HomeMy WebLinkAboutPC RES 2864 1 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 27 28 RESOLUTION NO. 2864 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN RECOMMENDING TO THE CITY COUNCIL APPROVAL OF FINAL PARCEL MAP 90-104. The Planning Commission does hereby resolve: I · The Planning Commission finds and determines as follows: A· That Final Parcel Map 90-104 has been submitted by CMS Development to consolidate 5 parcels into 3 for a retail/restaurant center. Be That a public hearing was held by the Planning Commission on July 9, 1990. At this hearing the Planning Commission recommended approval of Tentative Parcel Map 90-104 to the City Council. Subsequently, the City Council approved Tentative Parcel Map 90-104 on September 4, 1990. Co That following tentative map approval, the applicant filed Final Parcel Map 90-104 that conforms with the approved tentative parcel map, as permitted by the Subdivision Map Act. Certain modifications to conditions imposed were approved. De This project is Categorically Exempt, Class 15 from the requirements of the California Environmental Quality Act for the subject project area. E· That the proposed subdivision is in conformance with the Tustin Area General Plan, and Subdivision Map Act. F· That the site is physically suitable for the type of development proposed. G· That the site is physically suitable for the proposed density of development. Ho That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat. I · That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public-at- 6 7 8 9 10 11 12 13 14 15 16 17 18 19 21 23 24 ~5 26 1!7 28 Resolution No. 2864 Page 2 large, for access through or use of the property within the proposed subdivision. J · That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. Ke That the Final Map is in substantial conformance with the Tentative Map. II. The Planning Commission hereby recommends to the City Council approval of Final Parcel Map 90-104 subject to Final Approval of City Engineer. PASSED AND ADOPTED at a regular meeting of the Tustin Planning Commission, held on the 14th day of January, 1991.
