A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, APPROVING AN AMENDMENT TO CONDITIONAL
USE PERMIT 90-10 ADDING A SIX FOOT DIAMETER
MICROWAVE GRID DISH TO A FIFTY FOOT TOWER AT 137
SOUTH PROSPECT AVENUE
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That a proper application, (Amendment to
Conditional Use Permit No. 90-10) has been filed on
behalf of Orange County News Channel to add a six
foot diameter microwave dish to an existing fifty
foot tower.

That a public hearing was duly called, noticed and
held on said application on March 25, 1991.

That establishment, maintenance, and operation of
the use applied for will not, under the
circumstances of this case, be detrimental to the
health, safety, morals, comfort, or general welfare
of the persons residing or working in the
neighborhood of such proposed use, evidenced by the
following findings:
A Negative Declaration was prepared for
Conditional Use Permit 90-10 to approve the
construction of a high-frequency radio-
reception tower on the subject property. As
conditioned, the current proposal will pose no
greater threat to surrounding properties and
improvements than the tower, in that the
microwave dish will be painted "skyblue" to
reduce its visual impact and to match the
tower and existing antennae. Additionally,
the microwave dish will increase reception for
the City's cable viewers.

The proposed improvements will be required to
satisfy the requirements of the Uniform
Building Code, and will be inspected by the
Community Development Department.

The use applied for is compatible with the
existing use of the subject property as
permitted by Conditional Use Permit 90-10.

That the establishment, maintenance, and operation
of the use applied for will not be injurious or

detrimental to the property and improvements in the
neighborhood of the subject property, nor to the
general welfare of the City of Tustin as evidenced
by the findings stated in the above paragraphs.

The installation of the microwave dish will not
preclude the removal of the antennae on the roof of
the existing building and their placement onto the
fifty foot tower, nor will it preclude the
undergrounding of the utilities exclusively serving
the site and tower previously required by Planning
Commission Resolution No. 2773.

This project is Categorically Exempt from the
requirements of the California Environmental
Quality Act, pursuant to Section 1530 (Class 1).
II. The Planning Commission hereby approves an Amendment to
Conditional Use Permit No. 90-10 to authorize the
addition of a six foot diameter microwave grid dish to a
fifty foot tower at 137 South Prospect Avenue subject to
the conditions contained within Exhibit A attached hereto
and incorporated herein by reference.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Commission, held on the 25th day of March, 1991.

RESOLUTION NO. 2887
CONDITIONS OF APPROVAL
USE PERMIT 90-10 AMENDMENT
GENERAL
(1) 1.1 The proposed project shall substantially conform with the
submitted plans for the project date stamped March 25,
1991, on file with the Community Development Department
except as herein modified, or as modified by the Director
of Community Development in accordance with this exhibit.
(1) 1.2 Ail original conditions of approval contained within
Exhibit A of Planning Commission Resolution No. 2773
shall remain in full force and effect.
(5) 1.3 No building permits shall be issued for the proposed six-
foot-diameter microwave dish until conditions 2.2 and 2.3
of Exhibit A of Resolution 2773, stating that all
antennae shall be removed from the roof of the existing
building and all utilities exclusively serving the site
shall be undergrounded, are satisfactorily completed.
(1) 1.4 Unless otherwise specified, conditions contained in this
exhibit shall be complied with prior to issuance of any
additional building permits for the project.
(1) 1.5 The applicants and property owners shall sign and return
an Agreement to Conditions Imposed form prior to the
issuance of any building permits.
(1) 1.6 The six-foot-diameter microwave dish shall be painted
"skyblue" to match existing tower, microwave dishes and
antennae.

PLAN SUBMITTAL
(1) 2.1 At building plan check three sets of construction level
plans shall be submitted as follows:

Construction plans, structural calculations, and
Title 24 energy calculations and requirements of
the Uniform Building Codes and Energy Requirements
shall be complied with as approved by the Building
Official.
(1) 2.2 Ail construction activities shall be subject to
provisions of the City of Tustin Noise Ordinance and
shall take place only during the hours of 7:00 a.m. to
6:00 p.m., Monday through Friday or other hours and times
the Building Official determines is in substantial
conformance with the Noise Ordinance and the public
health and safety will not be impaired subject to
application being made at the time a permit for the work
is granted or during program on the work.
FEES
(6) 3.1 Prior to the issuance of any building permits, payment
shall be made of all required fees including all
applicable plan check and building permit fees to the
Community Development Department.
