HomeMy WebLinkAboutPC RES 28411 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 2841 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING AN AMENDMENT TO CONDITIONAL USE PERMIT 88-15, TO ALLOW REVISIONS TO THE MASTER SIGN PROGRAM FOR THE TUSTIN MARKET PLACE. The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: A· A proper application (Amendment to CUP 88-15) was filed by Donahue Schriber, representing the Irvine Company, requesting approval of an amendment to the Master Sign Program for the Tustin Market Place. Be A public hearing was duly called, noticed and held on said application on October 8, 1990. Ce Pursuant to Section 9291 of the Tustin Municipal Code, the Commission finds that the proposed amendment to the Master Sign Program will not be detrimental to the health, safety, morals, comfort or general welfare of persons residing or working in the general area nor will it be injurious or detrimental to the property or general welfare of the city of Tustin. The Commission further finds that the amended Master Sign Program will provide for signs that are compatible with, and complimentary to the architectural design and treatments of the Tustin Market Place, as evidenced by the following findings: · The safety of shopping center and theater patrons will not be compromised by the proposed plan. · The goals and objectives of the proposed amendment, and the locations, proportions, areas, and styling of sign types described in the proposed sign program are not injurious or detrimental to the welfare of the City or its residents. · The sign designs that result from the revised program will better serve public needs and interests than the originally- approved designs. 3 4 5 6 8 9 10 II 12 13 14 15 16 17 18 I9 20 21 22 23 24 25 26 27 28 Resolution No. 2841 Page 2 II. The Planning Commission hereby approves the amendment to Conditional Use Permit 88-15 to allow revisions to the approved master sign program for the Tustin Market Place, subject to conditions contained in Exhibit "A" attached hereto PASSED AND ADOPTED at a regular meeting of the Tustin Planning Commission, held on the 8th day of October, 1990. KA~H-L~RN ~I~ZPA~I CK Recording Secretary EXHIBIT A AMENDMENT TO CONDITIONAL USE PERMIT 88-15 CONDITIONS OF APPROVAL RESOLUTION NO. 2841 GENERAL (1) 1.1 Ail signage for the Tustin Market Place project shall substantially conform with the "Tenant Signage Criteria for the Tustin Market Place", Part 1 - Phase I, Phase II and General Provisions (Exhibit 1) and Part 2 - North Village: Buildings A, B & C (Exhibit 2), dated September 27, 1990, on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this exhibit. (1) 1.2 The applicant shall sign and return an Agreement to Conditions Imposed form prior to issuance of sign or building permits. (4) 1.3 Page 8 of the North Village Sign Plan (Exhibit 2) shall (5) be revised to eliminate all references to the acceptable use of moving, swinging, rotating, flashing, chasing, blinking or otherwise animated lights. (4) 1.4 Animated lights or other "moving" sign components shall (5) be included as prohibited elements in Exhibits 1 and 2. (4) 1.5 The North Village Sign Plan (Exhibit 2) shall be modified (5) to limit the total allowable sign area of any one tenant to that area which would be allowed for three building frontages. 1.6 The applicant shall revise the "Tenant Signage Criteria for the Tustin Market Place", Parts 1 and 2, to include all corrections and changes required by this Resolution for review and approval by the Community Development Department prior to the issuance of any sign permits affected by the amendment and this Resolution. Failure to submit the revised program within 30 days of approval may be grounds for the amendment to become null and void. Ail signs shall be subject to review and approval of the Director of Community Development for compliance with the Master Sign Program, including design, colors, illumination type, materials, etc., prior to issuance of permits for a sign. ~.9 Ail signs shall comply with the applicable provisions of the Uniform Building Code and the National Electrical Code as adopted by the City (including UL approvals). ~.~0 Permits shall be required for all signs as necessary. ~.~ Construction level plans, including any required structural calculations, for all project signs shall be submitted, reviewed and approved by the Community Development Department prior to issuance of sign permits. FEES Z.~ Ail applicable plan check, sign and building permit fees shall be paid to the Community Development Department prior to issuance of any sign permits. TO: FROM: SUBJECT: CHRISTINE SHINGLETON, DIRECTOR OF COMMUNITY DEVELOPMENT CITY ATTORNEY CORRECTION OF RESOLUTION NO. 2841 At the end of the last Planning Commission meeting, it was believed that the amended wording in Condition 1.7 of Resolution 2841 needed to be corrected from use of the word "minimum" to the word "maximum." It appears that there was simply an error in the use of the term, as the Planning Commission did intend a 10% minimum increase in signage. It is not necessary to adopt an amendment to this resolution, but there is a procedure that the City can use to correct the error so that the original of the resolution reflects what the Planning Commission intended and not what they mistakenly approved. The procedure we recommend is to place an item on the Consent Calendar entitled "Motion to Correct Error in Wording of Section 6.2 of Resolution No. 2841, Nunc Pro Tunc." Taking an action nunc pro tunc has the effect of correcting the error in the document as if no error had ever been made and the correct word was used at the time the resolution was adopted. This procedure is one followed by courts for the correction of "clerical errors." Such clerical errors include omissions and use of obviously incorrect language to describe a certain situation or result.
