The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae That a proper application, (Design Review No. 90-44) was filed by Harris, Pettett & Kent Architects on behalf of Tustin Nissan, requesting approval of a 3,584 square foot auto service building and storage/trash enclosure design at 30 Auto Center Drive. Be Pursuant to Section 9272 of the Tustin Municipal Code, the Commission finds that the location, size, architectural features and general appearance of the proposed development will not impair the orderly and harmonious development of the area, the present or future development therein, the occupancy as a whole. In making such findings, the Commission has considered at least the following items: 1. Height, bulk and area of buildings. 2. Setbacks and site planning. 3. Exterior materials and colors. 4. Co The proposed project is considered categorically exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. II. The Planning Commission conditionally approves Design Review 90-44 authorizing construction of a 3,584 square foot auto service building at 30 Auto Center Drive subject to conditions attached hereto as Exhibit A. KATHLEEN ~I-TZ P~TRI C~/ ReCording Secretary RESOLUTION 2860 EXHIBIT A CONDITIONS OF APPROVAL DESIGN REVIEW 90-44 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted site plans for the project date stamped January 14, 1991 on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this exhibit. (1) 1.2 Unless otherwise specified, all conditions contained in this exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (i) 1.3 This Design Review approval shall become null and void unless all necessary building permits are issued within eighteen (18) of the date on this exhibit and substantial construction is underway. Time extensions may be granted by the Community Development Department up to 6 months if a written request is received by the Community Development Department within thirty (30) days prior to expiration. Longer extensions shall require Planning Commission approval. (i) 1.4 The applicants and property owners shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any building permits and or business license. Prior to the issuance of any building permits for combustible construction, evidence that a water supply for fire protection is available shall be submitted to and approved by the Fire Chief. Fire hydrants and access roads shall be in place and operational to meet requirements and fire-flow prior to commencing combustible materials. NOISE (1) 4.1 Ail construction operations including engine warm up (2) shall be subject to the provisions of the City of Tustin Noise Ordinance and shall take place only during the hours of 7:00 a.m. until 6:00 p.m., Monday through Friday or other times that the Building Official determines will Exhibit A Resolution No. 2860 Page 3 and the public health and safety will not be impaired subject to application being made at the time the permit for the work is awarded or during progress of the work. Ail requirements of the City's Noise Ordinance (Chapter 6 of the Municipal Code) shall be met at all times which in part requires noise levels not to exceed 60 dba at any time. (1) 4.Z Outside public address speakers, telephone bells, buzzers and similar devices which are audible on adjoining properties must comply to the Tustin Auto Center Loudspeaker Criteria. *** 4.3 Identify location of paging equipment on the building plans. Said equipment shall comply with the adopted paging criteria for the Auto Center. BUILDING/SITE (4) 5.1 Provide a letter from Great Western Reclamation indicating that the proposed trash enclosures complies with access and recycling standards of Great Western Reclamation. (4) 5.Z Ail exterior colors to be used shall be subject to review and approval of the Director of the Community Development Department. All exterior treatments shall be coordinated with regard to color, materials and detailing and noted on submitted construction plans and elevations shall indicate all colors and materials to be used. (1) 5.3 Note on final plans that a six-foot-high chain linked fence shall be installed around the site prior to building construction stages unless area is secured by existing fencing. Gated entrances shall be permitted along the perimeter of the site for construction vehicles. Determination (To be completed by the Lead Agency) On the basis of this initial evaluation: I find that the proposed project COULD NOT have a significant effect on the environment, and a NEGATIVE DECLARATION will be prepared. x I find that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because the mitigation measure described on an attached sheet have been added to the project. A NEGATIVE DECLARATION WILL BE PREPARED I find the proposed project MAY have a significant effect on the environment, and an ENVIRONMENTAL IMPACT REPORT is required. Date EXHIBIT A INITIAL STUDY RESPONSES BACKGROUND This project, identified as Conditional Use Permit 90-33, has been undertaken by the applicant to transform an existing pick-up and delivery dry cleaning facility into an on premise dry cleaning facility. The project is located at 14031 Prospect Avenue in the Pinewood Plaza Shopping Center at the southwest corner of Prospect and Seventeenth Streets, which has a Planned Community - Commercial zoning designation. An on-premise dry cleaning plant is considered a retail use and is not considered different from other retail uses except in the introduction of flammable liquids in the dry cleaning process. Since a list of permitted or conditionally permitted uses was not established for the shopping center at the time of its Planned Community - Commercial zoning designation, allowed uses specified in the Tustin Zoning Code are applicable. Where dry cleaning plants are specified in the Tustin City Code commercial district regulations, they are subject to a Conditional Use Permit. Therefore this project requires a Conditional Use Permit. A majority of the responses to the Initial Study questions are negative as the proposed use is retail, which is suitable in the existing commercial center in which the proposed dry cleaning facility is located. 