HomeMy WebLinkAboutPC RES 2877 3 4 $ 6 8 10 11 1'2 14 _'2O '2 I ~3 24 ~5 97 RESOLUTION NO. 2877 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING AMENDMENT TO CONDITIONAL USE PERMIT 90-18 AND DESIGN REVIEW 90-28 AUTHORIZING CONSTRUCTION OF A NEW BUILDING OF 8,300 SQUARE FEET TO ACCOMMODATE ADMINISTRATION OFFICES FOR THE CHURCH AND ENLARGE THE EXISTING DAY CARE FACILITY TO ACCOMMODATE A TOTAL OF 132 CHILDREN FOR THE PROPERTY LOCATED AT 1201 SE IRVINE BOULEVARD. The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: A· B· That a proper application (Amendment to Conditional Use Permit No. 90-18 and Design Review 90-28) has been filed on behalf of Aldersgate Methodist Church to request an expansion of a day care facility to accommodate 132 children and to provide a new administrative office by constructing a new building of 8,300 square feet. .- . That a public hearing was duly called, noticed and held on said application on February 11, 1991. Ce Pursuant to Section 9291 of the Tustin City Code, the Commission finds that the proposal will not be detrimental to the health, safety, morals, comfort, general welfare of the persons working or residing in the neighborhood nor will it be injurious or detrimental to property and improvements in the area based upon the following findings: i · Uses within the P&I (Public and Institutional) Zoning District are permitted subject to the approval of a conditional use permit; therefore, conditions of approval, attached hereto, have been included to ensure compatibility with surrounding uses. Resolution No. 2877 Page 2 fi 7 8 10 11 12 14 17 18 '21 2,1 26 28 · Standard development standards have been satisfied by provisions shown on the submitted development plans ensuring compatibility as well as reducing potential negative impacts associated with noise and parking. · The proposal to expand is compatible with the existing church use and day care facility as it will not result in generating additional parking but will actually provide enhancements to portions of the existing parking lot area, thereby bringing the overall site closer to conformance with current City standards. · The proposed expansion is compatible with surrounding uses in that the P&I - Public and Institutional Zoning District maintained for this subject property will continue to act as a buffer or transition between commercial development to the south and residential properties to the north furthering the protection of these neighborhoods from detriment resulting from significantly different land use designations. De Pursuant to Section 9272 of the Tustin Municipal Code, the Planning Commission finds that the location, size, architectural features and general appearance of the proposed development will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Planning Commission has considered at least the following items: 2. 3. 4. 5. · · Height, bulk and area of buildings. Setbacks and site planning. Exterior materials and colors. Type and pitch of roofs. Towers, roof structures, doors and windows. Landscaping, parking area design and traffic circulation. Relationship of proposed structures to existing adjacent uses. 10. Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood. 11. Proposed signing. 12. Development guidelines and criteria as adopted by the City Council. Ee This project has been determined to be categorically exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. II. The Planning Commission hereby approves Amendment to Conditional Use Permit No. 90-18 and Design Review 90-28 authorizing construction of a new building of 8,300 square feet to accommodate administration offices for the church and enlarge the existing day care facility to accommodate a total of 132 children for the property located at 1201 SE Irvine Boulevard, subject to conditions contained in Exhibit A attached hereto. KATHLEEN CLANCY Recording Secretar~ EXHIBIT A AMENDMENT TO CONDITIONAL USE PERMIT 90-18 AND DESIGN REVIEW 90-28 CONDITIONS OF APPROVAL RESOLUTION NO. 2877 (i) (i) (i) (i) GENERAL 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped February 11, 1991 on file with the Community Development Department, as herein modified, in accordance with this Exhibit. 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. 1.3 This Conditional Use Permit Amendment approval and Design Review approval shall become null and void unless all permits are issued for the proposed expansion within eighteen (18) months of the date of approval and substantial construction is underway. 1.4 Approval of the Amendment to Conditional Use Permit 90-18 and Design Review 90-28 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. 1.5 Ail applicable conditions of approval stated in Planning Commission Resolution No. 2821 approving Conditional Use Permit 90-18 shall remain in full force and effect. Construction plans, structural calculations, and Title 24 energy calculations. Requirements of the Uniform Building Codes, State Handicap and Energy Requirements shall be complied with as approved by the Building Official. (2) (3) B. (2) C. Final grading and specifications consistent with the site plan and landscaping plans and prepared by a registered civil engineer for approval of the Community Development Department. Information to ensure compliance with all requirements of the Orange County Fire chief including required fireflow and installation, where required, of fire hydrants subject to approval of the Fire Department and City of Tustin Public Works Department. Compliance with all applicable Uniform Fire Code standards are required especially related to occupancy and construction rating. SITE AND BUILDING CONDITIONS (1) 3.1 