I 27 9.8 RESOLUTION NO. 2939 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING AN AMENDMENT TO CONDITIONAL USE PERMIT 88-15, TO ALLOW REVISIONS TO THE MASTER SIGN PROGRAM FOR THE TUSTIN MARKET PLACE. The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: A· A proper application (Amendment to CUP 88-15) was filed by Graphic Solutions, representing the Irvine Company, requesting approval of an Amendment to the M~ster Sign Program for the Tustin Market Place. B· A public hearing was duly called, noticed and held on said application on August 26, 1991. C· Pursuant to Section 9291 of the Tustin Municipal Code, the Commission finds that the proposed Amendment to the Master Sign Program will not be detrimental to the health, safety, morals, comfort or general welfare of persons residing or working in the general area, nor will it be injurious or detrimental to the property or general welfare of the City of Tustin. The Commission further finds that the amended Master Sign Program will provide for signs that are compatible with, and complimentary to the architectural design and treatments of the Tustin Market Place, as evidenced by the following findings: · The safety of shopping center patrons will not be compromised by the proposed plan. · The goals and objectives of the proposed amendment, and the locations, proportions, areas, and styling of sign types described in the proposed sign program are not injurious or detrimental to the welfare of the City or its residents. · The sign designs that result from the revised program will better serve public needs and interests than the originally- approved designs. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 Resolution No. 2939 Page 2 II. The Planning Commission hereby approves the Amendment to Conditional Use Permit 88-15 to allow revisions to the approved master sign program for the Tustin Market Place, subject to conditions contained in Exhibit "A", attached hereto. 'KATHLEEN CLANCY Recording Secretary EXHIBIT A AMENDMENT TO CONDITIONAL USE PERMIT 88-15 CONDITIONS OF APPROVAL RESOLUTION NO. 2939 GENERAL (1) 1.1 Ail signage for the Tustin Market Place project shall substantially conform with the Sign Plan for Tustin Market Place "Primary Amendment", dated August 26, 1991, on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this exhibit. (1) 1.2 The applicant and shopping center owner shall sign and return an Agreement to Conditions Imposed form prior to issuance of sign or building permits. 1.3 The applicant shall revise the Sign Plan for Tustin Market Place "Primary Amendment", to include any and all corrections and changes required by this Resolution for review and approval by the Community Development Department prior to the issuance of any sign permits affected by the Amendment and this Resolution. Failure to submit the revised program within 30 days of approval may be grounds for the amendment to become null and void. 1.4 Pursuant to Section 3.12.2.F of the East Tustin Specific Plan minor deviations from the sign plan for the Tustin Market Place (up to a maximum of 10% increase in height or area), shall require the prior approval of the Director of Community Development; all other deviations shall require the prior approval of the Planning Commission. 1.5 Ail signs shall be subject to review and approval of the Director of Community Development for compliance with the Sign Plan for the Tustin Market Place, including design, colors, illumination type, materials, etc., prior to issuance of permits for a sign. 1.6 Ail signs shall comply with the applicable provisions of the Uniform Building Code and the National Electrical Code as adopted by the City (including UL approvals). Construction level plans, including any required structural calculations, for all project signs shall be submitted, reviewed and approved by the Community Development Department prior to issuance of sign permits. ~.9 The primary amendment to the Sign Plan for the Tustin Market Place, dated August 26, 1991, shall be modified as follows: ae Page 9, Section E - Theme Banners - include the language "product, service, merchandizing or center-wide sale advertising shall be prohibited" Be Page 9, Section E - Theme Banners - delete the sixth bullet item stating "streamers may be used in conjunction with banners" Ce Page 16, Exhibit 6 - remove graphic depiction of streamers De Page 45 - Temporary Signage - Item B, modify last bullet statement - "banners may be established for 30-day periods subject to Tustin City Code provisions related to time extensions" Page 25 and 26 - Wall Sign Copy Area Allowance Charts - add footnote to criteria for open line sign elements stating: "*Subject to Design Review by the Community Development Department In approving, denying or modifying a proposed open line element, the following criteria shall be utilized: · The size and spacing of the open line elements shall be in proportion to the lettering and closed-line figures of the proposed sign, as well as the height, bulk and area of the building facade. . Open-line elements shall generally be an integral component of and relate to the Exhibit A Resolution No. 2939 Page 3 overall sign design. · Open-line elements shall not be used to merely "fill-up" the allowable placement area or as an attention-getting device." FEES (1) Z.1 Ail applicable plan check, sign and building permit fees shall be paid to the Community Development Department prior to issuance of any sign permits. PR:nm
