HomeMy WebLinkAboutPC RES 28741 2 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21~ 22 23 24 25 26 27 28 RESOLUTION NO. 2874 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING VARIANCE 90-14, TO ALLOW A BUSINESS IDENTIFICATION WALL SIGN ON THE WEST SIDE ELEVATION TO INCREASE FROM 25-SQUARE FEET TO 64-SQUARE FEET IN ALLOWABLE SIGN AREA, SUBJECT TO CONDITIONS, AT 17240 E. SEVENTEENTH STREET. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae That a proper application Variance 90-14 has been filed on behalf of Cameron Meraj (First Team Real Estate) to allow a business identification wall sign to exceed the maximum allowable sign area at 17240 E. Seventeenth Street. Be That a public hearing was duly called, noticed and held for said application on February 11, 1991. Ce That the Planning Commission has reviewed the request to allow a business identification wall sign to exceed the maximum allowable sign area and can be supported by the following findings: · There are unusual or exceptional circumstances applicable to the size, shape, topography, location or intended use of the subject property which do not apply to other properties in the same zoning district. The narrow lot configuration, surrounding land uses and siting of the existing structure are unique factors pertaining to the site. · Granting of the Variance will not convey a special privilege to the property owner which is not enjoyed by other property owners in the vicinity. Other parcels along Seventeenth Street do not have this set of unusual circumstances. · The granting of the Variance will not be detrimental to adjacent and surrounding properties. The Planning Commission hereby approves Variance 90-14 to allow a business identification wall sign to exceed the maximum allowable sign area at 17240 E. Seventeenth Street. PASSED AND ADOPTED at a regular Planning Commission meeting on the 11th day of February, 1991. Recording Secretary EXHIBIT A RESOLUTION NO. 28?4 CONDITIONS OF APPROVAL VARIANCE 90-14 GENERAL *** 1.1 The proposed project shall substantially conform to (1) submitted plans date stamped June 11, 1990 on file with the Community Development Department as herein modified or as modified by the Director of Community Development. In accordance with this Exhibit, the Director of Community Development may also approve subsequent minor modifications to plans during plan check if such modifications are determined consistent with the approved plans. (1) 1.2 Unless otherwise specified, all conditions in this exhibit shall be complied with prior to issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Variance approval shall become null and void unless sign permits and all construction is completed within twelve (12) months of the date of this exhibit. (1) 1.4 Approval of Variance 90-14 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (5) 1.5 The business identification wall sign area on the west side building wall, facing the 1-55 Freeway, shall be limited to a maximum of 25 percent of the wall area, not to exceed 64-square feet. (5) 1.6 The business identification wall sign area on the front building wall, facing Seventeenth Street, shall be limited to a maximum of five percent of the wall area, not to exceed 25-square feet. All electrical components shall be U.L. listed. (1) 2.2 The applicant shall pay all applicable plan check and permit fees to the Community Deelopment Department.
