HomeMy WebLinkAboutPC RES 2833 6 7 8 9 10 11 12 13 14 15 16 17 18 i9 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2833 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING CONDITIONAL USE PERMIT 90-05, TO AUTHORIZE THE ESTABLISHMENT OF A SELF-SERVICE GASOLINE STATION AND A SELF SERVICE CARWASH ON LOT 13 OF TRACT 12763 IN THE NC (NEIGHBORHOOD COMMERCIAL) DISTRICT OF THE EAST TUSTIN SPECIFIC PLAN. The Planning Commission does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ao That a proper application, (Conditional Use Permit No. 90-05) has been filed by Donahue Schriber to authorize a self-service gasoline station and self- serve carwash on Lot 13 of Tract 12763 in the NC (Neighborhood Commercial) District of the East Tustin Specific Plan. Be That a public hearing was duly called, noticed and held on said application on September 10, 1990. Ce That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: · The proposed use is a conditionally permitted use within the NC (Neighborhood Commercial) District pursuant to Section 3.7.1 A of the East Tustin Specific Plan. · The proposed use is consistent with the PCC (Planned Community - Commercial) Land Use Designation on the City's General Plan. · The proposed use is consistent and appropriate for inclusion within the commercial center and has been designed to maximize aesthetic consideration and minimize circulation, access and operational impacts on the surrounding street system and within the center. · The location of the facility on the site would not be detrimental to neighboring residential properties due to several other retail buildings buffering the residential uses. 1 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 i9 20 21 22 23 24 25 26 27 28 Resolution No. 2833 Page 2 De That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted as evidenced by the findings stated in Section C above. II. The Planning Commission hereby approves Conditional Use Permit No. 90-05 to authorize the establishment of a self-service gasoline station and self-serve carwash on Lot 13 of Tract 12763 subject to the conditions attached hereto as Exhibit A. K~THLEEN FITZ~RICK - Recording Secretary RESOLUTION 2833 EX~__IBIT A CONDITIONS OF APPROVAL FOR AMENDMENT TO CONDITIONAL USE PERMIT 90-05 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted site plan for the project date stamped September 10, 1990 on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this exhibit. (1) 1.2 Unless otherwise specified, all conditions contained in this exhibit shall be complied with prior to the issuance of a building permit for the project, subject to review and approval by the Community Development Department. (1) 1.3 Use permit approval shall become null and void unless all building permits are issued within one year of the date on this Resolution and substantial construction is 'underway. (1) 1.4 The applicant shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any building permits. (1) 1.5 Ail applicable conditions of Planning Commission 2832 shall also apply to this resolution and are incorporated herein by reference including plan check and grading submittal requirements, building modifications, landscaping, signs, Fire Department and Public Works requirements. OPERATIONAL STANDARDS *** 2.1 The carwash is to be self-serve with no attendants to rinse, clean, dry or operate the vehicles. The carwash use is only authorized under this use permit in conjunction with a gasoline station. *** 2.2 No mechanical work of any kind is authorized in conjunction with the operation of the service station. SOURCE CODES (1) STANDARD CONDITION (5) RESPONSIBLE AGENCY REQUIREMENT (2) CEQA MITIGATION (6) LANDSCAPING GUIDELINES (3) UNIFORM BUILDING CODE/S (7) PC/CC POLICY (4) DESIGN REVIEW *** EXCEPTION Exhibit A Resolution No. 2833 Page 2 *** 2.3 No inoperative vehicles shall be parked on the site. *** 2.4 Ail customers, employees and/or vendors must park in designated parking spaces except when at the pump island dispensing a product or paying for services. *** 2.5 The doors to the carwash shall be closed during non- business hours. (1) 2.$ Ail requirements of the City's Noise Ordinance (Chapter 6 of the Tustin City Code) shall be met at all times, which, in apart, requires noise levels not to exceed 60 dba at any time. FEES (6) 3.~ Prior to the issuance of any building permits, payment shall be made of all required fees including, but not limited to those fees identified in Planning Commission Resolution No. 2833.
