HomeMy WebLinkAboutPC RES 29221 2' 31 4 5 8 9 10' 11 12 13 14 15 1(;i ~~ li IR i l~ii I. 20 i 21' 22 . 23 ~i 24 ; ; 2J 26 27 28 RESOLUTION NO. 2922 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING VARIANCE 91-12, TO ALLOW A BUSINESS IDENTIFICATION WALL SIGN ON A SECOND SIDE ELEVATION AND ALLOW BOTH SIDE WALL SIGNS TO EXCEED THE MAXIMUM ALLOWABLE SIGN AREA, SUBJECT TO CONDITIONS, AT 17260 E. SEVENTEENTH STREET. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. That a proper application Variance 91-12 has been f filed on behalf of Crab Cooker of Newport, Inc. to allow a business identification wall sign on a second side elevation and allow both side wall signs to exceed the maximum allowable sign area at 17260 E. Seventeenth Street. B. That a public hearing was duly called, noticed and held for said application on July 22, 1991. C. That the Planning Commission has reviewed the request to allow a business identification wall sign on a second side elevation and allow both side wall signs to exceed the maximum allowable sign area and can be supported by the following findings: 1. There are unusual or exceptional circumstances applicable to the size, shape, topography, location or intended use of the subject property which do not apply to other properties in the same zoning district. The corner lot configuration, distance from the primary street frontage, surrounding land uses and siting of the existing structure are unique factors pertaining to the site. 2. Granting of the Variance will not convey a special privilege to the property owner which is not enjoyed by other property owners in the vicinity. The granting of the Variance will not be detrimental to adjacent and surrounding properties. Allowing an additional side wall sign and authorizing increased sign area on two side building walls will not adversely impact nearby residential areas or area vehicular traffic. 4. The granting of the Variance will not be contrary to the goals and policies of the General Plan. II. The Planning Commission hereby approves Variance 91-12 to allow a business identification wall signs on a second side elevation and allow both side wall signs to exceed the maximum allowable sign area at 17260 E. Seventeenth Street. PASSED AND ADOPTED at a regular Planning Commission meeting on the 22nd day of July, 1991. ~` ^. In accordance with this Exhibit, the Director of Community Development may also approve subsequent minor modifications to plans during plan check if such modifications are determined consistent with the approved plans. (1) 1.2 Unless otherwise specified, all conditions in this exhibit shall be complied with prior to issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Variance approval shall become null and void unless sign permits and all construction is completed within twelve (12) months of the date of this exhibit. (1) 1.4 Approval of Variance 91-12 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (5) 1.5 A 46.5-square-foot business identification wall sign shall be allowed on the east side building wall, facing the Enderle Center parking area. (5) 1.6 A maximum 31.5-square-foot business identification wall sign shall be allowed on the west side building wall, facing Yorba Street. (5) 1.9 No signage shall be allowed on the rear (south) building elevation, facing Vandenberg Lane. (5) 1.10 The exposed neon tubing, outlining the letters of the painted signs on the north front and west side walls, shall remain at all times. If the neon tubing is removed, the entire sign shall be replaced with interior- illuminated metal letters with plastic faces or reverse channel metal letters. PLAN SUBMITTAL (1) 2.1 At building plan check and prior to issuance of sign (4) permits, the following shall be submitted: a. The applicant shall provide two copies of plans including site plan, fully dimensioned and detailed elevations, attachment methods and electrical details for approval of the Building Official. All electrical components shall be U.L. listed. (1) 2.2 The applicant shall pay all applicable plan check and permit fees to the Community Development Department. PR:nm
