HomeMy WebLinkAboutPC RES 2803 6 8 9 10 11 12 13 14 15 16 17 18 I9 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 2803 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, CONDITIONALLY APPROVING CONDITIONAL USE PERMIT 90-17, AUTHORIZING THE ESTABLISHMENT OF A 2,961 SQUARE FOOT EMPLOYEE TRAINING CENTER IN CONJUNCTION WITH A 17,736 SQUARE FOOT, AUDIO/VIDEO RETAIL SALES STORE AT 2741 EL CAMINO REAL. The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: A· That a proper application (CUP 90-17) was filed on behalf of The Good Guys!, requesting approval of a 2,961 square foot employee training center in conjunction with their 17,736 square foot retail store located at 2741 E1 Camino Real in the Tustin Market Place. Be Ce That a public hearing was duly called, noticed and held on said application on July 23, 1990. That the establishment, maintenance, and operation of the employee training center will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: i · The use applied for is in conformance with the East Tustin Specific Plan (ETSP) in that the subject employee training center is ancillary to and supportive of a retail electronics store, which is a permitted use in the Mixed Use land use category of the ETSP. · The proposed employee training center is located immediately adjacent to The Good Guys! retail store, and will serve only employees of The Good Guys!. · On-site parking requirements for the proposed training center will not exceed the number of spaces required if the floor area were used for retail purposes. 6 8 9 10 11 12 13 14 15 16 17 18 i9 20 21 22 23 24, 25 26 27' 28 Resolution No. 2803 Page 2 De That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, as the proposed use will operate only during the hours of the adjacent Good Guys! retail store in addition to other facts cited above. Ee Proposed improvements shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official and Fire Code as administered by the Orange County Fire Marshall. II. The Planning Commission hereby approves CUP 90-17, authorizing improvement of a 2,961 square foot employee training center in conjunction with a 17,736 square foot retail store, operated by The Good Guys~., at 2741 E1 Camino Real in the Tustin Market Place, subject to the conditions contained in Exhibit A, attached hereto. PASSED AND ADOPTED by the Planning Commission of the City of Tustin at a regular meeting held on the 23rd day of July, 1990. KA~HLEEN FITZ ~TR~ICK Recording Secretary EXHIBIT A RESOLUTION NO. 2803 CUP 90-17 CONDITIONS OF APPROVAL GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped July 23, 1990 on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Conditional use permit approval shall become null and void unless all building permits are issued within twelve (12) months of the date of this Exhibit and substantial construction is underway. PLAN SUBMITTAL 2.1 At building plan check the following shall be submitted: (3) A. Tenant Improvement plans, structural calculations, and Title 24 energy calculations. Requirements of the Uniform Building Codes, State Handicap and Energy Requirements shall be complied with as approved by the Building Official. (5) B. Information to ensure compliance with all requirements of the Orange County Fire Chief including but not limited to separation walls and fire sprinklers. Entry door design shall be glass storefront consistent with the Tustin Market Place (color, tinting, materials and hardware). *** D. Exterior modifications, except for required entries and exits, shall be prohibited. OPERATIONAL CONDITIONS *** 3.1 The subject employee training center shall serve only employees of The Good Guys! (2) 3.Z Occupancy of the employee training center shall be restricted to a maximum of 20 "students", two (2) coordinators and one (1) receptionist at any time. (2) 3.3 The subject employee training center shall be ancillary to and supportive of The Good Guys! retail operation and is not permitted as a primary use in and of itself. SIGNAGE *** 4.1 The proposed training center shall be permitted one directional/identification sign only, having a maximum area of six (6) square feet to be located on the entrance door only, to the training facility. The design of said sign shall be consistent with the Sign Program for the Tustin Market Place and will require the submittal of separate plans for review and approval by the Community Development Department.
