HomeMy WebLinkAboutPC RES 2951 1 3 4 6 7 9 10 11 12 13 14 15 16 17 18 19 20 9.1 29. 23 24 25 26 ~7 28 RESOLUTION NO. 2951 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 91-21 TO CONTINUE THE DISPLAY OF TWO TEMPORARY BANNERS AT THE KEY INN LOCATED AT 1161 EL CAMINO REAL, TUSTIN The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: A· A proper application, Conditional Use Permit 91-21 has been filed on behalf of Key Inn by TheoPacific Corporation to allow the display of two temporary banners to continue until the completion of construction of the Red Hill Avenue overcrossing and on- and off-ramps in approximately October of 1992. Ce That the establishment, maintenance and operation of the use applied for will not be detrimental to the health, welfare, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, nor be a detriment to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin as evidenced by the following findings: . The need for the additional signage is temporary. The banners will be displayed only for the duration of construction of the nearby Red Hill Avenue overcrossing, including on- and off-ramps, or until October 31, 1992. · The banners are oriented toward the adjacent freeway and do not impact residential properties. · The size and location of the banners does not adversely impact the health, safety or welfare of those residing or working in the vicinity. 1 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 Resolution No. 2951 Page 2 E. This project is Categorically Exempt from the requirements of the California Environmental Quality Act, pursuant to Section 15311 (Class 11). II. The Planning Commission hereby approves Conditional Use Permit 91-21 to continue the display of two temporary banners at the Key Inn (1161 E1 Camino Real) until the completion of construction of the Red Hill Avenue overcrossing, including on- and off-ramps, in approximately October of 1992,subject to the conditions contained within Exhibit A, attached hereto. KATHLEEN CLANCY Recording Secretary EXHIBIT A RESOLUTION NO. 2951 CONDITIONS OF APPROVAL CONDITIONAL USE PERMIT 91-21 GENERAL (1) 1.1 The proposed project shall substantially conform with photographs and plans date-stamped September 23, 1991 on file with the Community Development Department. (4) 1.2 Conditional Use Permit 91-21 shall become null and void on October 31, 1992. (4) 1.3 Any modification to Conditional Use Permit 91-21, such as a request for an extension of the time period, must be received by the Community Development Department a minimum of 30 days prior to October 31, 1992, the expiration date. All modifications shall be approved, approved with conditions or denied by the Planning Commission. USE RESTRICTIONS (4) 2.1 The banners shall be securely attached to the building wall at all times. (2) 2.2 The banners shall be maintained and replaced or removed (4) when torn, frayed, faded or damaged, as determined by the Director of Community Development.
