HomeMy WebLinkAboutPC RES 2828 1 2 3 4 5 6 8 9 10 II 12 13 14 15 16 17 18 i9 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2828 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 90-22, AUTHORIZING TEMPORARY PARKING OF UP TO 100 CARS ON LOT 17 OF TRACT 12763. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A® That a proper application (Conditional Use Permit 90-22) has been filed by the Community Services Department of the City of Tustin, to allow temporary parking of up to 100 cars on Lot 17 of Tract 12763. Be That a public hearing was duly called, noticed and held on said application on September 10, 1990. C® That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: · The use applied for is in conformance with the Tustin General Plan as the General Plan. · The subject property is located in the PC - East Tustin Specific Plan, Mixed Use Designation and has been determined to be a conditionally permitted use in said district by the Community Development Department. · The proposed use will not negatively effect surrounding property owners, in that the use of the land is temporary and will be screened in an appropriate manner. De That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. The project is categorically exempt (Class 4) pursuant to the provisions of Section 15304(e) of the California Environmental Quality Act. 8 9 lO 11 12 13 14 15 16 17 18 I9 20 9_1 22 23 24 25 27 28 Resolution No. 2828 Page 2 II. The Planning Commission hereby approves Conditional Use Permit 90-22 to allow temporary parking of up to 100 cars on Lot 17 of Tract 12763 subject to conditions contained in Exhibit A, attached hereto and incorporated herein by reference. PASSED AND ADOPTED at a regular meeting of the Tustin Planning Commission, held on the 10th day of September, 1990. Secretary Chairman RESOLUTION 2828 E~WIBIT A CONDITIONS OF APPROVAL CONDITIONAL USE PERMIT 90-22 TEMPORARY PARKING - LOT 17, TRACT 12763 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted site plans for the project date stamped September 10, 1990 on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this exhibit. (1) 1.2 Unless otherwise specified, all conditions contained in this exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Use Permit approval shall become null and void unless the following is satisfied prior to use of the lot for storage of vehicles: ae Ail required permits issued and all required work completed. be Ail required plans for the proposed storage building at 9 Auto Center Drive and approved by Variance 90-12 and Design Review 90-15 are submitted for plan check. C® If Variance 90-12 (Resolution No. 2827) becomes null and void then this use permit shall also become null and void automatically. *** 1.4 The life of the Use Permit is subject to the following restrictions: ae Construction of the subject storage building at 9 Auto Center Drive shall be completed within 12 months from the date of this exhibit. This Use Permit shall become null and void at termination of this 12 month time frame or sooner if said storage building is completed within said 12 months. (1) 1.5 The applicants and property owners shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any building permits and or business license. PLAN SUBMITTAL (1) 2.1 Submit plans to the Public Works and Community Development Departments to ensure compliance with all conditions contained herein. The subject plans shall be reviewed and approved by the aforementioned departments prior to usage of the lot for the storage of vehicles. USE RESTRICTIONS *** 3.1 Transport trucks will not be allowed to unload the vehicles on E1 Camino Real. Either provide adequate space on-site for the unloading of vehicles and the turn around of the transport truck (so that it will not "back out" onto E1 Camino Real) or unloaded vehicles within the Tustin Auto Center and then drive them to the subject storage area. BUILDING/SITE (1) 4.1 The area shall be enclosed with a maximum 6' 8" high chain link fence with a green nylon mesh to be used as a screening device. A sample of the mesh shall be submitted to the Community Development Department prior to application. *** 4.Z Plans shall be submitted which identify all grading activities including but not limited to the removal of a portion of the existing landscape berms and drainage patterns. (1) 4.3 Indicate lighting scheme for project. Note location of all exterior lights. The location and types of lighting shall be subject to the approval of the Director of Community Development. Exhibit A Resolution No. 2828 Page 3 (1) 4.4 A dust and erosion control plan shall be submitted to, reviewed and approved by the Community Development Department prior to storage of vehicles on the lot. The lot and access shall also be surfaced with loose gravel or D.G. *** 4.5 Ail debris from the adjacent stockpile on the subject site shall be removed prior to the use of the lot for storage of vehicles. Said dumping of debris (garbage) on the site is illegal and shall be discontinued. (1) 4.6 Any damage done to existing street improvements and (6) utilities as a result of said activity shall be repaired after use is discontinued. The applicant shall be financially responsible for any damage. 4.7 The applicant shall post a minimum $2,500 cash deposit or letter of credit to guarantee the sweeping of streets and clean-up of streets affected by use of the subject lot for storage. In the event this deposit is depleted prior to termination of the use an additional incremental deposit will be required. FEES (1) 5.1 Prior to the issuance of permits, payment shall be made of all required fees as set forth below: a · Ail applicable building plan check fees to the Community Development Department. b. A $2,500 deposit for street sweeping. Ce Grading plan checks and permit fees to the Community Development Department.
