RESOLUTION NO. 2838
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, CONDITIONALLY
APPROVING DESIGN REVIEW 90-18 ON LOT 9 OF
TRACT NO. 12763.
The Planning Commission of the City of Tustin does hereby
resolve as follows:

The Planning Commission finds and determines as
follows:
A·
That a proper application, Design Review No.
90-18, was filed by the Community Services
Department of the City of Tustin requesting
approval of a Neighborhood Park conceptual
plan on Lot 9 of Tract No. 12763.

The subject site has been dedicated to the
City with recordation of Tract 12763 in
accordance with the City's Recreation Element,
and East Tustin Specific Plan.

That EIR (85-2), as supplemented, has
previously been prepared, considered, approved
and certified which adequately addresses this
proposal and no additional environmental
documentation need be prepared.

Pursuant to Section 9272 of the Tustin
Municipal Code, the Commission finds that the
location, size, architectural features and
general appearance of the proposed development
will not impair the orderly and harmonious
development of the area, the present or future
development therein, the occupancy as a whole.
In making such findings, the Commission has
considered at least the following items:
1. Height, bulk, and area of buildings.
2. Setbacks and site planning.
3. Exterior materials and colors.
4. Type and pitch of roofs.

Size and spacing of windows, doors and
other openings.
·
Towers, chimneys, roof structures,
flagpoles, radio and television antennae.

of a neighborhood park subject to conditions
attached hereto as Exhibit A.
PASSED AND ADOPTED by the Planning Commission of the City
of Tustin at a regular meeting held on the 24th day of
September, 1990.

CONDITIONS OF APPROVAL
RESOLUTION NO. 2838
GENERAL
(1) 1.1 The proposed project shall substantially conform with the
submitted plans for the project date stamped September
24, 1990, on file with the Community Development
Department, as herein modified, or as modified by the
Director of Community Development Department in
accordance with this Exhibit.
(1) 1.2 Unless otherwise specified, all conditions contained in
this Exhibit shall be complied with prior to the issuance
of any permits for the project, subject to review and
approval by the Community Development Department.
(1) 1.3 Use Permit approval shall become null and void unless all
necessary permits are issued within one year of approval
of said application. Time extensions may be granted by
the Planning Commission if a written request is received
by the Community Development Department thirty (30) days
prior to expiration.
(1) 1.4 The applicant shall sign and return an Agreement to
Conditions Imposed form prior to the issuance of any
building permits and/or business license.
PLAN SUBMITTAL
2.1 At building plan check submittal:

Plans and calculations, to satisfy the requirements
of the Uniform Building Codes and State Handicap
Codes shall be complied with as approved by the
Building Official.

Final grading and specifications consistent with the
site plan and landscaping plans and prepared by a
registered civil engineer for approval of the
Community Development Department.

A precise soils engineering report provided by a
soils engineer within the previous twelve (12)
months.
Information, plans and/or specifications to ensure
satisfaction of all Public Works Department
requirements including but not limited to:
·
The 20 foot wide storm drain easement along
the northwestern property line will need to be
shown along with the 42" RCP and the 18" RCP
lateral to this lot.
·
No trees will be permitted within the storm
drain easement.
3. A grading plan will be required.
·
An on-site storm drain system should be
constructed and connected to the existing 18"
RCP lateral near the westerly corner of this
parcel.
·
Detail of the drain system is needed with
respect to the sand play area.
·
Ail related construction within the street
right-of-way must be shown on a separate 24" x
36" street improvement plan.
Information to ensure compliance with all (6)
requirements of the Orange County Fire Chief
including required fireflow and installation, where
required, of fire hydrants subject to approval of
the Fire Department, and City of Tustin Public
Works Department and compliance with all
requirements pertaining to construction as follows:
1)
Prior to the issuance of any building permits
for combustible construction, evidence that a
water supply for fire protection is available
shall be submitted to and approved by the Fire
Chief. Fire hydrants and access roads shall
be in place and operational to meet
requirements and fire-flow prior to commencing
combustible materials.

Prior to the issuance of any building permits,
all underground piping for automatic fire
extinguishing system shall be approved by the
Fire Chief. These details shall include
width, clear height, and means of emergency
vehicle over-ride.
SITE CONDITIONS
3.1 Note on final plans that a six foot high chain
linked fence shall be installed around the site
prior to building construction stages. Gated
entrances shall be permitted along the perimeter of
the site for construction vehicles.
LANDSCAPING, GROUNDS AND HARDSCAPE ELEMENTS

4.1 Submit at plan check complete detailed landscaping
and irrigation plans for all landscaping areas
consistent with adopted City of Tustin Landscaping
and Irrigation Submittal Requirements. Provide
summary table applying indexing identification to
plant materials in their actual location. The plan
and table must list botanical and common names,
sizes, spacing, actual location and quantity of the
plant materials proposed. Show planting and
berming details, soil preparation, staking, etc.
The irrigation plan shall show location and control
of backflow prevention devices, pipe size,
sprinkler type, spacing and coverage. Details for
all equipment must be provided. Show all property
lines on the landscaping and irrigation plan,
public right-of-way areas, sidewalk widths, parkway
areas, and wall locations. The Department of
Community Development may request minor
substitutions of plant materials or request
additional sizing or quantity materials during plan
check. Note on landscaping plan that coverage of
landscaping irrigation materials is subject to
field inspection at project completion by the
Department of Community Development.
(1) 4.2 Provide details, colors, and materials for all
(4) exterior walkways, stairs and walls. Design interior
walkways to create a reinforced pedestrian corridor with
accessory landscaping treatment.

(1) 4.3 Entryways to the project site should be focal points. In
(4) addition to larger tree treatments these areas should be
provided with a variety of color and treatment of
landscaping as well as an incorporation of special
decorative pavement treatment.
(1) 4.4 Indicate lighting scheme for project, note
(4) locations of all exterior lights and types of fixtures.
No lights shall be permitted which may create any glare
or have a negative impact on the residential properties.
The location and types of lighting shall be subject to
the approval of the Director of Community Development.
(1) 4.5 Submit plans for park identification monument sign.
(4) Indicate details, colors and materials. Design and
materials should reflect typical monument signage evident
of the City's "Welcome Monument" sign and/or adjacent
development intersection identification monument signs.
The sign design shall be subject to the approval of the
Director of Community Development.
NOISE
(1) 5.1 Ail construction operations including engine warm up
shall be subject to the provisions of the City of Tustin
Noise Ordinance and shall take place only during the
hours of 7:00 a.m. until 6:00 p.m., Monday through Friday
or other times that the Building Official determines will
be in substantial conformance with the Noise Ordinance
and the public health and safety will not be impaired
subject to application being made at the time the permit
for the work is awarded or during progress of the work.
