RESOLUTION NO. 2895
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, DENYING VARIANCE 91-05, A
REQUEST TO REDUCE THE PARKING REQUIREMENT FROM
11 SPACES TO 6 SPACES TO ACCOMMODATE 34 SEATS
IN CONJUNCTION WITH A RESTAURANT
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I ·
The Planning Commission finds and determines as
follows:
A·
That a proper application, Variance 91-05 was
filed by Mr. Daljit Singh to allow a reduction
in the parking requirement for a restaurant
use from eleven (11) spaces to six (6) spaces.
B·
That a public hearing was duly called, noticed
and held for said application on April 8,
1991.
Ce
That there are no special or exceptional
circumstances applicable to the property
relative to size, shape, topography, location
or surroundings that justify the Variance.
The site is level, regular shaped consistent
with other adjacent properties and consistent
with the required development standards of the
Retail Commercial (C-i) District.

That the granting of the Variance would
constitute a grant of special privilege
inconsistent with development standards
applicable to other properties in the vicinity
and district in which the subject property is
located. No variances to reduce parking
requirements have been allowed previously in
this vicinity.
That the granting of the Variance would be
contrary to the intent of the Retail
Commercial District Development Standards, and
could potentially have a detrimental impact on
the adjacent and surrounding properties should
the demand for parking increase in the
vicinity.
II. The Planning Commission hereby denies Variance 91-
05, an application to reduce parking requirements
in conjunction with a restaurant use from six (6)
spaces to eleven (11) spaces.