1. EARTH Items A throuqh G - "No": - The project site is within a developed shopping center and does not require any construction that would involve the moving of earth, resulting in unstable conditions, changes in topography or exposure to geological hazards. AIR Items A throuqh B - "Maybe" and Item C - "No": The proposed project is a stationary source of air pollution, and is considered to contribute to air emissions. Therefore it is subject to specific regulations by the South Coast Air Quality Management District. The project will utilize and maintain quantities of materials that may create objectionable odors. The project is in an existing developed urban area and will not have a significant impact on the climate, or pose Exhibit A Initial Study Responses Conditional Use Permit Page 2 · · · alterations in the movement of, moisture in, or temperature of the air. The project will have no affect on site drainage. The project will utilize water resources in its operation; however, the minimum amount of water consumption anticipated would not significantly reduce available water. ANIMAL LIFE Items A throuqh D - "No": Based on review of City records and the site field inspection, there are no known endangered or rare species known to inhabit the project site. NOISE Item A - "Maybe" and Items B - "No": The proposed use is not anticipated to substantially increase noise levels in the area or expose persons to severe noise levels, however, noise levels could be reduced by isolating swamp coolers and venting equipment to screened rooftop area; thereby minimizing impacts to surrounding properties. Similar impacts are created due to sporadic noise caused by car doors, ignition of car engines and human communications. This noise source is for the existing shopping center and does not exceed the parameters of the Noise Ordinance but may occasionally generate annoyance noise situations. Sources: Proposed Floor Plan Tustin Noise Ordinance Tustin General Plan Mitigation/Monitoring Required: As a condition of approval, the applicant will be required to operate per the requirements of the Tustin Noise Ordinance which in part limits noise generation to a maximum of 65 dba in commercial areas. The Community Development Department and Police Department would monitor the site and remedy any activities in violation of the Noise Ordinance. A second condition of approval would require the applicant to isolate swamp coolers and venting equipment in a screened area. LIGHT AND GLARE "No": The project will not require the addition of lighting as the development currently exists and there are no modifications to the exterior proposed. LAND USE "No": The project is within an existing shopping center zoned PC - Planned Community Commercial Zoning District. Since a list of permitted uses and conditionally permitted uses was not established for the shopping center at the time of its establishment, allowed uses specified in Tustin's commercial zoning districts are applicable. Where dry cleaning plants are specified in the commercial districts regulations they are subject to a Conditional Use Permit. Therefore, this project requires a Conditional Use Permit. The project will not result in alterations of the present or planned land uses on the site. NATURAL RESOURCES Items A and B - "No": The project will not generate the need for non-renewable natural resources. The proposed land use will not require significant quantities of natural resources or non-renewable resources. RISK OF UPSET Item A - "Maybe" and Item B - "No": The proposed use does require the handling of hazardous or explosive materials in Exhibit A Initial Study Responses Conditional Use Permit Page 5 limited quantities. However, any upset would not result in interference with emergency response on evacuation. Sources: Use Permit Application City of Tustin Risk Evaluation Map Mitigation/Monitoring Required: As a condition of approval the storage and use of chemicals on the premises would be required to be reported to the Orange County Fire Department. Such materials would then be monitored and regulated by the Orange County Fire Department and applicable Sections of the Uniform Fire Code, which would reduce the potential impacts to an acceptable level. 11. POPULATION "No": The project is relatively small in size and scale and will not increase the general population in the area. Therefore, no significant increase in population is anticipated as a result of the project. HOUSING "No": The project will not reduce the number of housing units within the City as the tenant space is part of an existing shopping center. There is an adequate supply of housing elsewhere in the City, and there will not be an increase in housing as a result of this project. TRANSPORTATION/CIRCULATION: Items A throuqh F - "No": The project entails the occupancy of an existing tenant space, part of an existing shopping center which maintains adequate allocated parking. The project is similar to other retail uses that have occupied the tenant space in the past and will not generate an extraordinary demand on the current transportation system. PUBLIC SERVICES Items A throuqh F - "No": The proposed use does not substantially contribute towards the concentration of or increase in the provision of public services such as police, fire, schools, parks and recreational facilities, or maintenance of public facilities. Typically, retail uses do not impact schools or parks and recreational type uses or facilities. This is due to the size, type and location of the project. Utilities are currently being provided to the tenant space. HUMAN HEALTH Items A and B - "Maybe": As noted previously in Item 10, the proposed use does involve the use of known hazardous or explosive materials as the various dry cleaning fluids will be stored on the premises. Sources: Use Permit Application Mitiqation/Monitorinq Required: As a condition of approval, the project will be required to meet both the SCAQMD and OCFD approvals and permits. The results of which would avoid or mitigate negative effects by requiring the specification of quantities, storage and use requirements. 18. SOLID WASTE "No": The project will contribute cumulatively to the solid waste disposal of the City. However, the contribution was anticipated during construction of the existing shopping center and the proposed use is not extraordinary to other retail uses in relationship to solid waste disposal. AESTHETICS "No": The project is not located along a scenic corridor or within a special design district and the project is within an existing tenant space of an existing shopping center. Any roof mounted equipment would be screened to protect the aesthetic qualities of the existing building. MANDATORY FINDINGS OF SIGNIFICANCE Item A - "No": Based upon the responses to Items 1 - 20 in this Initial Study, the review of City files, records and documents and the nature of the project, the project is not anticipated to significantly impact wildlife, fish, flora, fauna or cultural resources.
