HomeMy WebLinkAboutPC RES 2840 1 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 18 I9 20 21 22 23 24 25 26 27 28 I · RESOLUTION NO. 2840 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, CONDITIONALLY APPROVING CONDITIONAL USE PERMIT 90-24, AUTHORIZING THE ESTABLISHMENT OF A 2,000 SQUARE FOOT PET GROOMING FACILITY LOCATED AT 621 SOUTH "B" STREET, UNIT A. The Planning Commission finds and determines as follows: A® That a proper application (CUP 90-24) was filed on behalf of E1 Camino Pet Grooming, requesting approval of a 2,000 square foot pet grooming facility located at 621 South "B" Street, Unit A. Be That a public hearing was duly called, noticed and held on said application on October 8, 1990. Ce That the project has been determined to be Categorically Exempt (Class 3) pursuant to provisions of Section 15303 of the California Environmental Quality Act. De That the establishment, maintenance, and operating of the pet grooming facility will not, under the circumstances of this case, be detrimental to the health, safety, nor, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, as evidenced by the following findings: le By Minute Order on July 23, 1990, the use applied for was determined by the Planning Commission to be a use similar in character to other conditionally permitted uses in the Planned Industrial (PM) Zoning District and thereby authorized subject to approval of a conditional use permit. · The proposed pet grooming facility will be located in an existing industrial building and will not require structural modifications or alterations. · On-site parking requirements for the proposed pet grooming facility will be maintained and there is no proposed expansion of office use that would 1 3 4 5 6 7 8 9 10 11 13 14 15 16 17 18 i9 2O 21 23 24 26 27 28 Resolution No. 2840 Page 2 necessitate additional parking. Ze That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin as evidenced by the following findings: I · The proposed pet grooming facility will operate during hours compatible with other uses permitted in the district. · The proposed pet grooming facility will operate entirely within the interior of the tenant space including ancillary needs. · The proposed pet grooming facility is regularly scheduled for inspections by the County of Orange Animal Control, a Division of the Health Care Agency, to assure compliance with licensing and sanitary conditions. II. The Planning Commission hereby approves Conditional Use Permit 90-24 authorizing the establishment of a 2,000 square foot pet grooming facility located at 621 South "B" Street, Unit A, subject to the 1 2 3 4 5 6 8 9 10 11 12 13 14 15 17 i9 20 21 22 23 25 26 27 28 Resolution No. 2840 Page 3 conditions contained in Exhibit A, attached hereto and incorporated herein by reference. PASSED AND ADOPTED at a regular meeting of the Tustin Planning Commission, held on the 8th day of October, 1990. TZPA~ICK Recording Secretary EXHIBIT A RESOLUTION NO. 2840 CONDITIONAL USE PERMIT 90-24 CONDITIONS OF APPROVAL GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped October 8, 1990 on file with the Community Development Department, except as herein modified, or as modified by the Director of Community Development in accordance with this Exhibit. (1) 1.2 Use Permit approval shall become null and void if the pet grooming facility is not operative within twelve months of the date on this Exhibit. Time extensions may be granted by the Planning Commission if a written request is received by the Community Development Department within thirty (30) days prior to expiration. (1) 1.3 The applicant and property owner shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any building permits and/or business license. (1) 1.4 The applicant shall obtain a City Business License from the Community Development Department for the new location. PLAN SUBMITTAL 2.1 At building plan check the following shall be submitted: (3) A. Tenant Improvement plans, structural calculations, and Title 24 energy calculations. Requirements of the Uniform Building Codes, State Handicap and Energy Requirements shall be complied with as approved by the Building Official. SITE *** 3.1 The office square footage shall not be increased and shall be limited to 400 square feet unless sufficient parking can be provided subject to review by the Community Development Department. SOURCE CODES (1) STANDARD CONDITION (5) RESPONSIBLE AGENCY REQUIREMENT (2) CEQA MITIGATION ( 6 ) LANDSCAPING GUIDELINES (3) UNIFORM BUILDING CODE/S (7) PC/CC POLICY (4) DESIGN REVIEW *** EXCEPTION Exhibit A Conditional Use Permit 90-24 October 8, 1990 Page 2 OPERATIONAL CONDITIONS *** 4.1 The subject pet grooming facility shall restrict hours of operation to 7:30 a.m. - 6:00 p.m., Tuesday through Saturday. *** 4.Z Ail grooming and related temporary housing of animals shall be performed within the interior of the building at all times. *** 4.3 No animals shall be permitted to run loose or at large while under service of the subject pet grooming facility. *** 4.4 At no time shall animals, while under service of the subject pet grooming facility, be permitted or led to defecate anywhere on the premises of the exterior of the building. *** 4.5 The subject pet grooming facility shall obtain and satisfy all necessary permits and requirements of the Orange County Animal Control, a Division of the Health Care Agency including, but not limited to, maintaining sanitary conditions and proper disposal of animal waste. *** 4.6 The subject pet grooming facility shall not be permitted to board animals overnight.
