HomeMy WebLinkAboutPC RES 2807 3 4 5 6 8 9 10 11 12 13 14 15 17 18 i9 20 21 24 25 27 28 RESOLUTION NO. 2807 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA APPROVING AN AMENDMENT TO CONDITIONAL USE PERMIT 89-47 TO DELETE CONDITION OF APPROVAL NO. 6.5 OF PLANNING COMMISSION RESOLUTION NO. 2731 REQUIRING A MAINTENANCE AGREEMENT WITH CAL TRANS FOR A LANDSCAPE SETBACK ALONG THE NORTHERLY PROPERTY LINE ADJACENT TO THE I-5 FREEWAY INCLUDING THE REQUIREMENT OF A ENTRY IDENTIFICATION SIGN FOR THE PROJECT LOCATED ON THE SOUTHEAST CORNER OF NEWPORT AVENUEAND THE I-5 FREEWAY, 14041 NEWPORT AVENUE. The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: A· That a proper application has been filed on behalf of CMS Development requesting a waiver of Condition of Approval No. 6.5 of Resolution No. 2731 requiring a maintenance agreement with Cal Trans for a landscape setback along the northerly property line adjacent to the I- 5 Freeway including the requirement of an entry identification sign for the project located on the southeast corner of Newport Avenue and the I-5 Freeway, 14041 Newport Avenue. Be That an amendment to the Planning Commission's approval of CUP 89-47 has been reviewed by the Planning Commission of the City of Tustin of a request by CMS Development to delete a condition requiring a landscaping maintenance agreement with Cal Trans along the northerly property line adjacent to the I-5 Freeway including the requirement of an entry identification sign for the project located at 14041 Newport Avenue. A public hearing for said amendment was duly called, noticed and held on August 13, 1990. Ce That the request of deletion of Condition of Approval No. 6.5 including the requirement of an entry identification sign will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, as evidenced by the following findings: 5 6 7 8 9 10 11 12 13 14 15 16 17 18 I9 2O 21 22 23 25 26 27 28 Resolution No. 2807 Page 2 · The uses applied for are in conformance with the requirements of the Tustin General Plan. · The uses applied for are in conformance with the requirements of the Tustin Zoning Code. · The project has been designed to be architecturally compatible with area. · The project has been conditioned to allow only those uses which will be compatible with neighboring and adjacent uses. · The proposed development conforms with the established guidelines for development of Planned Community Commercial properties as established by Planning Commission Resolution No. 2411. II. The Planning Commission hereby approves an amendment to Conditional Use Permit 89-47, deleting Condition of Approval No. 6.5 of Planning Commission Resolution No. 2731 requiring a maintenance agreement with Cal Trans for landscape setback along the I-5 Freeway and an amendment to the approved site plan to delete the requirement of an entry identification sign for the northeast corner of the project site located at 14041 Newport Avenue. All other Conditions of Approval contained in Planning Commission Resolution No. 2731 shall remain in force. PASSED AND ADOPTED at a regular meeting of the Planning Commission of the City of Tustin, held on the 13th day of August, 1990.
