HomeMy WebLinkAboutPC RES 2870 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2870 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CONDITIONALLY APPROVING AMENDMENT #1 TO DESIGN REVIEW 90-48 AUTHORIZING THE INSTALLATION OF EXPOSED NEON TUBING ON THE EXTERIOR ELEVATIONS AT THE ENTRANCES TO AN EXISTING RESTAURANT LOCATED AT 17245 SEVENTEENTH STREET. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae That a proper application, Amendment #1 to Design Review No. 90-48, was filed on behalf of Consolidated Ribs of Southern California Inc. requesting approval of the installation of exposed neon tubing to the exterior elevations of the entry arches for the property located at 17245 Seventeenth Street. S. That this item is considered Categorically Exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. Ce That Tustin City Code Section 9444(i) and Section 9272(c) provides that the Planning Commission can determine whether exposed neon tubing is compatible with the architectural style and character of the building. De That the Planning Commission has considered the proposed installation, location, size, and illumination of the exposed neon tubing pursuant to the requirements of Tustin City Code Section 9272(c) and found that the proposal to locate the exposed neon tubing within the arch overhang above the doorway as modified is within this criteria. II. The Planning Commission of the City of Tustin does hereby authorize the installation of an exposed neon tubing on the exterior elevations of the entrances to an existing restaurant located at 17245 Seventeenth Street subject to the conditions attached hereto on Exhibit A. PASSED AND ADOPTED at a regular meeting of the Tustin Planning Commission, hel.d~on the 28th day January, 1991. Chairman ~ KATHLEEN CLANCY ~ Secretary EXHIBIT A AMENDMENT #1 TO DESIGN REVIEW 90-48 CONDITIONS OF APPROVAL RESOLUTION NO. 28?0 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped January 28, 1991 on file with the Community Development Department or as herein modified in accordance with this Exhibit. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Design review approval shall become null and void unless building permits are issued within eighteen (18) months of the date on this Exhibit. (1) 1.4 The applicant and property owner shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any building permits. (1) 1.5 Ail building signage shall be maintained in accordance with the Tustin Sign Code; specifically as pertains to the use of temporary banner displays which require an approved Temporary Use Permit from the Community Development Department. PLAN SUBMITTAL (1) 2.1 At building plan check, two sets of construction plans shall be submitted and the construction plans shall be in accordance with applicable Building Codes and shall be inspected by the Community Development Department during construction and prior to final. (4) 2.2 Prior to submitting for plan check, the applicant shall remove the neon sign that reads "Tony Roma's - A Place for Ribs" from the glassed archway in order for the property to be in compliance with the City's requirements of Section 9494 (b) and (c), SOURCE CODES (1) STANDARD CONDITION (5) RESPONSIBLE AGENCY REQUIREMENT (2) CEQA MITIGATION (6) LANDSCAPING GUIDELINES (3) UNIFORM BUILDING CODE/S (7) PC/CC POLICY (4) DESIGN REVIEW *** EXCEPTION Exhibit A Resolution No. 2870 Page 2 (4) Z.3 Plans submitted at plan check shall indicate the location of exposed neon tubing to be installed on the building wall or window arch attached above the doorway/window elevation (not on the arch overhang itself).
