RESOLUTION NO. 2940
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, CONDITIONALLY APPROVING CONDITIONAL USE
PERMIT 91-18 AND DESIGN REVIEW 91-16 AUTHORIZING
THE CONVERSION OF AN EXISTING 360-SQUARE FOOT
DETACHED GARAGE INTO A GUEST ROOM WITH RELATED SITE
IMPROVEMENTS, INCLUDING THE CONSTRUCTION OF AN
ADDITIONAL 2,012-SQUARE FEET TO THE EXISTING
RESIDENCE AND CONSTRUCTION OF A 447-SQUARE FOOT
ATTACHED GARAGE ON THE PROPERTY LOCATED AT 13321
WOODLAND DRIVE
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I.
The Planning Commission finds and determines as follows:
A. That a proper application, Conditional Use Permit
91-18 and Design Review No. 91-16 was filed on
behalf of Mr. Min Sung Kim for the conversion of a
detached garage to a guest room with related site
improvements on the property located at 13321
Woodland Drive.
B. That a public hearing was duly noticed, called and
held on said application on August 26, 1991.
C. That the establishment, maintenance or operation of
the use applied for will not, under the
circumstances of the particular case, be
detrimental to the health, safety, morals, comfort
and general welfare of the persons residing or
working in the neighborhood or such proposed use,
and will not be injurious or detrimental to
property and improvements in the neighborhood or
general welfare of the City as evidenced by the
following:
1. The site is of adequate size and layout tol
accommodate the guest home as all applicable;
development standards such as setbacks, lot
coverage, height and parking, can be
satisfied.
2. The conversion results in exterior
modifications to an existing structure,'
providing an upgrade in the overall property's
appearance.
3. The improvements proposed will not create a
new dwelling or second single-family residence
in that the conversion will not include
provisions for cooking facilities.

4. The improvements will not impact adjacent
properties as the structure is existing and
the conversion will not result in additional
height nor provide windows that would view
onto adjacent side yards.
C. Pursuant to Section 9272 of the Tustin Municipal
Code, the Commission finds that the location, size,
architectural features and general appearance of
the proposed development will not impair the
orderly and harmonious development of the area, the
present or future development therein. In making
such findings, the Commission has considered at
least the following items:
1. Height, bulk and area of buildings.
2. Setbacks and site planning.
3. Exterior materials and colors.
4. Type and pitch of roofs.
5. Size and spacing of windows, doors and other
openings.

Towers, chimneys, roof structures, flagpoles,I
radio and television antennae.
Landscaping, parking area design and traffic)
circulation.
Physical relationship of proposed structures
to existing structures in the neighborhood.
Appearance and design relationship of proposed'

public thoroughfares.
Development Guidelines and criteria as adopted
by the City Council.
E. This project has been determined to be
Categorically Exempt (Class 3) pursuant to Section
15303 of the California Environmental Quality Act.'
II. The Planning Commission hereby approves Conditional Use
Permit 91-18 and Design Review 91-16 authorizing the'

conversion of an existing 360-square foot detached garage
into a guest room with related site improvements,
including the construction of an additional 2,012-square
feet to the existing residence and construction of a 447-
square foot attached garage on the property located at
13321 Woodland Drive, subject to conditions attached;
hereto as Exhibit A.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Commission, held on the 26th day of August 1991.

CONDITIONS OF APPROVAL
CONDITIONAL USE PERMIT 91-18 AND DESIGN REVIEW 91-16
GENERAL
(1) 1.1 The proposed project shall substantially conform to the
submitted plans date stamped August 26, 1991 on file with
the Community Development Department as herein modified
or as modified by the Director of Community Development.
(l) 1.2 Unless otherwise specified, all conditions in this
exhibit shall be complied with prior to the issuance of
any buildinC permits for the project, subject to review
and approval by the Community Development Department.
(1) 1.3 Conditional Use Permit 91-18 and Design Review 91-16
approval shall become null and void unless building
permits and all construction is completed within eighteen
(18) months of the date of this exhibit.
(1) 1.4 Approval of Conditional Use Permit 91-18 and Design
Review 91-16 is contingent upon the applicant signing and
returning an "Agreement to Conditions Imposed" form, as
established by the Director of Community Development.
(1) 1.5 Any public improvements damaged by the app 1 icant adjacent
to this project shall be repaired and/or replaced as
determined by the Engineering Division and shall include,
but not be limited to, curb and gutter, street paving and
drive apron.
*** 1.6 A certificate of occupancy shall not be issued for the
guest room conversion until a certificate of occupancy is
obtained on the proposed new garage addition.
PLAN SUBMITTAL
(1) 2.1 At building plan chec}; and prior to the issuance of
(3) building permits, the applicant shall submit three
(3) copies of construction drawings and two (2) copies of
structural calculations for approval by the Building
Official.

SITE RESTRICTIONS
___._ *** 3.1 A covenant and restriction shall be prepared for the
property stating the the converted 360-square foot
detached garage is considered a guest room rather than a
separate residential unit. The guest room is prohibited
from the installation of cooking facilities and may not
be rented unless a subsequent Conditional Use Permit is
approved by the Planning Commission for such use pursuant
to Tustin City Code Section 9223 (b) (1) . Said covenant
and restriction shall be reviewed and approved by the
Community Development Department and City Attorney and
recorded with the County Recorder's Office prior to
issuance of any permits.
*** 3.2 The applicant shall remove the wet bar from the submitted
plans for the guest room and no authorization for
installation shall be granted.
FEES
(1) 4.1 Payment of the following fees shall be made prior to the
issuance of any building permits in accordance with the
Tustin City Code:
a. Building plan check and permit issuance fees to the
Community Development Department.
b. School District fees to the Tustin Unified School
District as applicable.
