HomeMy WebLinkAboutPC RES 2844 1 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 i9 ~0 22 23 24 25 26 ~7 28 RESOLUTION NO. 2844 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE MODIFICATION TO CONDITIONAL USE PERMIT 90-18 MODIFYING CONDITION NO. 2.1 OF RESOLUTION NO. 2821 TO PERMIT A CHANGE IN CONSTRUCTION MATERIAL FOR A REQUIRED PLAY YARD FENCE FROM A SLUMP BLOCK WALL TO DOUBLE-SIDED WOOD FENCING. The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: ao That a proper application (Modification to Conditional Use Permit No. 90-18) has been filed on behalf of Aldersgate Methodist Church to request a modification of Condition No. 2.1 of Planning Commission Resolution No. 2821 adopted August 27, 1990. B® That this item was continued from a public hearing duly called, noticed and held on said application on October 22, 1990 to the meeting of November 13, 1990. Co Pursuant to Section 9291 of the Tustin City Code, the Commission finds that the proposed modification to Conditional Use Permit 90-18 will not be detrimental to the health, safety, morals, comfort, general welfare of the persons working or residing in the neighborhood nor will it be injurious or detrimental to property and improvements in the area as the proposed modification will provide for compatible architectural design and treatment while providing adequate screening and security of the play yard areas and the overall site. De This project has been determined to be categorically exempt (Class 3) pursuant to Section 15303 of the California Environmental Quality Act. II. (1) 1.2 The modified Use Permit approval shall become null and void if the conditions herein are not completed within thirty (30) days from the date of Planning Commission approval. Time extensions may be granted by the Planning Commission if a written request is received by the Community Development Department within thirty (30) days prior to expiration. (1) 1.3 The applicant and property owner shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any building permits and/or business license. (1) 1.4 Condition No. 2.1 through 2.3 of this exhibit supersede Condition No. 2.1 of Resolution No. 2821, adopted by the Planning Commission on August 27, 1990. SITE AND BUILDING CONDITIONS *** 2.1 The site plan shall be modified to show all fencing and gates installed without authorization and include the alignment proposed on the submitted plans date stamped November 13, 1990. *** 2.2 The proposed alignment shown on the submitted plans date stamped November 13, 1990, shall be compatible in height with the fencing installed without authorization, not to exceed 6'-8" in height. *** 2.3 Ail fencing, proposed and previously installed, shall be double-sided and painted/stained to match trim on main buildings.
