RESOLUTION NO. 2863
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, AUTHORIZING A SIX
MONTH EXTENSION OF CONDITIONAL USE PERMIT 89-
47 FOR A RETAIL CENTER FOR PROPERTY LOCATED ON
THE SOUTHWEST CORNER OF NEWPORT AVENUE AND THE
I-5 FREEWAY (14041 - 14061 NEWPORT AVENUE).
The Planning Commission of the City of Tustin resolves as
follows:
I ·
The Planning Commission finds and determines as
follows:
A·
A proper application (Extension of time for
CUP 89-47) has been filed on behalf of CMS
Development requesting an extension of time to
secure building permits for a retail center
totaling 45,376 square feet located on the
southwest corner of Newport Avenue and the I-5
Freeway (14041 - 14061 Newport Avenue).
Be
A Negative Declaration has previously been
approved in conformance with the California
Environmental Quality Act. For the
development and this extension is
categorically exempt Class 15.
C·
An extension of time is requested to satisfy
certain conditions of approval.
D®
That establishment, maintenance, and operation
of the extension applied for will not, under
the circumstances of this case, be detrimental
to the health, safety, morals, comfort, or
general welfare of the persons residing or
working in the neighborhood of such proposed
use, as evidenced by the following findings:

The extension applied for is in
conformance with the requirements of the
Tustin General Plan.
·
The extension applied for is in
conformance with the requirements of the
Tustin Zoning Code.
E·
That the establishment, maintenance, and
operation of the extension applied for will
not be injurious or detrimental to the
property and improvements in the neighborhood
of the subject property, nor to the general

welfare of the City of Tustin, and should be
granted.
II. The Planning Commission hereby approves a six month
extension of time for CUP 89-47. The project will
continue to be subject to all other conditions
contained in Resolution No. 2731 which are
incorporated herein by reference.
PASSED AND ADOPTED at a regular meeting of the Tustin
Planning Commission, held on the 14th day of January,
1991.