Ail exterior colors to be used shall be subject to review (4) and approval of the Director of Community Development Department. Ail exterior treatments must be coordinated with regard to color, materials and detailing and noted on submitted construction plans and elevations shall indicate all colors and materials to be used. (1) 3.2 Note on final plans that a six foot high chain linked fence shall be installed around the site prior to building construction stages. Gated entrances shall be permitted along the perimeter of the site for construction vehicles. (1) 3.3 Ail mechanical and electrical fixtures and equipment (4) shall be adequately and decoratively screened. The screen shall be considered as an element of the overall design of the project and shall blend with the architectural design of buildings. All telephone and electrical boxes shall be indicated on the building plans Exhibit A Resolution No. 2877 Page 3 and shall be completely screened. Electrical transformers shall be located toward the interior of the project maintaining a sufficient distance from frontage of the project. 3.4 Exterior elevations of the building(s) shall indicate any fixtures of equipment to be located on the roof of the building, equipment heights and type of screening. All parapets shall be at least six inches above rooftop equipment for purposes of screening. (1) 3.5 Submit detail for all on-site walls to be constructed (3) including block walls for the trash enclosure indicating (4) exterior treatment, wood fencing and wrought-iron *** fencing. (1) 3.6 Adequate size trash enclosures with solid metal, self (4) closing, self latching gates shall be provided. Said enclosure(s) shall be screened by a decorative wall of a minimum height of six feet. The actual location of said enclosures and types of screening shall be subject to approval by the Director of Community Development. Prior to issuance of a Certificate of Occupancy, the applicant shall provide written documentation from Great Western Reclamation stating that the proposed enclosure and type of trash containers (roll-off) used are adequate to accommodate the City's recycling program. LANDSCAPING, ~ROUNDS AND HARDSCAPE ELEMENTS (7) 4.1 Submit at plan check complete detailed landscaping and irrigation plans for all landscaping areas consistent with adopted City of Tustin Landscaping and Irrigation Submittal Requirements. Provide summary table applying indexing identification to plant materials in their actual location. The plan and table must list botanical and common names, sizes, spacing, actual location and quantity of the plant materials proposed. Show planting and berming details, soil preparation, staking, etc. The irrigation plan shall show location and control of backflow prevention devices, pipe size, sprinkler type, spacing and coverage. Details for all equipment must be provided. Show all property lines on the landscaping and irrigation plan, public right-of-way areas, sidewalk widths, parkway areas, and wall locations. The Department of Community Development may request minor substitutions of plant materials or request additional sizing or quantity materials during plan check. Note on Exhibit A Resolution No. 2877 Page 4 landscaping plan that coverage of landscaping irrigation materials is subject to field inspection at project completion by the Department of Community Development. (7) 4.2 The submitted landscaping plans at plan check must reflect the following requirements: ao Turf is unacceptable for grades over 25%. A combination of planting materials must be used, ground cover on large areas alone is not acceptable. Be Provide a minimum of one 15 gallon size tree for every 30 feet of property line on the property perimeter and five 5 gallons shrubs. Ce Provide one 15 gallon tree for each 5 parking spaces within an open parking area. De Shrubs shall be a minimum of 5 gallon size and shall be spaced a minimum of 8 feet on center when intended as screen planning. Eo Ground cover shall be planted between 8 to 12 inches on center. Fe When 1 gallon plant sizes are used the spacing may vary according to materials used. G · Up along fences and/or walls and equipment areas, provide landscaping screening with shrubs and/or vines and trees on plan check drawings. H· Ail plant materials shall be installed in a healthy vigorous condition typical to the species and landscaping must be maintained in a neat and healthy condition, this will include but not be limited to trimming, mowing, weeding, removal of litter, fertilizing, regular watering, or replacement of diseased or dead plants. 4.3 The use of decorative paving techniques such as stamped and colored concrete is encouraged, particularly for pedestrian paths. 4.4 Indicate lighting scheme for project, note locations of all exterior lights and types of fixtures, lights to be installed on building shall be a decorative design. No Exhibit A Resolution No. 2877 Page 5 lights shall be permitted which may create any glare or have a negative impact on adjoining properties. The location and types of lighting shall be subject to the approval of the Director of Community Development. OPERATIONS 5.1 Authorization for operation of the day care facility shall be for the hours between 7:00 a.m. and 6:00 p.m. weekdays for the care of a maximum of 132 children. FEES (1) 6.1 Prior to the issuance of any building permits, payment shall be made of all applicable fees including, but not limited to: ae Be Ce D® Ee Major thoroughfare and bridge fees to Tustin Public Works Department. Orange County Sanitation District No. 7 fees to the Sanitation District. East Orange County Water District Fees to the Water District.
