review approval shall become null and void unless building permits are issued within eighteen (18) months of the date on this Exhibit. (1) 1.4 The applicant and property owner shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any building permits. (1) 1.5 Ail building signage shall be maintained in accordance with the Tustin Sign Code; specifically as pertains to the use of temporary banner displays which require an approved Temporary Use Permit from the Community Development Department. PLAN SUBMITTAL (1) 2.1 At building plan check, two sets of construction plans shall be submitted and the construction plans shall be in accordance with applicable Building Codes and shall be inspected by the Community Development Department during construction and prior to final. FEES (1) 3.1 Payment of all applicable plan check and building permit fees shall be made to the Community Development Department.
